Feb 25, 1810) Probate of the Will of Hendrick Hess. The people of the State of New York, by the Grace of God free and independent. To all to whom these presents shall come or may concern send Greeting. Know ye that at Johnstown in the County of Montgomery before James Lansing Esq. Surrogate of our said County, the last Will and Testament of Hendrick Hess deceased, (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death goods, chattels or credits within this State by means whereof the proving and registering the said Will and the granting Administration of all and singular the said Goods Chattels and Credits, and also the auditing, allowing and final discharging the Account thereof, doth belong unto us; the Administration of all and singular the Goods, Chattels, and Credits of the said deceased, and any way concerning his Will is granted unto George W. Gerlach and Henry I. Felling Executors in the said Will named, they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect Inventory of all and singular the said Goods Chattels and Credits, and also to render a just and true Account thereof when thereunto required. - In testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed. Witnesses James Lansing Esquire Surrogate of the said County at Johnstown the thirteenth Day of June in the year of our Lord One thousand eight hundred and ten, and of our Independence the thirty fourth. - James Lansing In the name of God amen. I Hendrick Hess of the Town of Canajohary (sic) in the County of Montgomery and State of New York, considering the uncertainty of this mortal life and being of sound and perfect mind and memory, blessed be God therefore, do make and publish this my last Will and Testament in manner and form following, that is to say, First, I will and order that all my just Debts and funeral Expenses be paid. - Also, I give devise and bequeath unto my Son Henry Hess Junior his Heirs and Assigns for ever, the Farm I now live on with all my lands in Freys Bush, with all the farming Utensils thereunto belonging; subject nevertheless to the Bequest next herein following, and to the payment of the money herein after ordered to be paid by him. - Also, I give and bequeath unto my Wife Mary Elizabeth during her life, all my moveable Estate and farming Utensils, my House and Barn, and one third part of the produce of my Farm, which shall be delivered to her fit to be taken to Market - Always understanding that the farming utensils are to be made use of in the cultivation of the Farm, and the Horses in working the same if Henry desires it. - Also, after my Wifes (sic)decease I give and bequeath unto my Sons George and Henry, all the Horses then remaining on my Farm. - Also, I give and bequeath unto my Daughters Susanna, Magdalen, Elizabeth, Catharine and Margaret, and to Anna, Maria Elizabeth and Susanna, children of my deceased Daughter Maria, the Sum of three hundred and Seventy & five Dollars, to wit, sixty two Dollars and fifty Cents to each of my said Daughters, and sixty two Dollars and fifty Cents to the four Children above named of my Daughter Maria deceased, two hundred and fifty Dollars of the said Sum I will and order to be paid by my son Henry, - and one hundred and twenty five Dollars of the said Sum I will and order to be paid by my Son George, who has been advanced and provided for by me in my life time. - Also, I give and bequeath unto my said five Daughters, and to my said four Grand Daughters, all my household Furniture, the horned Cattle, Sheep and Hogs remaining at my Wifes (sic) decease, to wit, one sixth part to each of my said Daughters and one sixth part to my said Grand Daughters. - Also, I will and order that if my said Grand Children Anna, Maria, Elizabeth and Susanna, continue in my Family until they marry they and each of them shall have one Cow, one Calf and one chintz Gown. - Also, the rest and residue of my personal Estate, at my Wifes (sic) decease, I given and bequeath unto my said Sons, Daughters and Grand Daughters, to be divided so that my said Grand Children have an eighth and my Sons and Daughters each one eighth. - Also, I nominate, constitute and appoint my Wife Mary Elizabeth to be Executrix and my Friends and Neighbours (sic) George W. Gerlach and Henry I. Felling to be Executors of this my last Will and Testament: Hereby revoking all former Wills, Testaments or Codicils by me made. In witness whereof I have hereunto set my Hand and Seal the twenty sixth Day of August in the Year of our Lord one thousand eight hundred and one. Hendrick X Hess L.S. his mark Signed sealed published and declared by the said Hendrick Hess to be his last Will and Testament in the presence of us who have hereunto subscribed our Names as witnesses in the Testators presence. Be it remembered that on the thirteenth Day of June in the Year of our Lord one thousand eight hundred and ten, personally appeared before me James Lansing Surrogate of the County of Montgomery, Roger Dougherty who being duly sworn deposeth and saith that he saw Hendrick Hess sign and seal, and heard him publish and declare the within Instrument as and for his last Will and Testament: That the said Hendrick Hess was at the time thereof (according to the best of the Deponent's knowledge and belief) of sound and disposing mind memory and understanding: That the name of this Deponent subscribed thereto as a Witness is his own proper writing: That he saw Hendrick Deill and Christopher P. Yates subscribe their names thereto; and that this Deponent and the said Hendrick Deill and Christopher P. Yates subscribed their names thereto as Witnesses to the execution thereof, in the presence of the Testator. James Lansing The preceding are true copies of the last Will and Testament of Hendrick Hess deceased, of the Certificate of the proof thereof and of the Letters testamintary (sic) thereon. - Registered the 13th Day of June 1810. - James Lansing Surrogate Be it also remembered that on the said thirteenth Day of June last mentioned personally appeared before me the said Surrogate, George W. Gerlach and Henry I. Felling Executors in the last Will and Testament of the said Hendrick Hess deceased named, and were duly sworn as Executors.
