Williams esq., surrogate of said county, for the purpose of proving and recording the Last Will and Testament of Peter Antis, late of the town of Deerfield in the County of Oneida, deceased, in the pursuance of chapter sixth, title first, article first part second, of the Revised Statutes of the State of New York, and of an act entitled "An Act concerning the proofs of Wills, Executors and Administrators, Guardians and Ward, and Surrogate's Courts," passed May 16, 1837, and other acts concerning the same, on the application of John P. Ganett in said Will named one of the Executers. Stephen D. Wise being duly sworn and examined in open court testified that he was well acquainted with Peter Antis deceased, and had been for the last 30 years immediately preceding his death, that he died in the month of March last past, at Deerfield in the County of Oneida, which was his last place of residence at the time of his death; that he saw the said Testor sign the paper here offered, to be proved, recorded, and admitted to probate as the Last Will and Testament of the said deceased, on the day the same bears date, (the seal having been previously affixed,) that this deponent signed the same, at the same time as a subscribing witness, in the presence of the Testor and at his request, and in the presence of the Testor and at his request, and in the presence of this deponent. Abraham Hughes, being duly sworn and examined in open court testified that he was well acquainted with Peter Antis deceased, and had been for the last 30 years immediately preceding his death, that he died in the month of March last past, at Deerfield in the County of Oneida, which was his last place of residence at the time of his death; that he saw the said Testor sign the paper here offered, to be proved, recorded, and admitted to probate as the Last Will and Testament of the said deceased, on the day the same bears date, (the seal having been previously affixed,) that this deponent signed the same, at the same time as a subscribing witness, in the presence of the Testor and at his request, and in the presence of Stephen D. Wise who also at the same time signed the same The foregoing proofs and examinations having been taken before me, the Surrogate aforesaid, at the time and place above mentioned, and the depositions of the respective witnesses having been by them respectively subscribed after having been carefully read over to them; I, the Surrogate, being satisfied Peter Antis. In the name of god amen: I, Peter Antis of the town of Deerfield the County of Oneida and State of New York of the age of sixty five years and upwards, being of sound mind and memory, do make, publish and declare this my last will and testament, in manner and form following. First, I resign my soul unto the hands of almighty God and my body I commit to the earth to be buried at the discretion of my surviving friends, and my worldly estate I give and devise as follows: First, I give and bequeath to my beloved wife Jackie the use and occupancy of the one third of all my real and personal property of every name and nature; also the use and occupancy of one half of the dwelling house that I now live in (to be optional with her what part of said house she will occupy) also all my household furniture during her natural life. Second, I give and bequeath to my son John W. the sum of ten dollars to be paid by my son Francis S. at any time the same shall be demanded at the house I now live in after one year from my decease. Third I give and bequeath to my son Peter V. the sum of one thousand two hundred dollars on condition that my son Peter V. shall release to my son Francis S. his interest in and to a certain lot of about nineteen acres which is deeded to said Peter V. and Francis S. and lying in the southerly side of my farm, and it is my desire that Peter V. do release as aforesaid, then the amount shall be eight Hundred Dollars (instead of one thousand two hundred) to be paid by my son Francis S. as follows, viz: the sum of two hundred dollars in one year after my decease and the remainder one half in two years and one half in three years after my decease. Also the sum of five hundred dollars in addition on condition that he Peter V. shall receive by Will of his Uncle Francis Antes a sum less than one thousand Dollars, which sum shall be paid in one year from the decease of his said Uncle Francis and if he Peter V. shall receive by Will of his uncle as above the amount as large as one thousand dollars then this two hundred is not to be paid. Fourth, I give and bequeath to my son Francis S. the remaining two thirds of all my real and personal property together with the one third (which I had willed to my wife) after the decease of my said wife, subject to the bequest already mentioned and following and payment of the same. Fifth, I give and bequeath to my daughter Catharine M. the sum of five hundred dollars to be paid by my son Francis S. as follows, viz: one hundred dollars when she arrives at the age of twenty one years and one hundred dollars yearly from that time until the whole is paid with interest on all the sums unpaid after she is entitled to the first payment provided that my decease occur before she arrives at the age of twenty one years. If otherwise, no interest is to be paid her until one year after my decease. Also, all the household furniture including bedsteads, beds and bedding and carpets after the decease of my said wife. Also that she shall have a home with Francis S. as long as she remain unmarried, and in the case of the marriage of Francis S. she is to have a separate room and fire wood if she desires. It is my will also that my son Francis S. shall pay all my debts and the legacies above mentioned and the same shall be a lien upon the real estate until paid. I hereby nominate and appoint my son Francis S. Antes and my friend John P. Garrett as executors of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto subscribed my name this 14th day of March in the year of our Lord one thousand eight hundred and fifty four. N.
