I Lonson Russell of the Town of Riga in the county of Monroe and state of New York of the age of seventy three years, and being of sound mind and memory do make, publish, and declare this my last will and testament in manner following that is to say: I give, devise, and bequeath all of my estate both real and personal wheresoever situate to my wife Lucy Russell to be used and enjoyed by her during the term of her natural life and from and immediately after her decease I give and devise the same to my son Levi Russell his heirs and assigns forever. Subject however to the following sepacies which I give to wit to my daughter Charity, wife of William Churchill three hundred dollars, to my daughter Mary Jane Russell four hundred dollars, to my daughter Laura, wife of Jason Spencer three hundred dollars, to my daughter Esther J. Russell three hundred dollars to be paid within five years after my decease with interest after one year from my decease and I do hereby charge and subject my said real estate with and to the payment of the said or foregoing humid segacies. It is also my wish and desire that my said daughters Mary Jane and Esther J. be kindly provided for and that they remain with my family on the homestead while they remain single. That Esther J. be brought up and educated the same as my other daughters have been. And also if they get married to have the same setting out for house keeping that my other daughters who are married had. It is also my wish and desire that my said son Levi Russell remain with the family work the farm and kindly assist his mother in all things pertaining to her happiness and their mutual benefit and also the benefit of all my family. And I do hereby appoint my said wife Lucy Russell executrix and my said son Levi Russell executor of this my last will and testament hereby revoking all former will by me made. In witness whereof I have hereunto set my hand and seal this 24 day of January in the year of our lord one thousand eight hundred and fifty three. Lonson Russell S.S. The above or foregoing instrument consisting of one sheet was at the date thereof signed sealed published and declared by the said Lonson Russell as and for his last will and testament in presence of us who at his reqsuest and in his presence and in the presence of each other have subscribed our names as witnesses thereto. Mrs. Moore residing at Churchville in the county of Monroe Franklin Cate residing at Chili in the county of Monroe County of Monroe Be it remembered that at a surrogate court held at Rochester in and for the county of Monroe on the first day of November 1858 before Henry P. Norton Surrogate of said county. The last will and testament of Lonson Russell late of the town of Riga in said county of Monroe deceased of which the precuding record of will is a true copy was duly proved and admitted to probate after citation for that purpose had been duly issued to all persons entitled to service and the said citation served returned and filed according to law and the following depositions of the witnesses were thereupon taken and filed, establish he execution genuineness and validity of said will. County of Monroe Surrogate Court In the matter of proving the Will of Lonson Russell dead County of Monroe Meritt Moore of the town of Riga and Franklin Cate of the town of Chile in the county of Monroe aforesaid being duly sworn do depose and say that they are the subscribing witnesses to the last will and testament of Lonson Russell late of the town of Riga in the county of Monroe aforesaid deceased. And these deponents further say that the said testator did at the said time of subscribing his name as aforesaid at the end of said will declare the said instrument as subscribed and now shown and exhibited to these deponents which purports to be the last will and testatment of the said Lonson Russell and which bears date on the 24 th day of January in the year of our lord one thousand eight hundred and fifty three. And these deponents further say that the said testator did at the said time of subscribing his name as aforesaid at the end of said will declare the said instrument as subscribed and now exhibited to be his last will and testament and these deponents did thereupon subscribe their names at the end of the said will as witnessing witnesses thereto in the presence and at the request of the said testator. And these deponents further say that at the said time when the said testator subscribed his name on the said last will as aforesaid and at the time of thse deponents subscribing their names as attesting winessess thereto as aforesaid the said testator was of sound mind and memory of full age to execute a will and was not under any restraint and that the said will now appears in all respect as when so executed without any alterations whatsoever.
