In the name of God Amen I Frederick Smith of Kingsborough Township of Johnston County of Montgomery and State of New York (tayborh) ?? being under infirmities and weak of body but of perfect mind and memory thanks be given to God calling unto mind the uncertainty of life I do make and ordain this my last will and testament in manner and the following (to wit) First of all my funeral expenses and just debts are to be paid by my executor or executors hereinafter named. I give and bequeath unto my oldest son Elias Smith (cooper) 1 mare distinguished by the name of the Jewel mare & three sheep but in case if I should sell the said mare or sheep before my death or they should happen to die before or after my death before delivery then the said Elias Smith must sustain the loss of them. I give and bequeath unto my son Gerrard Smith (farmer) one team of horses which works together also I give my cow hogs and the remainder of my sheep with all of my farming utensils of what kind soever unto my youngest son with all my household goods my chest and books also I will and bequeath unto my eldest son Elias one hundred and forty acres of land on the east side of my farm containing in front of the south side twenty two chains thence to run back the whole length of the said farm along by Lot no. seventy one but in case the front of said farm should not hold out and keep its length then in such case each one of my sons to loose his proportionable part of the said front. I will and bequeath unto my younger son Gerrard the remainder of my farm estimated two hundred acres if in case there should be in turning out any overplus to belong then my youngest son & in case it should fall short it must come out of my youngest son's part his part in front thirty two chains in front but in case the front should fall short of measurement then each to be his proportionable part in loss, The said two hundred acres more or less joining and bounding the farm of Jonathan Carpenter Lot No. seventy seven to hold the said part whereon I now live with all this betterments I will and bequeath unto my two sons (if in case there is any property coming to me of my father Gerrard Smith by will) to be divided equally also. My will is that if there's any crops in the ground or gathered to by my youngest sons. Lastly I nominate and appoint my two sons Elias Smith and Gerrard Smith my true and lawful executors of this my last will and testament and I do hereby utterly disallow revoke and disannull all and every other former testament and I by these presents do ratify and confirm this and no other to be my last will and testament. In witness whereof I have hereunto set my hand & seal this sixth day of May in the year of our Lord one thousand eight hundred and six.
