THE PEOPLE OF THE STATE OF NEW YORK TO George Bartlett, John Bartlett, Charles Bartlett, James Richards & Lucinda Richards, his wife, James Bailey & Anna Bailey, his wife & Sarah Aucutt of Lee, Oneida Co., Joseph Bartlett & Barnard Bartlett of Alexandria, Jefferson Co. & Joseph S. Avery, special Guardian of William Bartlett, a minor of Clinton, Oneida Co., N.Y. Heirs at Law and next of kin of Joseph Bartlett, deceased WHEREAS John Bartlett has this day offered the last will and testament of the said Joseph Bartlett late of the town of Lee in the county of Oneida, deceased, for probate as a will of real and personal estate, before Othniel S. Williams, Surrogate of the county of Oneida. You are therefore hereby cited to appear before the said Surrogate at Stanwix Hall, in the town of Rome, in the county of Oneida, on the fourth day of September, 1855 at 10 o'clock in the forenoon of that day to atten to the probate of said will. PETITION AND AFFIDAVIT RELATING TO WILL OF JOSEPH BARTLETT (continued) Surrogates Court In the matter of proving the last will and testament of Joseph Bartlett, deceased. To O.S. Williams, Esquire, Surrogate of the County of Oneida. The petitioner, Grace Bartlett/ by Cyrenus M. Greene, her atourney, the executive named in the last Will and Testament of Joseph Bartlett late of the town of Lee in the County of Oneida and State of New York, deceased, respectfully showeth that the said Joseph Bartlett died on or about the 10th day of March 1854 at the town of Lee in the county of Oneida aforesaid, which was the place of his residence at the time of his death: that the instrument now presented and shown for your petitioner, purporting to be the last will and testament of the said deceased and bearing date upon the ____ day of ____ 185__, your petitioner verily believes to be such last will and testament; that the said instrument purporting to be such last will and testament relates to both real and personal estate that the same was who has kept the same in his possession from and after the time he so received the same as aforesaid, until this day, until he delivered the same to the Surrogate of the county of Oneida for Probate. And your petitioner further shows that the deceased left: A widow, Grace Bartlett, of Lee, Oneida Co., N.Y. & sons, George Bartlett, John Bartlett, Charles Bartlett, William Bartlett a minor all of Lee aforesaid; Joseph Bartlett, & Barnard Bartlett of Alexandria, Jefferson Co., 3 daughters, Lucinda Richards, wife of James Richards, Anna Bailey, wife of James Bailey, all of Lee N.Y. & Sarah Aucutt, a widow of Lee aforesaid. and who are all and the only heirs at law and next of kin of the said deceased. Your petitioner therefore prays that a citation may issue to the above heirs at law and next of kin to the said deceased. (The citation continues and is signed by Grace Bartlett, O.S. Williams and C.Greene, the attorney for the estate.) THE back of the citation bears the following testimony. Oneida County – John Bartlett of Lee in said County being duly sworn says that he is informed that in addition to the persons named within, that George, Henry, Aaron, Sarah Ann, Joseph, Francis and Delos Aucutt, all minor children of Hannah Aucutt, a deceased daughter of said Testator are next of kin to said Joseph Bartlett, deceased. Your petitioner therefore prays that a citation ______ ______ to them to attend the probate of the Last Will of said deceased.
