NY Wills - Probate Records Vol 18 years 1875 FHL#0854273 P 61-63 Written 23 Jun 1874 Proved 23 Mar 1875 Niagara County Surrogate’s Court Last Will And Testament of Hetty C.Wilson Deceased Be it Remembered, That heretofore, to-wit: On the 15th Day of March in the year of our Lord one thousand eight hundred and seventy five. Reuben F. Wilson the Executor named in the Last Will and Testament of Hetty C Wilson late of the Town of Wilson in the County of Niagara deceased, appeared in open Court, before the Surrogate of the County of Niagara, and made application to have the said Last Will and Testament _______________ which relates to both Real and Personal Estate, proved: and on such application the said Surrogate did ascertain by satisfactory evidence who were the husband heirs at law and next of kin of the said Testatrix and their respective residences, and said Surrogate did thereupon issue a Citation in due form of law, directed to the _________________ heirs at law and next of kin of said deceased, by their respective names, stating their respective places of residence ____________________________________ ______________________________________________ , requiring them to appear before said Surrogate, at his office in the City of Lockport, in said County, on the 23rd day of March , A.D. 1875 to attend the probate of said Will, ____________________________________________________ _________________________________________________________________________________ ______________________________________________ And afterwards, to-wit: on the 23rd day of March A.D. 1875, satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law, and on that day said Executor appeared & it appearing that Reuben S Wilson & Fannie R Wilson named in the petition in this matter are minors who have been duly served with the Citation George P. Ostr? In his consenting thereto was duly appointed the Special Guardian for said minors to appear for them and take care of their interests in this matter and said Special Guardian appearing and no one appearing to oppose the Probate of such Will _______________, such proceedings were thereunto had in said Court, afterwards, that said Surrogate took the proofs of said Will __________________ hereinafter set forth, upon ________________________________________________________ ____________________________________________________ This 23rd day of March 1875, and be thereupon adjudged the said Will _________________________________ to be a valid Will __________________ of Real and Personal Estate, and the proofs to be sufficient, which said Last Will and Testament ______________________________________________________________ _____________________________________ and proofs are as follows that is to say: “Will” The Last Will and Testament of Hetty C. Wilson wife of Reuben F. Wilson of the Village of Wilson County of Niagara and State of New York. Made the 23rd day of June 1874. I Hetty C. Wilson being of sound mind and disposing memory do make, publish and declare this my last will and testament in manner and form following that is to say. First I give and bequeath to my children the following articles of personal property as follows to wit: To my daughter Harriet Adelia my gold Watch, to my daughters Harriet Adelie & Fannie Pease jointly my Florence Sewing machine, to my son Reuben Stanley my gold chain worn on my Watch: to my daughter Fannie Pease the chain (gold Satchel) worn on my watch Second I give and bequeath to my children Ella Geraldine, Harriet Adelia, Reuben Stanley, and Fannie Pease out of my property & Estate in the state of New York the sum of Seven hundred dollars each to be paid as follows: to my daughter Ella Geraldine in one year after my decease, to Harriet Adelie (ten?) years after my decease, to my son Reuben Stanley four years after my decease, to my daughter Fannie Pease, six years after my decease; and in case of the death of any or either (to faded to read) issue, him or her surviving at the time his or her said legacy shall become due then the said legacy shall go to my said children who shall be living when said legacy becomes due as aforesaid Equally or to the survivor or Survivors of then. Third I give and bequeath to my four children herein above named in addition to the above bequest the amount due one or to come to me from my fathers Estate, and which may be received by my executor from my brother Don A Pease of Toledo Ohio Executor and I hereby direct my said Executor to pay and distribute the said amount equally to & among my said children applying the same rule of distribution as is contained in paragraph “Second” above. Fourth, After the payment of all my just debts, and foregoing bequests. I give, devise, & bequeath all the rest & residue of my Estate to my daughter Ella Geraldine to have and to hold the same forever. Lastly I hereby constitute and appoint my husband Reuben F. Wilson sole executor of this my last will & testament with full power to carry the same into full force & effect and without requiring him to give bail or security for the faithful discharge of his duties as such executor, and he shall not be required to make or file any inventory of my estate or account to the Surrogate for the disposition he may make of my Estate. In witness whereof. I have hereunto set my hand and Seal the day & year first above written. Hetty C. Wilson {seal} The foregoing instrument consisting of one sheet was at the date thereof signed, Sealed, published & declared by the above named Hetty C. Wilson testatrix as and for her last will and testament in presence of us who at her request & in her presence & in the presence of each other have hereunto subscribed our names as witnesses thereto.
