SCHNATZ 1857 - 1884 =================================== Last Will and Testament of Peter H. Schnatz; Surrogates Court, County of New York IN THE NAME OF GOD, AMEN. I, PETER SCHNATZ, of the City of New York being of sound mind and memory, and considering the uncertainty of this life, do therefore make, ordain, publish and declare the following to be my last will and testament: FIRST:- I direct that all my just debts, funeral and testamentary expenses be paid. SECOND:- I give and bequeath unto my beloved wife PHILLIPPINA SCHNATZ all my household effects, both useful and ornamental, wearing apparel and jewelry absolutely forever. THIRD:- I give, devise and bequeath all the rest residue and remainder of my property, both real and personal unto my said wife to have, hold, use, occupy and enjoy the same together with the rents, issues, income and profits thereof, for and during the term of her natural life, subject however to the payment of all annual charges against my estate for taxes, assessments, croton water rents, necessary repairs, insurance premiums and interest on mortgages which may be liens on my said estate. This bequest being made to my said wife in lieu of all her dower rights which she may have in my said property. FOURTH:- Upon the death of my said wife I give and bequeath to my son JACOB the sum of Two Hundred dollars, and to my daughter KATE the sum of One Hundred dollars which said several sums so bequeathed to them I direct to be paid out of my residuary estate or the proceeds realized on a sale or sales thereof; and the balance of my said residuary estate remaining after the payment of said legacies or bequests I give, devise and bequeath unto my children JACOB, KATE, PETER AND PHILLIPPINA or their respective lawful issue to be divided between them equally, share and share alike. Such issue to take the share only which his, her or their parent would have taken if living. FIFTH:- I hereby authorize and empower my executors hereinafter named or such of them as shall qualify or the survivor of them at any time in their, his or her discretion, whenever they or the survivor of them shall deem it necessary or for the best interests of my estate to lease, mortgage or sell at public or private sale all or any part of my estate, both real and personal and to execute valid deeds of conveyances or other instruments necessary to carry this power into full effect, With full power and authority on the part of my said executors or the survivor of them to reinvest the proceeds of any and all such sales or monies obtained on mortgage for the benefit of my said wife as a life tenant under the provisions of this will, either in the purchase of real-estate or the purchase of Government Bonds, stocks or other securities, or by loaning the same upon bond and mortgage upon real estate in the City of New York, or by depositing the same in one or more Savings Banks or Trust companies in the City of New York as they may think best. LASTLY:- I hereby nominate, constitute and appoint my said wife PHILLIPPINA SCHNATZ and my son JACOB SCHNATZ executors of this my last will and testament, hereby revoking all former wills by me made. PETER SCHNATZ WITNESSES: (Illegible) CHARLES DECKERT SURROGATES COURT, CITY AND COUNTY OF NEW YORK BE IT REMEMBERED, that in pursuance of Section 2629 of the Code of Civil Procedure, I hereby certify that on the twenty seventh day of September 1897 the last will and testament of PETER SCHNATZ deceased, being the foregoing written instrument was upon due proof duly admitted to probate by the Surrogate's Court of the City and County of New York, and by the Surrogate of said City and County, as and for the last Will and Testament_____of the______ of said deceased, and as a will valid to pass real and personal property. Said last Will and Testament______and proofs are recorded in the office of said Surrogate in Liber 571 of Wills, page 455. In TESTIMONY WHEREOF, I have hereupon subscribed my name and affixed the Seal of Office of the Surrogate of said City and County, this TWENTY THIRD day of FEBRUARY One Thousand Eight Hundred and Ninety Eight. Note: The croton water rents mentioned in the above will refer to The Croton dam and aqueduct which supplied the city of New York with water, and themonies collected by the Croton Aqueduct Board. This board maintained control of all structures and property connected with the supply of Croton water and the collection of water rents, of the underground drainage of the city, public sewers, permits for street vaults, paving and repairing streets, and of digging and constructing wells. It had a Bureau of Water Rents, and one of Pipes, Sewers, and Pavements. The department was organized in July, 1849, under an act passed April 11 of that year. Previous to this the Water Commissioners were appointed by the Governor and Senate.
