NY Will Book Volume 13, Page 25 Written: September 6, 1735 Recorded: September 15, 1736 Transcribed from SAMPUBCO copy by Robert Lakin New York City, New York, Will Book Volume 13, page 25 "Will of John Cure" "In the name of God, Amen I John Cure, of the City of New York Wintner being sick and weak in Body but of sound mind memory and understanding thanks be given to Almighty God for the same Doe make and ordain this my last Will and Testament. ffirst and Chiefly I recommend my soul to God hoping for pardon of my sins by the merritts of my blessed Saviour and Redeemer Jesus Christ And my Body I committ to the earth to be decently buried in a Christian like manner at the Discretion of my Executors herein after named And as Touching all such Worldly Estate which God hath been pleased to bestow upon me I give devise and bequeath thereof in Manner and form following That is to say Item it is my will that my just Debts and funeral Charges be first paid and Satisfied within Convenient time after my Decease by my Executors and for the better enabling and Satisfying the same Do give full and Absolute power and Authority unto my Executors to sell and Dispose of all or as much of my said Estate - as shall Satisfy the same And their Conveyance for the same shall be good and sufficient against my heirs forever. Item I give devise and bequeath unto my son John one silver hilted sword Item I give devise and bequeath unto my son William Ten pounds Current money of New York Item I give Devise and bequeath unto my Daughter Sarah over and above what is bequeathed unto her together with the rest of my Children to and for her own use the sum of twenty pounds Current money aforesaid. Item I give and bequeath unto my Daughter Belicha one shilling in full Barr of any Claim or pretence to any part of my reall or personal Estate. Item All the rest and Residue of my Estate both reall & personal Whatsoever and wheresoever I give devise and bequeath unto my children Namely (to wit) Anne, John Robert William Sarah Equally to be divided amongst them all or to the survivors of them to and for their Severall uses forever And in case any or either of them should happen to Dye haveing not received the Legacy or portion herein bequeathed unto them Then the Legacie or portion of the Deceased Leaving no Lawful Issue Shall be and remain to and for the use of the Survivours or their heirs Equally to be divided amongst them share and share alike Item I do hereby revoke and anull all former Wills and Wills Testament and Testaments heretofore by me made and declared either by word or writting These presents only to be of fforce after my Decease. Item it is my will and Desire. And I do hereby further give and Bequeath unto my said Daughter Sarah one feather Bed and furniture one Cupboard one Looking Glass one Dozen of the best Chairs in the house two tables three Dishes, one Dozen of plates two Iron potts one pair of handirons one pair of Tongs one shovell one pewter TanKard two brass Candlesticks one ffrying pan one pot hook three Earthen Bowles and one Dozen of Pictures over and above what is bequeathed unto her Item it is further my will in case any of my Children should produce any Instrument Executed by me for any goods or Chattles whatsoever than the valuation of the same shall be Deducted out of his or her or their portions so bequeathed as aforesaid before any Division be made of said Estate. And Lastly I do hereby nominate Constitute and appoint my Loving son John Cure and Loving Brother-in-Law Cornelius Cousyn Executors of this my last Will and Testament anything herein Contained to the Contrary in anywise notwithstanding. Demyer Probate to the Will of John Cure Volume 13, page 26 George Clarke Esqr President of his Majesties Council and Commander in Chief of the Province of New York &c To all to whom these presents shall come or may Concern Greeting Know Ye that at New York the fifteenth day of September Instant before Frederick Morris Esqr being thereunto Delegated and appointed the Last will and Testament of John Cure was proved and now approved and allowed by me having whilst he lived and at the time of his death goods Rights and Credits in Divers places within this province by means whereof the full Disposition of all and singular the goods Rights and Credits of the said Dece'd and the granting Administration of them as also the the hearing of Account Calculation or Reckoning and the ffinal Discharge and Dismission from the same unto me solely and not unto any other Inferiour Judge are manifestly known to belong and the Admimistration of all and singular goods Rights and Credits of the said Dece'd and his last will and Testament in manner of way concerning was granted unto (John Cure one of the Exer. in said Will named Cornelius Cousyne the other Exr. in said will named having by an instrument under his hand and seal relinquist the office of Executor of or Concerning the said Will and refuse to take upon himself the Burden of Execution thereof) Chiefly of well and Truely administring the same and of making a true and perfect Inventory of all and singular goods Rights and Credits of the said Dece'd and Exhibiting the same into the registry of the prerogative Court in the Secretaries Office for the provinice of New York at or before the fifteenth day of March next ensuing and of rendering a just and true Account Calculation or Reckoning when there unto required. on Testamony whereof I have Caused the Prerogiative Seal of the said Province of New York to be hereunto affixed this Fifteenth day September Anno Domini one thousand and seven hundred and Thirty Six"
