The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.org *********************************************************************** Montgomery County, NY MOSHER, Peter Oppemheim Vol. 1 page 322 Transcribed from SAMPUBCO copy In the name of God amen I Peter Mosher of Oppenheim in the County of Montgomery + State of New York being weak in body but of a sound and perfect memory + blessed be the Almighty God for the same do make and publish this my last will and testament in manner and form following that is to say first it is my will that my beloved wife Mary shall have the full occupation of the farm on which I now live being part of Lot No. thirty seven in Maguire patent in the Town of Oppenheim aforesaid as long as she continues to be my widow together with all my household furniture and farming utensils and a team of three horses to wit, two large mares and a four year old horse, and that she shall take the charge of my children under age to wit, John P Mosher, Ephraim, Abraham, Jeremiah and Leonard + that they shall be sent to school and supported in such a manner as to give them a good decent common education + that they should live + work together on said farm until they respectively come of lawful age and that all the property they may gain more than to support the family shall be equally divided among them when the youngest is of age. Secondly that after paying my funeral charges that all my debts now due shall be collected and all the debts I owe shall be paid especially a Mortgage given to the State of New York in the first place and the remainder shall be applied to the support of the younger children + for their education that all the money on hand and debts that may become due after paying my debts together with five cows fifteen sheep five heifers a yoke of yearling steers one bull and a heifer calf shall be left on the farm for the use of my wife and younger children. I give and bequeath to my son John P Mosher a certain mare commonly called the Gin mare also five ewe sheep let out to Christian Sheppersman. I give and bequeath to my son Ephraim Mosher a certain yearling horse colt and also five sheep to be taken from my flock of an average quality. I give and bequeath to my son Abraham Mosher a sucking colt that now sucks the Gin mare. I give and bequeath to my eldest daughter Elizabeth four sheep from my flock of an average quality. I give and bequeath to my daughter Cornelia next eldest also four sheep from my flock of a like quality. I also give and bequeath to my daughter Polly the remaining six sheep of my flock and also two beds and bedding one chest and all wearing apparel and fowls that have usually been called hens. I also will and order that my two youngest sons Jeremiah + Leonard shall each have the priviledge (sic) of raising on the farm and be furnished when they are respectively twenty one years of age with a young horse to be about three years old. I also give and bequeath to my eldest son Peter Mosher Jr a certain fifteen dollar note to be given up to him and also upon condition that he pays and takes up a certain note given to the Executors of William Attenburgh deceased of twelve dollars and twelve + a half cents. It is my will that he should keep a certain cow now in his possession for which said note was given. All of which property before bequeathed I order to be delivered to the respective Legaties (sic) upon death and as soon as they respectively come of lawful age to receive it after my decease. I further give and devise to pay eldest son Peter Mosher Jr + my second son John P Mosher + their heirs and assignees all that certain piece or parcel of land containing twenty five acres being part of lot number one hundred and forty four in a patent Granted to George Klock and others situate in Oppenheim aforesaid to be divided between them equally by a line running northerly and southerly parallel to the boundaries of said land. And I hereby give and bequeath to my four younger sons Ephraim Abraham Jeremiah Leonard all my other freehold estates being about seventy two acres of land known as part of lot number thirty seven in Meagers patent situate in Oppenheim aforesaid and to their heirs and assignees forever to be divided equally between them according to the value of the freehold property by lines running easterly and westerly and I further order that they have possession of the premises as soon as my present wife ceases to be my widow. And lastly I appoint Ezekiel Belding Peter Clause + my son Peter Mosher Junior sole executors of this my last will and testament hereby revoking all former wills made by me. In witness whereof I have hereunto set my hand and seal at Oppenheim this seventh day of July in the year of our Lord one thousand Eight hundred and twenty one. Be it remembered that on the twenty seventh day of August in the year of our Lord one thousand Eight hundred and twenty one personally appeared before me Tobias A Stoutenburgh Surrogate of the County of Montgomery William VanBuren and on the next day Elias Lawton also personally appeared who being both duly sworn depose and say that they saw Peter Mosher sign and seal and heard him publish and declare the within Instrument as and for his last will and testament. That the said Peter Mosher was at the time thereof of sound and disposing mind memory and understanding. That these deponents subscribed their names thereto as Witnesses to the execution thereof in the presence of the said Peter Mosher the testator and that they at the same time saw Joseph Yoran subscribe his name thereto as a Witness to the execution thereof also in the said testators presence.
