NY Will Book Vol. 4 page 87 The people of the State of New York by the grace of God free and independent To all to whom these presents shall come or may concern send greeting know Ye that at the Village of Johnstown, the County of Montgomery on the fourteenth day of April in the year of our Lord on thousand eight hundred and twenty seven before Tobias A Stoutenburgh Esquire Surrogate of our said County, the last Will and testament of William Caldwell deceased,[a copy where of is here unto annexed] was proved and is now approved and allowed of by us and the said deceased having whilst he lived, and at the time of his death goods, chattels or credits within this State by means where of the proving and registering the said Will and the granting administration of all and singular the said Goods, Chattels and Credits and also the auditing, allowing and final discharging the account thereof doth belong unto us; The administration of all and singular the Goods, Chattels and Credits of the said deceased and any way concerning his Will is granted unto James Caldwell Executors in the said Will named they bring first duly sworn will and faithfully to administer the same and to make and exhibit a true and perfect Inventory of all and singular the said Goods, Chattels and Credits and also to render a just and true account thereof when thereunto required. -- In testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed. Witness Tobias A Stoutenburgh Esquire Surrogate of our County of Montgomery at the Villiage of Johnstown the fourteenth Day of April in the year of our Lord one thousand eight hundred and twenty seven and of our independence the fifty frist. -- Tobias A Stoutenburgh In the name of the God I William Caldwell of the town of Palatine in the County of Montgomery the State of New York being of sound memory that considering the mortality of the body and the uncertainty of the hour of death do this twenty sixth day of Feburary in the year of our Lord one thousand eight hundred and twenty three make and publish this my last will and testament in manner following.[to wit] Frist I give and bequeath unto my wife Rebecca the use privilege bought Profit and management of a certain Lot of land on which I formly resided containing thirty acres of land, more or less, together with all the improvements and buildings there on as like wise all the personal property of whatsoever [?] that I shall die lawful of, to make us of and to hold the same during her life time. Secondly I give and bequeath unto my son Joseph, after the decease of my said wife Rebecca, his heirs and assigns forever all the above mentioned property, personal and real together will all the privilege, profits use and behold as above bequeathed unto my said wife during her life time, thus of his heirs executor,and adminstrators forever, excepting all the house hold furniture which shall or may remain after the death of my said wife, which said furniture shall be equally divided between my daughters Elisa and Sally or their heirs and assigns. Further I will and devise that my said son Joseph his heirs and assigns pay unto my son Paul his heirs and assigns the just and full sum of fifty dollars, in two equal payments, that is the one half of said sum to be paid at the out of the first year after the date of my decease and the remaining half at the end of the second year. Further I order that all my just debts and all expences which may a course during my illness and likewise all furneral charges and other demaned shall be paid [out of the estate freely bequeath]by my said wife Rebecca and my said son Joseph. And I do hereby revoking and dismissal all former wills and bequeaths by me made and declare this to be my last will and testament. Sadly to make oder and appoint my son James Caldwell and Stephen Cogswell executor of this my last will and testament. State of New York Montgomery County, Be it remembered,that on the fourteenth day of April in the year of our Lord one thousand eight hundred and twenty seven, personally appeared before me Tobias A. Stoutenburgh, Surrogate of the so County of Montgomery Joseph Quilhat,one of the Subsenting witness to th last Will and testament of William Caldwell late of the town of Palentine in the said County of Montgomery, deceased, who being duly swon declare that he saw the said William Caldwell deceased,seal and excute the instrument [?]annexed, and [?] with the seal of office of the said Surrogate, which said instrument purpose to be the last will and testament of the said William Caldwell deceased, being date the twenty sixth day of Feburary in the year of our Lord one thousand eight hundred and twenty three, That he heard [?] the said William Caldwell puglish and dealar the same as and for his last Will and testament, that at the time thereof he the said William Caldwell was of sound and disposing mind memory and understanding, to the but knowledge and belief of his the said Joseph Quilhat, and that he together with Christopher Getman and David Getman thee other witnesses to the said Will did severally subcribe their names thee to , as witnesses to the executors thereof, in the presence of the said William Caldwell the testator. In testimony whereof the said Surrogate hath executor set his hand and affixed his seal of office. Done at the Village of Johnstown this fourteenth day of April in the year of our Lord one thousand eight hundred and twenty seven.--Tobias A Stoutenburgh Montgomery County, Be it also remembered that on the said fourteenth day of April in the year of our Lord One thousand eight hundred and twenty seven personally appeared before me the said Surrogate James Caldwell as Executors in the afore said Will named, and was duly swone to the faithful [?] and execution theeof by taking the usuel oath in that case forward.
