I give and bequeath to my daughter Lucy Jane Day all my personal property of every nature kind and description and where soever the same may be to have and to hold the same to her the said Lucy Jane her heirs and assigns forever. And I do further nominate and appoint my said daughter sole executrix of this my last will and testament. In witness where of I have hereunto se my hand and seal this ninth day of September A.D. 1853. Lucy Russell S.S. The above instrument is writing upon this sheet of paper written was at the date thereof and in our presence and in the presence of each of us signed sealed published and declared by the said Lucy Russell as for her last will and testament and we at her request and in her presence and in the presence of each other do thereunto subscribe and sign our names as attesting witnesses. Griffen of Rochester, Monroe County County of Monroe Be it remembered that at a surrogate court held at Rochester in and for the county of Monroe on the 3rd day of May 1858 before Henry P. Norton surrogate of said county, the last will and testament of Lucy Russell late of the city of Rochester in the county of Monroe aforesaid deceased of which the preceding rocord of will is a true copy was duly proven and admitted to probate as a will of personal estate after citation for that purpose had been duly issued to all persons entitled to service and the said citation served returned and filed according to law and the following depositions of the witnesses were thereupon taken and filed to establish the executrix gueniness and validity of said will County of Monroe Surrogate Court In the matter of Proving the will of Lucy Russell, Deceased County of Monroe Daniel S. Augle and William G. Griffen of the city of Rochester in the county of Monroe aforesaid being duly sworn do depose and say that they are the subscribing witnesses to the last will and testament of Lucy Russell late of the city of Rochester in the county of Monroe aforesaid deceased. And these deponents further say that the said Lucy Russell the said testatrix did in the presence of these deponents subscribe her name at the end of the instrument which is now shown and exhibited to these deponents which purports to be the last will and testament of the said Lucy Russell and which bears date on the ninth day of September in the year of our lord one thousand eight hundred and fifty three. And these deponents further say that the said testatrix did at the said time of subscribing her name as aforesaid at the end of said will declare the said instrument so subscribed and now exhibited to be her last will and testament and these deponents did thereupon subscribe their names at the end of the said will as attesting witnesses thereto in the presence and at the request of the said testatrix. And these deponents further say that at the said time when the said testatrix subscribed her name to the said last will as aforesaid and at the time of these deponents subscribing their names as attesting witnesses thereto as aforesaid the said testatrix was of sound mind and memory of full age to execute a will and was not under any restraint and that the said will now appears in all respects as when so executed without any alterations whatsoever.
