I Joshua Campbell of the Town of Cambria County of Niagara State of New York being of sound mind and memory and considering the uncertainty of the frail and transitory life, do therefore make ordain. Publish and declare this to be my last will and testament that is to say: Firist: After all my lawful debts are paid and discharged I give and bequeath to my beloved wife Currence the sum of Three Thousand ($3000) Dollars to be received and accepted by her in lieu of dower. I give to my son Jeremiah or his heirs Fifteen Hundred Dollars. I give to my daughter Elizabeth, wife of Corydon Mighles or her heirs One Thousand Dollars. I give to Emma, wife of Holmes Stedman Two Hundred and Fifty Dollars. I give to William Mighles of Warrens Corners, Two Hundred and Fifty Dollars. I give to my heirs of my deceased son Two Hundred and Fifty dollars. I give to Ella wife of Philo Gritman, Two Hundred and Fifty Dollars. I give to my son Sydney or his heirs Fifteen Hundred Dollars. I give to my daughter Syrena wife of Lyman Lewis or her heirs Fifteen Hundred Dollars. I give to William St John my grandson Eight Hundred Dollars which several sums or legacies I direct and order to be paid to said respective legalese within one year after the sale of any real estate. Second I direct my executor to erect an iron fence around my lot in the cemetery where I shall be buried at a cost of not exceeding Three Hundred Dollars within one year after my decease. Third I give and bequeath all the rest and residues of my estate of whatever name and nature to my son Jeremiah or his heirs and to my son Sydney or his heirs and to my daughter Syrena or her heirs to be divided equally between them share and share alike. Fourth I direct that my widow shall have the use of my dwelling house horse barn and garden free of all expense to her during one year from the time of my decease. Fifth I direct that the sum of money I give to Mrs. E. S. G. Dutton of Sanborn about the year 1865 shall remain in her possession or in the possession of her heirs forever. Sixth I give and devise all of my real and personal estate of what nature or kind soever to Artenas W. Comstock the execution of this my last Will and Testament hence soafter nominated and appointed in trust for the payment of my just debts and the legacies above specified with power to sell and dispose of the same at public or private sale at such time or times and upon such terms and in such manner as to time shall seem ??? provided however that no part of my real estate as aforesaid shall be sold at public auction until after the expiration of three years from the time of my decease. Likewise I make constitute and appoint Arteneas W, Comstock of the Town of Cambria County of Niagara state of New York to be executor of this my Last Will and Testament, hereby revoking all former wills by me made. "Codicil" Whereas I Joshua Campbell, of the town of Cambria, County of Niagara, have made my last Will and Testament in writing bearing date the third day of April in the year of our Lord, One Thousand Eight Hundred and Seventy Two, on and which which I have given and bequeathed to my daughter Elizabeth, wife of Coyden Migles deceased or his heirs the sum of one thousand dollars in which will above referred to I have also given to Emma wife of Homer Stedman the sum of two hundred and fifty dollars; also in said will above referred to I have given two hundred and fifty dollars to William Mighles of Warren Corners, now therefore I do by this writing which I declare to be a codicil to my said last Will and Testament and to be taken as a part thereof order and declare that my will is that only the sum of one hundred dollars be paid to my daughter Elizabeth or her heirs in full of the said legacy given and bequeathed to her. Also that no sum of money be paid to Emma wife of Homer Stedman instead of the legacy given and bequeathed to her also that no sum of money be paid to William Mighles of Warrens Corners instead of the legacy given and bequeathed to him and that the remaining part of said legacies given and bequeathed to my daughter Elizabeth, given and bequeathed to Emma wife of Homer Stedman, and given and bequeathed to William Mighles to be given ? paid to the remainder of my heirs excepting to my wife Currence share and share alike. And Lastly it is my desire that this Codicil be amended to and be part of my Last Will and Testament as aforesaid to all interests and purposes.
