First: I will , devise and bequeath to my sons Andrew Bushman and John Bushman, Jacob Bushman and David Bushman and my four daughters, viz: Elizabeth, now, Elizabeth Rhynehart, my daughter Polly, now Polly Inglesby, my daughter Catherine, now Catharine Robertson, and my daughter Margaret, now Margaret Burghduff, all my estate Real and Personal, to be divided equally between them after my decease and not until that time saving and excepting fifty cents each, reserved to Henry Bushman, Sally Bushman afterwards Sally Robertson, Nancy Bushman now Nancy OHarry (O’Hara) and Lany Bushman now Lany Burghduff fifty cents each, and if either of my daughters, above named, die leaving children, the property real and personal herein bequested to them and each of them, is to be paid in equal proportions to such of said children of my executor or executors hereinafter named being kept by him or them until the said Children shall severally have attained the age of twenty one years. And I do hereby appoint Andrew Bushman of the town of Henrietta, county and state afore said and Jacob Bushman of the town of Byron in the county of Genesee and State of New York, executors of this my last Will and Testament, with full power and authority to do and perform any and all acts and things connected therewith that may be necessary and lawful in the fulfillment of this my last Will and Testament. And if there shall arise any disagreement between any of my heirs herein before named touching or concerning the division of their or either of their shares of the property hereafter mentioned in my said will, I do hereby appoint Thomas Wright of the town of Brighton and Henry Bstart (?) of the town of Rush and both of the County of Monroe and State of New York enforce with full power to decide every such difference and them decide when and shall be conclusion between the parties and in witness of this my last Will and Testament, I have herein affixed my seal and subscribe my name this tenth day of June A. D. one thousand, eight hundred and fifty two at Henrietta and in the presence of David Ely and Roswell Wickwire and in the presence of the same witness, I do hereby revoke and declare null and void any and all former wills of mine and especially that will now in the possession of Judge Snyder of Wayne County and every clause contained in them and each of them is hereby declared to be void and of no effect, In testimony of all of which I have hereto subscribed my name and affixed my seal the tenth Day of June one thousand eight hundred and fifty two above named. Shuart Esqr Surrogate of the said County the last Will and Testament of John Bushman late of the town of Henrietta in the County of Monroe, aforesaid deceased of which the proceeding record of Will, is a true copy, was duly recorded and admitted to probate as a Will of real and personal estate, after citation for that purpose had been issued, served, returned and filed according to law, and the following depositions of the witnesses and thereupon taken and filled to establish the execution, genuiness and validity of the said Will~~ County of Monroe, Surrogate Court In the matter of approving the Will of John Bushman Deceased County of Monroe, SS: David Ely and Roswell Wickwire of the town of Henrietta in the county of Monroe aforesaid, being duly sworn do depose and say that they are the subscribing witness of the Last Will and Testament of John Bushman late of the town of Henrietta in the County of Monroe aforesaid deceased___ And these deponents further say, that the said John Bushman, the said testator did in the presence of these deponents subscribe his name at the end of this instrument which is now shown and exhibited to these deponents, which purport to be the last Will and Testament of the said John Bushman and which bears date on the 10th day of June, in the year of our Lord, one thousand, eight hundred and fifty two. And these deponents further say, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of these deponents subscribing then names as attesting witnesses thereto as aforesaid, the said testator was of sound mind and memory, of full age to execute a will and was not under any restraint. Shuart, Surrogate of Monroe County. *********************** Monroe County SS: A true record of the Will of John Bushman, late of the town of Henrietta, in the County of Monroe aforesaid deceased, and the proceedings, proofs and examinations had and taken are admitting said Will to probate and record as a Will of Real and Personal Estate. Recorded & Examined July 2, 1855. D. G. Shuart, Surrogate. Additional Comments: John Bushman was born in Mt. Pleasant Twp., Adams county, PA in 1768 and moved to New York about 1800 to the area of Scipio, Cayuga, New York. Wife Barbara died in Victory, NY about 1851 and it would appear that John then removed to Henrietta where his sons had located.
