Winne of Fairport Monroe County N.Y. hereby make publish, and declare this my last will and testament revoking all former wills by me made. First. I direct my Executrix hereinafter named to pay all my lawful debts, and my funeral expenses. Second. I give devise and bequeath to my daughter, Mrs. Nettie Worden the sum of fifteen hundred dollars. Third. I give devise and bequeath to my daughter Mrs. Elizabeth P. Winne the sum of Twenty five hundred dollars. Fourth. To my son Frank A. Winne I give the sum of Two hundred dollars. Fifth. To my grand daughter Mrs. Gertrude Winne of Adrian Michigan, I give the sum of two hundred dollars. Sixth. I hereby make the payment of the above legacies a charge upon my real estate. Seventh. All the rest, residue and remainder of my estate both real and personal, and mixed I hereby give devise and bequeath to my daughter Mrs. Elsie Talman. Eighth. I hereby nominate my said daughter Mrs. Elsie Talman to be the Executrix of this will, and hereby authorize and empower my said Executrix to sell and convey any or all of my real property. In witness whereof I have hereunto set my hand and seal this 26 day of July 1892. Electa L. Winne. L.S. The foregoing instrument was at this date thereof subscribed by Mrs. Electa L. Winne the testator therein named, in the presence of us, and each of us, and she at the same time acknowledged to each of us that she executed the same and she declared the said instrument to be her last will and testament, and we at her request, and in her presence, and in the presence of each other do here subscribe our names as witnesses thereto. Robert B. Cole, residing at Fairport N.Y. Mark O. Garnsey residing at Fairport N.Y. Surrogate's Court. In the Matter of Proving the Last Will and Testament of Electa L. Winne, Deceased. Monroe County, ss. Robert B. Cole and Mark O. Garnsey being first duly sworn in open Court, each for himself doth depose and say, that he is a subscribing witness to the last Will and Testament of Electa L. Winne late of the town of Perinton, in the County of Monroe and State of New York, deceased. And these deponents do further say, that the said Electa L. Winne deceased, did, in the presence of each of these deponents, subscribe her name at the end of the instrument in writing, which is now here shown to the deponents, and which purports to be the last Will and Testament of the said deceased which bears the date on the 26th day of July one thousand eight hundred and ninety-two. That the said deceased died on or about the 21st day of October 1892 at Perinton aforesaid, as deponents are informed and believe. That the said deceased did, at the time of subscribing her name to the said instrument as aforesaid, declare the same to be her last Will and Testament; and these deponents did thereupon subscribe their own respective names, at the end of said instrument, as attesting witnesses to the execution thereof, each at the request of the said deceased, and in her presence and the presence of each other. That the said deceased at the time of so subscribing her name to the said instrument as aforesaid, and publishing said instrument as aforesaid, was of full age, and a citizen of the United States; that she appeared to be, and deponents believe she was, of sound mind, memory, and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to the said instrument, in the presence of said deceased, Robert B. State of New York, County of Monroe, Surrogate's Office, ss. I Hereby Certify, that the annexed instrument, being the Last Will and Testament of Electa L. Winne late of the Town of Perinton in the County of Monroe and State of New York, deceased, has upon due proof, been this day admitted to probate by the Surrogate's Court of said County of Monroe, as a will valid to pass real and personal property; which said last Will and Testament, and the proofs and examinations taken thereon, are recorded in the office of the Surrogate of said last mentioned County. In Testimony Whereof, I have hereunto set my hand and affixed the seal of said Surrogate's Court at Rochester, in said County, this 30th day of January one thousand eight hundred and ninety-three. Winne at the time she executed the same, was in all respects competent to devise real estate, and not under restraint, the said last Will and Testament and the proofs and examinations are hereby recorded, signed and certified by me, pursuant to the provisions of the Code of Civil Procedure, this 30th day of January A.D. 1893.
