The people of the state of New York by the grace of God free and independent. To all to whom these presents shall come or may concern send greeting. Know ye that at Johnstown in the county of Montgomery before James Lansing, Esq., surrogate of your said county the last will and testament of John Anderson, Senior., deceased ( a copy whereof is hereto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death goods chattels or credits within this state by means whereof thus proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing and final discharging the account thereof doth belong unto us the administration of all and singular the goods chattels and credits of the said deceased and any say concerning his will is granted unto Robert Robertson and John Mac Martin executors in the said will named they being (?) duly sworn well and faithfully to administer the same and to make and exhibit a time and perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof where thereunto required. On testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed. Witness James Lansing Esquire Surrogate of the said county of Johnstown the eighth day of February in the year of our Lord one thousand eight hundred and six and of our Independence the thirtieth. I , John Anderson, Senior of the town of Johnstown in the county of Montgomery and State of New York being weak and frail in Body but of sound Mind and Memory (blessed be God) do this twentieth day of January in the year of our Lord one thousand Eight hundred and six make and (?)ellish this my last will and testament in manner and form as follows to wit. I give and bequeath to Jane Anderson my beloved wife one equal third part of the equal half of Lot Number Forty and in like manner one third part of the equal half of fifty acres of land of Number Fourty and a half of lot number two hundred and thirty four in the Eastern Allotment of Kingsborough or the one third part of the equal half of the profits wrising during her natural life produced from the above specified lands during her natural life. As also I give to Jane , my said beloved wife, the whole of my household furniture, beds and bedding, clothes (except my books) as also two cows of her own choosing of my said cows with six sheep from my flock of sheep. Also I give and bequeath to my beloved wife the use of the East end of the house in which now I live both below and above that is East of the Hall of said house as also the use of the said Hall to pass and repass during her natural life (with this exception) that I recommend as it is my will that the said Jane Anderson shall at her decease leave and bequeath to Daniel Anderson, my eldest lawful son the one half of the subject or effects bequeathed to her that is to say the one equal half of the then remaining subject at her decease. Secondly I give and bequeath to Mary Anderson, my grandchild, Daughter of John Anderson my son, forty pounds of lawful money of the State of New York a yoke of oxen of my property to go or be sold in first part of the payment of said forty pounds and the first and reediest of my moveables not otherwise conveyed shall make up the remainder of said fourty pounds. Thirdly, I give and bequeath to Daniel Anderson my eldest son, twelve hundred and fifty dollars out of my real and personal property to wit. Two hundred and fifty dollars annually during the space of five years and whatever remains unpaid of said twelve hundred and fifty dollars at the expiration of five years after my decease shall bear lawful interest observing the first (?)hriety to become due at a (?) after deceasing (I mean my own decease) as also my wagon and black horse. Fourthly I give and bequeath to John Anderson ,my son, the whole of the above specified lands and the whole of the other (?) not otherwise conveyed witht his provision that he is to satisfy and pay my last and lawful debts with funeral charges, etc. but incase said Junior John Anderson my lawful son thinks the above specified conditions too grievous the whole specified real property are to revert to Daniel Anderson my lawful son without divisions to any other excepting what is allotted to Jane Anderson my beloved wife during her lifetime. It is to be observed that I mean my real property my lands above mentioned. Furthermore if my said son John Anderson Junior approves and is satisfied with the portion and gifts allotted him he may at the opening of this my last will and testament (which I order to be at eight days after my decease) enter to the above real and personal property convey and bequeath to him providing he gives sufficient security in what is otherwise bequeathed or conveyed. Lastly I appoint and constitute to Robert Robertson and John MacMartin both in the town of Johnstown executors t othis my last will and testament revoking all other Testaments and wills heretofore made done this twentieth day of January eighteen hundred and six express at Johnstown. John Anderson (Signature) We the witnesses to this last will and testament saw the testator signed and sealed and deliver this as his last will and testament and that he was sound in memory and reason. Be it remembered that on the sixth day of February in the year of our Lord one thousand eight hundred and six personally appeared before me James Lansing surrogate of the county of Montgomery, Archibald McLaren, Alexander Cameron and Peter MacPherson who being duly sworn separately depose and say that they say John Anderson Senior sign seal publish and declare the within instrument as and for his last will and testament. That the said John Anderson Senior was at the time thereof according to the best of the knowledge and belief of these deponents of sound and disposing mind, memory and understanding that the names of these deponents subscribed thereto as witnesses is respecting their own writing and that they separately subscribed their names as witnesses to the execution thereof in the presence of the testator and in the presence of each other.
