The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.org *********************************************************************** transcribed from SAMPUBCO copy by Carol Mason Monroe Co NY ROBINSON, Martha, Rochester Vol. 41 page 85 Record of Will In the name of God, Amen: Martha Robinson, of the City of Rochester, County of Monroe and State of New York, of the age of eighty years and being of sound mind and memory, do make, publish and declare this my last will and testament in manner following that is to say: First: I give, bequeath and devise all my property and estate, both real and personal of every name and nature and wheresoever situate to my Executors hereinafter nominated, their successor and successors in office, in trust nevertheless to sell and convey the same at public or private sale and at such time and prices and upon such terms as they shall deem proper and to convert the same into money and out of the avails thereof, after payment of my just debts and funeral expenses, to pay the following legacies, to wit: To my grandson, Robert K. Toaz, the sum of one hundred and fifty dollars. To my Son, Joseph B. Robinson, the sum of fifty dollars to reimburse him for moneys advanced by him, at my request, for the use of my daughter, Martha. To my sons, Williams Robinson and John D. Robinson, not exceeding three dollars per week each, provided and as long as the same shall in the opinion of my said Executors, their successor or successors in office be necessary for their support respectively, also their funeral expenses respectively; not however to exceed in all to each of them the one fifth part of said avails after payment of said debts and funeral expenses. And to my sons Joseph B. Robinson and Samuel G. Robinson and my daughter, Ellen Toaz, the residue of said avails equally, share and share alike. I hereby release and discharge my said son, John D. Robinson of and from all debts and demands which I may have against him for borrowed money or otherwise. Second, and Lastly, I nominate and appoint my sons, Joseph B. Robinson and Samuel G. Robinson, both of said City of Rochester to be executors of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal at said City of Rochester this 10th day of September 1886. Martha Robinson Witnesses: Geo. Truesdale William K. Toaz The foregoing instrument, consisting of one sheet was on the day of the date thereof subscribed by Martha Robinson, the testatrix therein mentioned in our presence and she at the same time declared the same to be her last will and testament in the presence of each of us, who at the same time at her request and in her presence and in the presence of each other have subscribed our names hereto and at the end of said will as witnesses. Geo. Truesdale, Rochester, NY William K. Toaz, Rochester, NY In the Matter of Proving the Last Will and Testament of Martha Robinson, Deceased. Monroe County, ss. George Truesdale and William K. Toaz, being first duly sworn in open Court, each for himself doth depose and say, that he is a subscribing witness to the last Will and Testament of Martha Robinson late of the City of Rochester, in the County of Monroe and State of New York, deceased. And these deponents do further say, that the said Martha Robinson, deceased, did, in the presence of each of these deponents subscribe her name at the end of the instrument in writing, which is now here shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 10th day of September, 1886.
