Witnesseth, that the said party of the first part, in consideration of the sum of four hundred fifty Dollars to them duly paid, have Sold, and by these presents do Grant and Convey to the said party of the second part his heirs and assigns forever, ALL that tract or parcel of Land Situate in the town of Newfane aforesaid Known and distinguished on a map or survey made by Joseph Ellicott for the Holland Land Company as part of Lot Number thirty six in the fifteeneth Township seventh Range agreeable to a plan laid down in the Margin hereof and bounded as follows On the South by Land Deeded by Jesse Smith to Thomas Perry fifty eight Chains & ninety two links On the East by Lot number twenty five five chains and nine links On the North by a line parallel to the first mentioned line fifty eight Chains & eighty nine links and on the west by Lot number forty six five Chains and nine links Containing thirty acres be the same more or less. The above Land is conveyed subject to a Mortgage Executed by the said party of the first part to Hosea S Strong bearing date the Eighth day of May 1846 On which there is due according to the conditions thereof the sum of three hundred Dollars as principal & interest from the date thereof With all the appurtenances: and all the estate, title and interest therein, of the parties of the first part. And the said William Starkey for himself and his heirs, (do?) hereby Covenant and Agree to and with the said party of the second part his heirs and assigns, that the premises above conveyed, in quiet and peaceable possession of the said party of the second part, his heirs and assigns, he will forever Warrant and Defend against person whomsoever, except as to the mortgage above mentioned In Witness Whereof, The parties of the first part have hereunto set their hands and seals the day and year first above written SEALED AND DELIVERED William Starkey {seal} IN PRESENCE OF Roxanna Starkey {seal} State of New York Niagara County Ss Came before me on the 13th day of February 1846 the within named William Starkey & Roxana his wife described in and who Executed the within Deed & to me known to be the same persons and duly acknowledged that they Executed the same for the (reles?) and purposes therein mentioned And the said Roxana being by me Examined separate and apart from her said husband acknowledged she Executed the same without fear or compulsion of her said husband.
