Wills Vol. 7 Page 373 (transcribed From Sampubco photocopy) Written: January 11, 1859 Recorded: February 28, 1859 Record of Will The last will and Testament of Joseph Bowerman of the Town of Wheatland County of Monroe and State of New York I Joseph Bowerman considering the uncertainty of this life and being of sound mind and memory do make and publish this my last last will and testament in manner and form following. First I give and bequeath unto my beloved wife Alice Bowerman during her natural life all my real and personal property. And it is my wish that the part of said real estate lying on the south side of the road dividing said estate consisting of twenty five and sixty eight hundredths acres of land be reserved and occupied by said Alice Bowerman as a home for herself and two youngest children Adeline E. Bowerman and Elmer S. Bowerman. It is also my wish that should anything more than enough to sustain the family be produced on the farm the surplus be used towards the payment of my honest debts and that the Executors be empowered to dispose of that part of the land lying on the north side of the above mentioned road as in their judgement shall be deemed best and use the proceeds for the settlement of such just claims as may be presented. After the decease of my wife the said Alice Bowerman and the settlement of all just debts if any such debts shall remain unpaid after her decease the remainder of the proceeds of said property be divided among the heirs as following -viz- To each of my oldest sons Luther B. Bowerman and Daniel Bowerman I give and bequeath the sum of Four Hundred Dollars. To each of my oldest daughters Sarah E. Stokoe and Adeline E. Bowerman the sum of Three Hundred dollars And to my youngest son Elmer S. Bowerman I give and bequeath the sum of Five Hundred dollars One Hundred dollars of the last named sum may be used by my Executors towards defraying the expenses of education of said Elmer S. Bowerman. If anything remains after the payments of the above mentioned sums it is my wish that it be equally divided among said heirs. And I hereby appoint my said beloved wife Alice Bowerman Luther B. Bowerman and Robert Estes Executors to this my last will and testament. And I also hereby appoint the said Luther B. Bowerman as guardian for Elmer S. Bowerman. In witness whereof I have hereunto set my hand and seal the 11th day of 1st month in the year of our Lord one thousand eight hundred and fifty nine. Joseph Bowerman The above instrument of one sheet was now and here subscribed by Joseph Bowerman the testator in the presence of each of us and was at the same time declared by him to be his last will and testament and we at his request sign our names hereto as attesting witnesses William B. County of Monroe Surrogate Court In the matter of proving the will of Joseph Bowerman Deceased County of Monroe William B. Bowerman and Robert Estes of the Town of Caledonia in the County of Livingston being duly sworn do depose and say that they are the subscribing witnesses to the last will and Testament of Joseph Bowerman late of the Town of Wheatland in the County of Monroe aforesaid deceased. And these deponents further say that the said Joseph Bowerman the said testator did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents which purports to be the last will and testament of the said Joseph Bowerman and which bears date on the eleventh day of January in the year of our Lord one thousand eight hundred and fifty nine. And these deponents further say that the said testator did at the said time of subscribing his name as aforesaid at the end of said will declared the said instrument so subscribed and now exhibited to be his last will and testament and these deponents did thereupon subscribe their names at the end of the will as attesting witnesses thereto in the presence and at the request of the said testator. And these deponents further say that at the said time when the said testator subscribed his name to the said last will as aforesaid the said testator was of sound mind and memory of full age to execute a will and was not under any restraint. And that the said will now appears in all respects as when so executed without any alterations whatsoever. Robert Estes William B. Bowerman Subscribed and sworn this 28th day of February 1859 before me H.P. Norton Surrogate of Monroe County County of Monroe Be it remembered that at a Surrogate Court held at Rochester in and for the County of Monroe on the 28th day of February 1859 before Henry P. Norton Esq. Surrogate of said County - The last will and Testament of Joseph Bowerman late of the Town of Wheatland in said County of Monroe deceased of which the preceeding record of will is a true copy was duly proved and admitted to probate after citation for that purpose had been duly issued to all persons entitled to service and the said citations served returned and filed according to law and the foregoing depositions of the witnesses were thereupon taken and filed to establish the execution genuineness and validity of said will. Monroe County A true copy record of the will of Joseph Bowerman late of the Town of Wheatland in said County of Monroe deceased & of the proofs proceedings & examinations had and taken on admitting said will to be proved & recorded according to law as a will of real & personal estate. Recorded and Examined Febry 28th 1859 H.P. Norton Surrogate Monroe County Surrogate Court In the matter of the last will and Testament of Joseph Bowerman Deceased Renunciation I Robert Estes of the Town of Caledonia in the County of Livingston and state of New York one of the Executors named in and appointed in and by the last will and testament of Joseph Bowerman late of the Town of Wheatland in the County of Monroe and state aforesaid do hereby renounce the said appointment and all rights and claims to Letters Testamentary of the said last will and Testament or to act as an Executor thereof, and ask the Surrogate of Monroe County to accept and record this my renunciation.
