Rollins, surrogate of the County of New York and made application to have the said last will and testament which relates to both real and personal property proved. And on such application the Surrogate did ascertain by satisfactory evidence that said deceased died on the tenth day of July in the year one thousand eight hunred and eighty five leaving her surviving, Augustus Bassett a half brother residing at Killingly, Conn, Betsy Williams the petitioner, a half sister, residing in the city of New York, Henry D. Bassett, a nephew residing at Brooklyn, Conn. William E. Bassett, a nephew residing at Norwich, Conn. Harriet L. Bassett a grand niece residing at Rye, West Chester Co. Ny. Walter T/L? Hutchins a grand nephew residing at Paris, France, Florence M. Hutchins, a grand niece residing at Paris France and Almira H. Judson a grand niece residing at Brooklyn, N. Y., her only heirs and next of kin. And said Surrogate did thereupon issue a citation duly directed to said only heirs and next of kin, requiring them to appear before said Surrogate at his office in the City of New York on the thirtieth day of September then next to attend the probate of said will, and afterward to wit. On the said thirtieth day of Page 237 September in the year one thousand eight hundred and eighty five satisfactory proof by affidavit was adduced and presented to said Surrogate of the service of said citation in the mode prescribed by law. It being ascertained on the said day or before any proceedings were taken upon the probate of said will, that two of the parties cited were minors one having a general guardian the other no general guardian residing in the State of New York. Thomas E. Marsac was appointed a special Guardian in due form of law, to take care of her interests in the matter of proving said will by an order duly entered for that purpose by said Surrogate, and said guardians having duly appeared. Whereupon no opposition having been made to the probate of said will such proceedings were thereupon had afterwards that said Surrogate took the proofs of said will as here- inafter set forth. And upon this fifth day of October in the year one thous- and eight hundred and eighty five, he adjudged said will to be a valid will of Real and personal property and the proofs there of to be sufficient Which said last Will and Testament and proofs are as follows that is to say -- In the name of God Amen, I Almera Hutchins wildow of Samuel Hutchins late of the city of New York deceased, being of sound and disposing mine, and duly mindful of the great uncertainty which accompanies the continuance of my mortal life and being desirous of bequeathing and devising al my real personal and mixed property as well that of which I now seized and possessed or to which I am entitled Page 238 as also that of which I may hereafter become seized or possessed or entitled unto do for the accomplishment of that purpose and intent subscribe, seal and publish and declare this instrument as and for my last Will and Testament as follows: that is to say-- First -- I direct my executors hereinafter named to pay out of my personal estate my just debts and my funeral and testamenitary expenses as soon after my decease as the same can be done safely and properly----- Second -- I give and bequeath unto my brother Augustus Bassett one thousand dollars. Third -- I give and bequeath unto my grand niece Harriet L. Williams daughter of my niece Emily L Williams deceased, one thousand dollars --- Fourth -- I give and bequeath to my nephew William E. Bassett son of my brother Joseph Bassett, deceased the sum of Five hundred dollars ----- Fifth -- I give and bequeath unto my nephew Henry Dwight Bassett son of said deceased brother Joseph Bassett the sum of five hundred dollars ----- Sixth -- I give and bequeath unto my niece, Annie L. Bassett, daughter of my brother Augustus Bassett one thousand dollars. ------- Seventh -- I give and bequeath unto my nephew Frederick E. Bassett son of said brother Augustus Bassett one thousand dollars ------- Eighth -- I give and bequeath unto my nephew John C. Bassett, son of my said brother Augustus Bassett one thousand dollars ----- Ninth -- I give and bequeath unto my grand nephew Walter T Hutchins son of my nephew and step son Francis W. Hutchins one thousand dollars ---- Tenth -- I give and bequeath unto my grand niece Florence M. Hutchins Page 239 daughter of my said nephew and stepson Francis W. Hutchins the sum of one thousand dollars ---- Eleventh -- I give and bequeath unto my niece Adelaide F. Hutchins wife of my said nephew and step son Francis W. Hutchins one thousand dollars. ----- Twelfth -- I give and bequeath unto my friend Helen M. Wilson, wife of Alexander N. Wilson the sum of one thousand dollars ----- Thirteenth -- I give and bequeath unto my grand niece Almira H. Bassett daughter of my nephew Henry Dwight Bassett two hundred and fifty dollars ----- Fourteenth -- I give and bequeath unto my stepson and nephew Francis W Hutchins son of my late husband Samuel W Hutchins, deceased ten thousand dollars ----- Fifteenth -- I give and bequeath unto my executor hereinafter named the sum of ten thousan dollars in trust never the less to invest the same and keep the same invested upon safe security (changing such investments at his pleasure) and collect the interest and income arrising therefrom and apply the same to the use of my sister Roxana Bacon, widow of Lucius F. Bacon during her natural life and at her decease to pay the said capital sum of ten thousand dollars to my grand niece Almira H. Judson daughter of my niece Lucy A Judson deceased unless she should then be under the age of twenty one years and unmarried. And upon the further trust if the said Almira H. Judson shouold be living, unmarried and under the age of twenty at the time of the death of my said sister Roxana Bacon, then to return such capital sum of ten thousand dollars; and keept the same invested as before and apply the interest and income arising therefrom or such part thereof as he may deem proper to the use of said Page 240 Almira H. Judson, until she gets to be twenty one years old or married; whichever event may first occur in the meanwhile accumulating the surplus interest and income not applied to her use and then to pay over to her said capital sum of ten thousand dollars and all accumulations of interest and income for her use forever ================== And upon the the further trust if said Almira H. Judson dies before my said sister Roxana Bacon leaving issue living at the death of my said sister Roxana Bacon, then to pay to said issue, equally upon the decease of my said sister the said capital sum of ten thousand dollars, And if the said Almira H. Judson should die before my said sister Roxana Bacon and leave no issue then living,then to pay over the said capital sum of ten thousand dollars to my said sister --Roxana Bacon for her life forever--------- And upon the further trust if my said grand niece Almira H. Judson, should survive my said sister Roxana Bacon, and die before she gets to be twenty one years old, or marries leaving no issue, living at her decease, then to pay over said capital sum of ten thousand dollars and all accumulations of income and interest to such person and persons and in such sums as my said sister Roxana Bacon may by last Will and Testament or instrument in the nature thereof, direct or appoint for the use of such legatee and legatees forever---- Sixteenth -- If my personal estate should not be sufficient to pay the bequests and legacies herein before mentioned in full then I order and direct that the deficiency shall be apportioned among the said several bequests and legacies, prorata, and that the sum of each of said bequests and legacies shall be abated correspondingly ======== Seventeenth -- I give and bequeath unto my sisters, Roxana Bacon widow of Lucius F. Bacon and Page 241 Betsy Williams, widow of Abel B. Williams in equal shares (one half to each) my undivided half of the furniture ornamental and useful and my other personal effects at my residence in the city of New York which are owned by me as a partner and tenant in common with my said sister Betsy Williams, and also my undivided half part of the stock tools furniture useful and ornamental, and my other personal effects at Stamford in the state of Connecticut, owned by me as a partner and tenant in common with my sister Betsy Williams --------------- Eighteenth -- I give and devise unto my sisters, Roxana Bacon and Betsy Williams, my undivied half part of the Real Estate at Stamford in the State of Connecticut which is owned by me and my said sister Betsey Williams as tenants in common thereof, to have and to hold the same to themselves and their heirs in fee simple forever.--- Nineteenth -- I give and bequeath and devise unto my sisters Roxana Bacon and Betsy Williams, and to my nephew and stepson Francis W. Hutchins, son of my late husband Samuel Hutchins, deceased, all the rest, residence and remainder of my property and estate real. -- personal and mixed, whatever the same may be and wherever it ma be, embracing every thing of value, belonging to me, which is not herein otherwise disposed of by me-------- To have and to hold the same in equal shares to them, their heirs, executors, administrators and assigns forever.-- Lastly -- I nominate constitute and appoint my nephew and step-son Francis W. Hutchins, sole executor of this my last Will and Testament --------------- In witness whereof I have hereunto set my hand and affixed my seal this twenty sixth day of September in the year of our Lord one thousand eight hundred and seventy nine; at the same time publishing and declaring page 242 this instrument and this alone to be my Last Will and Testament, and revoking all former and other Wills by me heretofor made.------ Almira Hutchins [L.S] Signed sealed published and declared by the said Almira Hutchins the testatrix above naamed as and for her Last Will and Testament in presence of each of us, who at her request in her presence, and in the presence of each other, have at the same time subscribed our names, as attesting witnesses thereto this twenty sixth day of September 1879. Seybel New York City Surrogate Court County of New York In the Matter of proving the last Will and Testament of Almira Hutchins deceased As a will of Real and personal property City County and State of New York I Darius G. Crosby of New York City being duly sworn as a witness in the above entitled matter and examined on behalf of the applicant to prove said will, says: I was well acquainted with Almire Hutchins, now deceased. I knew the above named decedent for more than ten years before her death. The subscription of the name of said Page 243 decedent to the instrument now shown to me and offered for probate as her last will and Testament and bearing date the twenty sixth day of September in the year one thousand eight hundred and seventy nine, was made by the decedent at the city of New York on or about the twenty sixth day of September in the year one thousand eight hundred and seventy nine in the presence of myself and Levi A. Lockwood and Daniel E. Seybel the other subscribing witness At the time of such subscription the said decedent declared the said instrument so subscribed by her to be her last Will and Testament; and I thereupon signed my name as a witness at the end of said instrument at the request of said decedent and in her presence. The said decedent at the time of so executing said instrument was upwards of the age of twenty one years and of sound mind, memory and understanding and not under any restraint or in any respect incompetent t devise real estate. I also saw said Levi A. Lockwood, and Daniel E. Seybel the other attesting witnesses sign their names as witnesses at the end of said Will and know that they did so at the request of said decedent and in her presence.. D. G. Crosby Witness sworn and examined before me this 3 day of Oct 1885 Charles H. Beckett Assistant to the Surrogate New York County City County and State of New York Ls Daniel E. Seybel of New York City being duly sworn as a witness in the above entitled matter and examined on behalf of the applicant to prove said Will says' I was well aquainted with Almire Hutchins, now deceased. I knew the above named Page 244 decedent for more than seven years before her death. The subscription of the name of said decedent to to instrument now shown to me and offered for probate as her last Will and Testament and bearing the date the twenty sixth day of September in the year one thousand eight hundred and seventy nine was made by the decedent at the City of New York on the twenty sixth day of September in the year one thousand eight hundred and seventy nine in the presence of myself and Levi A. Lockwood and Daniel G. Crosby[it does say Daniel here] the other subscribing witnesses. At the time of such subscription the said decedent declared the said instrument so subscribed by her to be her last Will and Testament and thereupon signed my name as a witness at the end of said instrument at the request of said decedent and in her presence. The said decedent at the time of so executing said instrument was upwards of the age of twenty-one years and of sound mind memory and understanding and not under any restraint or in any respect incompetent to devise real estate. I also saw said Levi A. Lockwood and Darius G. Crosby the other attesting witnesses sign their names as witnesses at the end of said Will and know that the did so at the request of said decedent and in her presences. D. E. Beckett Assistant to the Surrogate New York County ======================== At a Surrogate Court held in and for the County of New York at the Surrogates office in the City of New York Page 245 on the Fifth day of October in the year 1885 ======================== In the matter of proving the Last Will and Testament of Almira Hutchins deceased The Citation herein having been duly issued, served and returned, John A. Papes Esq. appearing for the petitioner the general guardian of Almira H. Judson an infant appearing by his attorney Charles J. Judson Es. the Surrogate on his own motion appointed Charles E. Marsac Special Guardian of the other infant therein the allegations of the said parties appearing having been heard and the proofs having been duly taken by the Surrogate, the hearing having been contested and it appearing to the Surrogate that the will was duly executed and that the testatrix at the time of executing it was in all respects competent to make a will and not under restraint. It is ordered adjudged and decreed that the instrument offered for probate herein be and the same heeby is, admitted to probate as the Last Will and Testament of the said deceased, valid to pass real and personal property and that letters Testamentary be issued thereon to the executors who may qualify thereunder and that said Charles E.
