Second, I give and bequeath unto my executors hereinafter named Fifty Dollars in trust however, to be by them properly invested and the income or interest thereof annually applied toward the proper grading and maintaining of my burial lot. Third, I give and bequeath unto my wife, Anna Randolph, the use of the south part of the house on my farm in Webster, N.Y., being the portion now occupied by me together with the use of all my household furniture of and during her natural life time, provided however that she remains unmarried; also such fruits, vegetables, meats and other farm products as shall be necessary for her household use, during said time. Fourth, I give and bequeath unto my grandchildren Benjamin and James Newhall, of the town of Walworth, N.Y., the sum of Five Hundred Dollars each to be paid to them respectively in five annual payments commencing one year after my decease, without interest, and in the case of the death of either of them prior to my death without issue then the survivor to take the share of the deceased and in the case of the death of both of them without issue prior to my decease then to my son Jay W. Randolph or his heirs. Fifth- I give and bequeath unto my granddaughter Myra Wiser of the town of Webster, N.Y., the sum of Five Hundred Dollars to be paid to her in five equal annual payments commencing one year after my decease without interest and in case of her death prior to my decease and without issue then to her mother Margaret Wiser if living and, if not, to my son Jay W Randolph or his heirs. Sixth- I give and bequeath unto my daughter Margaret Wiser, of Webster, N.Y., the sum of Five Hundred Dollars, to be paid to her in five equal annual payments commencing one year after my decease without interest; and in case of her death prior to my decease, to her daughter Myra and in case of Myra's death without issue then to said Jay W. Randolph or his heirs. And I further direct that in case my personal estate shall not be sufficient to pay all of said legacies the same shall be a charge and lien upon my real estate, and that the bequest given to my wife in the third paragraph of this my will shall not affect her legal dower interest in my estate. Seventh, All the rest, residue and remainder of my estate other real and personal of every name nature and kind soever and wheresoever situated. I give devise and bequeath unto my said son Jay W. Randolph in fee simple absolute his heirs and assigns. Subject however to the right of dower of my said wife Anna Randolph therein and her use of the house, the farm products and household furniture hereinbefore bequeathed to her; also subject to the lien of the legacies hereinbefore mentioned and charged upon my real estate here by devised in case my personal estate shall not be sufficient to pay the same. Likewise, I make constitute and appoint my said son Jay W Randolph and my son-in-law George Wiser both of Webster, N.Y., to be the executors of this my last Will and Testament, and I hereby revoke all former wills by me made. In Witness Whereof I have hereunto subscribed my name and affixed my seal the twelfth day of May in the year of our Lord One thousand eight hundred and ninety-four. Joseph Randolph. The foregoing instrument was at the date thereof subscribed by Joseph Randolph the testator therein named in the presence of us, and each of us. He at the time of making such subscription acknowledged that he executed the same, and declared the said instrument to subscribed by him to be his last Will and Testament.
