Be it remembered that heretofore to wit, on this 20th day of October 1854, Henry V. Voorhees & Horatio Voorhees, the only next of kin of Mary Voorhees, late of the town of Glen in the County of Montgomery, deceased, appeared in open Court before the County Judge of Montgomery County as surrogate and made application to have the last will & testament of the said Mary Voorhees deceased, which relates exclusively to personal estate, proved; and on such application the said County Judge did ascertain that the said applicants were the only next of kin of said deceased & afterwards to wit, on said 20th day of October 1854, no one appearing to oppose the probate of such will, such proceedings were thereupon had that the said County Judge took the proofs of said will hereinafter set forth & he adjudged the said will to be a valid will of personal estate, the proof thereof to be sufficient, which said last will & testament & proof are as follows, that is to say. I Mary Voorhees, widow of the late James Voorhees deceased, of the town of Glen in the County of Montgomery, N.Y. do hereby make & declare this to be my last Will & Testament as follows; First I give & bequeath to my son, Henry V. Voorhees, one small Silver tea fork, eighteen silver tea spoons & two sets brown bed curtains. Second I give & bequeath to Peter, son of my said son Henry, one feather bed, marked (P.V), and to John Henry, son of my said son Henry V. Voorhees, I give & bequeath on clock, all my maps and one half of my books in the bookcase. Third I give & bequeath to Sarah Baird, daughter of the late Henry V. Wyckoff, on tall cherry cupboard. Fourth I give & bequeath to Mary Helen Voorhees, daughter of my son Horatio N. Voorhees, my gold neck chain, and to Anna Mariah, daughter of my said son Henry V. Voorhees, one feather bed, marked (A.V). Fifth I give & bequeath to Sarah Titus, a colored woman, on feather bed marked (S.T.) Sixth I give & bequeath to my son Horatio N. Voorhees, my secretary & book case, one half of my books, one large silver tea pot, 1 silver soup ladle & all the rest & remainder of my personal property, of every kind, other than that which is here in before otherwise bequeathed, except all my wearing apparel which I give & bequeath equally to the said Anna Mariah, said Mary Helen & to Mary Ellen, daughter of John L. Wyckoff. Lastly I hereby constitute and appoint Henry V. Voorhees & my said son Horatio, to be the executors of this, my last will and testament. County of Montgomery. Mathew Putman of the town of Glen, in the county of Montgomery, being first duly sworn before S. Belding Jr., County Judge of the county of Montgomery, as Surrogate, doth depose and say that he was well acquainted with the above named Mary Voorhees, that he was present as a witness and did see her subscribe her name at the end of the instrument now produced and shown to this deponent, bearing date, the 12th day of July, A.D. eighteen hundred and fifty one, purporting to be the last will and testament of said Mary Voorhees. That the said deceased, at the time of making said subscription, declared the said instrument to be her last will and testament and requested this deponent to sign his name as a witness thereto: Thereupon this deponent his name as a witness at the end of the said instrument: This deponent further says that said Mary Voorhees, at the time she executed said instrument was a citizen of the United States, of full age, of sound mind and memory and not under restraint, and that this deponent saw Giles F. VanVeckten, the other witness to said will, subscribe his name there to as witness to the execution thereof in the presence of and at the request of said testatrix. M.
