Second and Such I give and bequeath my soul to God and Body to the Mother Earth from where it came and I do hereby appoint my wife Margareth and my friend William Baumann Executors of this my last will and testament hereby revoking all former wills by me made. In testimony whereof I have hereunto set my hand and seal this 27th day of May, 1855. Sebastian Weiland |S.G. The above instrument consisting of one sheet of paper was at the date hereof signed sealed published and declared by the said Sebastian Weiland as & for his last will and testament in presence of us & in the presence of each other & in his presence we have subscribed our names thereto as witnesses B. Bardwell Residing in the City of Rochester, NY Roman Schlitzer “ County of Monroe Be it remembered that at a Surrogate Court held at Rochester in & for the County of Monroe on the 13 day of June 1859 before Henry P Norton Esqr. Surrogate of said County, the last will and testament of Sebastian Weiland late of the City of Rochester in said county of Monroe deceased of which the preceding Record of Will is a true copy, was duly signed & admitted to probate after citation for that purpose had been duly issued to all persons entitled to service & the said citation served returned & filed according to laws and the following depositions of the witnesses were thereupon taken & filed to establish the execution genuineness & validity of said will. County of Monroe Surrogate Court In the matter of hearing the will of Sebastian Weiland Deceased County of Monroe Butler Bardwell & Roman Schlitzer of the City of Rochester in the County of Monroe aforesaid being duly sworn to depose and say that they are the subscribing witnesses to the last will and testament of Sebastian Weiland late of the city of Rochester in the County of Monroe aforesaid deceased. And these deponents further say that the said Sebastian Weiland the said testator did in the presence of these deponents subscribed his name at the end of the instrument which is now here and exhibiting to these deponents which purports to be the last will and testament of the said Sebastian Weiland and which bears date on the 17 day May in the year of our Lord one thousand eight hundred and fifty five. And these deponents further say that the said testator did at the said time of subscribing his name as aforesaid at the end of said will declare the said instrument so subscribed and now exhibited to be his last will and testament and these deponents did thereupon subscribe their names at the end of the said will as attesting witnesses thereto in the presence and at the request of the said testator. And the deponents further say that at the said time when the said testator subscribed his name to the said last will as aforesaid and at the time of the deponents subscribing their names as attesting witnesses thereto as aforesaid the said testator was of sound mind and memory of full age to execute a will and wan not under any restraints. And that the said will now appeared in all respects as when so executed without any alterations whatsoever. B Bardwell Roman Schlitzer Subscribed and Sworn the 13th day of June 1859 before me H.P. Norton Surrogate of Monroe County. A true record of the will of Sebastian Weiland late of City of Rochester in said County of Monroe deceased & of the proofes, proceedings, & examinations had and taken on admitting said will to be proved & recorded according to law as a will of real & personal estate.
