I, John Cummings of the Town of Union in the County of Monroe and State of New York of the age of Seventy-five years on the twenty-sixth day of February in the year of one thousand eight hundred and fifty-three, and being sound of mind and memory do make and publish and declare this my Last Will and Testament in the manner following: First, I give and bequeath to my wife, Martha Cummings and Ann D. Cummings all of my real and personal estate, equal between my wife Martha and Ann D. Cummings which consists of as follows: the equal undivided half of lot number five in the sixteenth section of town number four of the town of Union in Monroe County and State of New York being in all of said lot seventy-six and a half acres and all of my personal property which consists of one half of all of the stock cattle sheep, horses hogs, ha, grain, farming utensils of all kinds which is now upon the place or may be at the time of the division of the said property of which George Cummings now owns one half with the exceptions mentioned hereinafter; first the said Ann D. owns two beds and bedding and one turkey(sic)carpet and all of the furniture which I bout(sic) with me shall be equally owned by my wife Martha and the said Ann D. Cummings also the undivided half of the house hold furniture which has been bot since the said George Cummings became partner is to belong equally to the said Martha and Ann D. Cummings and I bequeath to the said George Cummings all of my wairing(sic) apperiel(sic) at my decease and my wish and will is that if the said Martha Cummings should outlive the said Ann D. Cummings all of the afforesaid(sic) property shall belong to the said Martha, and if the said Ann D. Cummings shall outlive the said Martha Cummings, all of the afforesaid willed property shall belong to the said Ann D. Cummings. The intention of the afforesaid will is that all of the property belonging to the said John Cummings shall at his death belong equally to the afforesaid Martha and Ann D. Cummings in witness whereof I have hereunto set my hand seal this third day of March in year of our lord one thousand eight hundred and fifty three. /s/ John Cummings {L.S.} The above instrument consisting of two half sheets attached together with (wafers) was at the date thereof signed and sealed, published and declared by the said John Cummings as and for his last Will and Testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto. /s/ Henry Kimball residing at Union, Monroe County /s/ Sarah Kimball residing at Union, Monroe County And lastly I do hereby nominate and appoint my friend John (Shank) and my Daughter Ann D.
