I, James FARQUHAR of Floyd in the County of Oneida and State of New York do make, ordain and declare this my Last Will and Testament in manner following to wit: Firstly - I give and bequeath (in lieu of Dower) unto my beloved wife, Caroline FARQUHAR, the use of one equal third part of all my Real Estate during her natural life and all my household furniture to be disposed of at her pleasure. Secondly - I give and bequeath unto my son, William B. FARQUHAR my two watches one gold and one pinch (sp?) back watch. Thirdly, I give and bequeath unto my son William B. FARQUHAR and my daughter Elizabeth FARQUHAR all the rest and residue of my real and personal property of every name and nature whatsoever to be equally divided between them, & also the Real Estate, the land (sp?) of which is hereby bequeathed to my wife Caroline FARQUHAR, after her decease. And Lastly, I do hereby constitute and appoint my wife Caroline FARQUHAR Executrix and my beloved sister Charlotte FARQUHAR and my beloved friend, William H. JEFFERSON, Executors to this my last Will and Testament and I do hereby fully and absolutely authorize and empower them whenever they shall or may jointly deem it best for the interest of my heirs above named to sell and dispose of all or any part of my Real Estate and to execute and deliver good due sufficient deeds in law to the purchaser or purchasers of the same and to make such disposition of the monies of such sale or land as they may Deem but calculated to promote the interests of my heirs as aforesaid. In testimony whereof I have hereunto set my hand and affixed my seal this twenty eighth day of August in the year of our Lord one thousand eight hundred and twenty nine (28 August 1829). Farquhar and my daughter Elizabeth FARQUHAR to be equally divided between them and this equal disposition to be paid them when they shall arrive at a lawful age and the interest to be applied to (their care) and education and I do further give and bequeath unto my well beloved wife Caroline FARQUHAR, the use of income of all my personal estate except for the above mentioned three hundred dollars in addition to what is bequeathed in the above Will during her natural life and I do hereby constitute and appoint Samuel POTTER of the town of Floyd as one of the executors to this my last Will and Testament. HAMILTON of Steuben Caleb CLARK of Steuben Nathaniel WARED of Steuben At a Surrogate Court held at the Surrogate's Office in the town of Rome in the County of Oneida on the first day of October 1832 before Allanson (sp?)BENNETT, Surrogate of said County for the purpose of proving testimony and admitting to probate the Last Will and Testament of James FARQUHAR Junior, late of Floyd in the County of Oneida directed pursuant to the required statute in such and matter provided upon the application of Samuel POTTER, Executor in the said matter - Samuel POTTER the Executor appearing in person and prayed that the hearing proceed no person appearing on the part of the heirs. The Hearing Proceeded- At a Surrogate Court held at the Surrogate's Office in the town of Rome in the County of Oneida on the tenth day of September A.D. 1832 Present Allanson BENNETT, Surrogate Whereas Samuel POTTER one of the Executors named in the Last Will and Testament of James FARQUHAR late of the town of Floyd in the County of Oneida and State of New York Herewith as is alleged intends to make application to the Oneida Surrogate to have the said Will proved before the joie Surrogate and accorded pursuant to the resident statute of the State of New York, Chapter on Wills, first article, first part, second. And whereas it has been made satisfactorily to approve one William FARQUHAR and Elizabeth FARQUHAR heirs of the said James FARQUHAR are minors, it is ordered by the said Surrogate that John P. GEES of the town of Floyd in the County of Oneida be appointed guardian for the said minors to take care of their interests in the proceedings. Allanson BENNETT, Surrogate In the matter of proving recording and admitting to probate the Last Will and Testament of James FARQUHAR late of the town of Floyd in the County of Oneida, deceased. Oneida County as John P. GEES being duly sworn say's that he is a substantial freeholder of the County of Oneida and has no interest in the proving of the Will of James FARQUHAR deceased. GEES of the town of Floyd in the County aforesaid Guardian for the said minors to take care of their interest in this proceeding.
