All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm http://files.usgwarchives.org/ny/monroe/wills/v6/cushing-thomas.txt *********************************************************************** Source: Monroe co NY Will Book Vol. 6 page 523 Written: 25 Dec 1854 Probated: I Theodore Cushing of the town of Sweden in the county of Monroe and state of New York being of the age of fifty-five years and knowing the musability of all earthly things and being of a sound mind do make this my last will and testament. 1st I direct that all my lawful debts and funeral charges bepaid. 2. I give and bequeath to my beloved wife Irene Cushing all my personal estate that remains after the payment of the aforesaid debts and charges. 3. I give and bequeath to my beloved wife Irene Cushing the use of all my real estate until she shall deem it advisable to sell the same leaving it optional with her what time to make said sale. 4. I direct then that my real estate if sold that one half of the avails be paid to my wife Irene Cushing to have and dispose of as she pleases. 5. I give and bequeath to my adopted daughter Mary Roxanna Allen the sum of five hundred dollars to be paid out of the avails of real estate and in case said Mary Roxanna should not live to attain the age of twenty-one years I direct that the same shall be equally divided between her own brother and sisters to be paid to them when they respectively attain the age of twenty-one years, said sum to kept in the hands of my executors till said Mary Roxanna shall attain the age of twenty-one years. 6th I give and bequeath to my brother Roswell Cushing one thousand dollars to be paid out of the avails of my real estate as soon as may be after the sale of said estate. 7th I give and bequeath to my mother-in-law Sally Kimber the sum of five hundred dollars to be paid out of the avails of said real estate as soon as may be after the sale of said estate. 8th I give and bequeath to my brother Royal Cushing the sum of five hundred dollars to be paid as above. 9th I give to me executors in trust the sum of four hundred dollars said sum to be divied equally among and paid to the treasurers of the Society of the American Baptist Union, the American and foreign Bible Society of the American Baptist Home Missionary Society and the Baptist Publication Society. 10th I direct that what remains of my estate after paying the above bequests be equally divided between my three brother or their heirs, that is to say, one third to my brother Gilman Cushing, another third to my brother Warren Cushing and the remaining one third to be equally divided among the heirs of John Cushing, late of Le Roy deceased said sums to be paid as above. Sadly I nominate and appoint my beloved wife Irene Cushing executrix and my friend William executor of this my last will and testament authorizing and empowering them to seel and convey all real and personal estate and to perform all duties required by the law of executors. In witness thereof I have hereunto set my hand and seal this twenty-fifth day of December in the year of our Lord one thousand eight hundred and fifty-four.
