Borst, Surrogate of said county, and made application to have the said Last Will and Testament, which relates to personal property, proved; and on such application the said Surrogate did ascertain by satisfactory evidence who were the husband, heirs at law and next of kin of said testatrix and their respective residences: an the said Surrogate did thereupon issue a citation, in due form of law, directed to the said husband, heirs at law and next of kin by their respective names, stating their respective residences, requiring them to appear before said Surrogate at his office in the City of Amsterdam, on the 8th day of December, 1888, to attend the probate of said will. And afterwards, to wit, on the said 8th day of December, 1888, satisfactory evidence by affidavit was produced and presented to the said Surrogate of the due service of said citation in the mode prescribed by law, and on that day no one appearing to oppose the probate of said will, such proceedings were thereupon had afterwards that the said Surrogate took the proof of said will hereinafter set forth upon this 8th day of December in the year one thousand eight hundred and eighty eight and he adjudged the said will to be a will valid to pass personal property, and the proofs thereof to be sufficient , which said last will and testament and the proofs thereof are as follows, that is to say: I, Catharine Germond, do hereby make this my Last Will and Testament. First: I give and bequeath to my brother, Peter Putman, five hundred and fifty dollars and I release all claims against him for services rendered him, in consideration therefore, my said brother shall pay any doctors bills, my funeral expenses and cause to be erected, a suitable tombstone to mark the place of my burial. Second: I give and bequeath as follows to Martha Vedder, two hundred dollars. To Maggie James, $200.00 and my gold bracelets. To Abram Putman, two hundred dollars. To Eliza Orr, two hundred dollars and my plush sacque. To Brower Putman, one hundred dollars. To Mary Putman, his wife, one hundred dollars ($100.00). To my niece Katy Vedder, my gold watch and chain and one feather bed and two pillows. To my niece, Katy James, fifty dollars and one feather bed and two pillows. The feather bed and two pillows to be selected by my executor. To my mother, Magdalena Putman, my fur lined cloak. Third: All my wearing apparel and household furniture and goods, I give and bequeath to my sisters, Martha Vedder, Maggie James and Eliza Orr in equal shares. In the event that there shall not be sufficient of my estate to pay the money legacies herein before mentioned, than such deficiency shall be deducted from the same proportionately to the extent of the entire extinguishment of the same if inevitable. I hereby appoint my brother, Peter Putman, executor of this, my Last Will and Testament and I hereby revoke all former wills by me made. In witness whereof I have hereunto set my hand, this first day of September 1888. Catharine Germond The foregoing instrument was at the date thereof subscribed by the above named, Catharine Germond in our presence and she then declared the same to be her Last Will and Testament and requested us to sign the same as witness, which we do in her presence. IN THE MATTER OF PROVING THE WILL OF Catharine Germond Deceased. Walter L. VanDeubergh of the City of Amsterdam in the county of Montgomery, and James B. Bailey of the town of Amsterdam in the county of Montgomery being duly sworn and examined in open court before Henry V. Borst, Surrogate of said county, do depose and say, and each for himself deposeth and saith that he was acquainted with Catharine Germond in her life time and was present and saw the said Catharine Germond subscribe her name at the end of the instrument in writing now and saw the said Catharine Germond subscribe her name at the end of the instrument in writing now produced and shown, bearing date the 1st day of September, 1888; that the said Catharine Germond at the time she so subscribed it, declared the said instrument to be her last will and testament, and requested these deponents to subscribe their names as witnesses to the execution thereof. Thereupon these deponents subscribed their names as witnesses in the presence of the said Catharine Germond and of each other. That the said Catharine Germond at the time she so executed the said instrument was a citizen of the United States, an inhabitant of the county of Montgomery, of full age, of sound and disposing mind and memory, and in all respects competent to make a valid will And the said W. L. Van Deubergh for himself further separately says that he drew said will for the testatrix at her request according to her directions and just as she desired it. And the same has been in deponent's custody ever since the execution thereof and the same has not in any respect been altered or changed. W.L. VanDeubergh Taken, Subscribed and sworn this James B.
