Will of Michael LINGENFELTER This is a will made by a Michael Lingenfelter of Johnstown, Montgomery County, State of New York. Mr. Lingenfelter died in March of 1818. It was found on p. 104-106 of the Book of Wills at the Surrogate's Office (new building) in Fonda, New York. It had been copied by hand in the usual manner done in those days. The will was dated 2 August 1817 and probated 18 March 1818. Know ye that at Johnstown in the County of Montgomery before James Lansing Esquire Surrogate of our said County the last Will and testament of Michael Lingenfelter deceased (a Copy whereof is hereunto annexed) was proved and is now approved -- and allowed of by us and the said deceased having whilst he lived and at the time of his death Goods, Chattels or Credits within this State by means whereof the proving and registering the said Will and the granting administration of all and singular the said Goods, Chattels and Credits and also the auditing, allowing and final discharging the account thereof doth belong unto us; the administration of all and singular the Goods, Chattels and Credits of the said deceased and any way concerning his Will is granted unto James Cushney and Gerrit Ten Broeck Executors in the said Will named they bring first duly sworn will and faithfully to administer the same and to make and exhibit a true and perfect Inventory of all and singular the said Goods, Chattels and Credits and also to render a just and true account thereof when thereunto required. -- In testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed. Witness James Lansing Esquire Surrogate of (of) the said County at Johnstown the eighteenth Day of March in the year of our lord one thousand eight hundred and eighteen and of our independence the forty second. -- James Lansing In the name of God amen, I, Michael Lingenfelter of the town of Johnstown County of Montgomery and State of New York being of sound mind and memory do make publish and ordain this my last Will and testament, that is to say first and principally of all I give and recommend my Soul into the hands of almighty God who gave it nothing doubting but what I shall receive the same again by the mighty power of God at the general resurrection day and my body I commend to the Earth to be buried in a decent manner at the discretion of my Executors. And as to the worldly estate wherewith it hath pleased God to bless me in this life I give and dispose of in the following manner and form that is to say, First I give and devise unto my Son Baltus Lingenfelter all my real estate that I may divsized (?) of subject to the amount of Legacies herein after mentioned to him his Heirs and Assigns. I give and bequeath unto my six Daughters Lana, Margaret, Elizabeth, Catharine, Anatie & polly the Sum of two hundred Dollars each in three years after my death which said Legacies I make binding on the real estate divised to my Son Baltus until paid by my Son Baltus. --I give and bequeath unto my Daughter Polly all my cows sheep & Hoggs & all young horned Cattle that I may die in possession of -- also one feather bed & bedding and all my best household furniture & the remainder of my household furniture I give unto my six Daughters above named share & share alike -- and the negro Girl named Jin I give to my Daughter polly. All the rest of my personal property I give to my Sons Baltus Graudus and Michael Lingenfelter share & Share alike and all the Debts that I may owe at the time of my death & my funeral Charges I bind my three Sons aforenamed to pay and discharge. My Clock and my Case I give to my Daughter polly and one half of my dwelling House if she does not marry. I give to my Grandson Michael Son of my Son Michael his choice out of my Horses. I do hereby appoint James Cushney and Garet Ten Brook Executors of this my last Will and testament hereby revoking all former Wills by me made. Be it remembered that on the eighteenth Day of March in the year of our lord one thousand eight hundred and eighteen personally appeared before me James Lansing Surrogate of the County of Montgomery, James Cushney who being duly sworn deposeth and saith that he saw Michael Lingenfelter sign and seal and heard him publish and declare the foregoing instrument as and for his last Will and testament. That the said Michael Lingenfelter was at the time thereof (according to the best of the Judgment and belief of this Deponent) of sound and disposing mind memory and understanding. That this Deponent subscribed his name thereto as a witness to the execution thereof in the presence of the said Michael Lingenfelter the testator; and that he at the same time saw Jacob Graff and Samuel Leonard respectivily subscribe their Names thereto as Witness to the execution thereof, also in the said testators presence.
