All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ny/nyfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Betty-Lu Burton bigburma@juno.com June 24, 2011, 1:41 pm Written: October 15, 1840 Recorded: December 30, 1843 Benjamin Starkey Land Deed 1841 Samuel Newell to Benjamin Starkey FHL film # 0887716 page 63 Handwritten document, no form This Indenture made this fifteenth day of October in the Year of Our Lord One Thousand eight hundred and forty Between Samuel Newell and Minerva his Wife of the town of Newfane in the County of Niagara and State of New York of the first part and Benjamin Starkey of the Town County and State aforesaid of the second part Witnesseth that the party of the first part in Consideration of the Sum of Two hundred & fifteen Dollars to them duly paid hath Sold and by these presents doth grant and Convey to the said party of the second part his heirs and assigns all that tract or parcel of Land Situate in the town of Newfane in the County of Niagara Known and distinguished on a Map of Survey made by Joseph Elicott for the Holland Land Company as part of Lot Number Thirty Six in the fifteenth township and seventh Range agreeable to a Plan laid Down on the Margin hereof and Bounded as follows On the South by Land Deeded by Jesse Smith to Thomas Pany fifty Eight Chains & ninety two links on the East by Lot number twenty five five chains and nine links On the North by a line parallel to the first mentioned line fifty Eight Chains and Eighty nine links and On the West by lot number forty Six five Chains and Nine links Containing thirty Acres More or less be the same With the appurtanences and all the Estate title and interest therein of the said parties of the first part And the said Samuel Newell and Minerva his wife do hereby Covenant and agree to and With the Said party of the second part his heirs and assigns that the premises above Conveyed in the quiet and peacible possession of the said party of the Second part his heirs and assigns they Will forever Warrant and defend against any person Whomsoever lawfully Claiming the Same of any part thereof excepting a Mortgage of two hundred and twenty dollars executed by Samuel Newell and Wife to Lucy Porter bearing date the ninth day of October One thousand Eight & thirty nine In Witness Whereof the parties of the first hath hereunto set their hands and seals the day and year first above Written Sealed and delivered Samuell (sic) Newell {seal} in presence of Menna (sic) Newell {seal} State of New York Niagara County Ss On this 25th day of October 1841 personally came before me Samuel Newell and Minerva Newell and swearlley acknowledged that they Executed the Within deed for the uses and purposes therein Mentioned and the said Minerva being Examined by me apart from her husband acknowledged that she executed the same Without any fear or Compulsion from her said husband James (can’t read) Com of deeds Recorded December 30th 1843 at 9 OClock AM *The date of 15 October 1840 is correct and the date of 25 October 1841 is also correct.
