O'Neill Oneida County NY Will Book Vol 45 page 254 I Joseph Tisserant, now residing at number 36 Garden Street in the City of Utica, County of Oneida, and State of New York, being of sound and disposing mind and meory, do hereby make, ordain, publish and declare this my Last Will and Testament, in manne rfollowing that is to say: First: I give and bequeath unto my daughter Adele Kimm, my gold watch, also all my household furniture, ornaments and other personal property, which I am accustomed to use or keep in my dwelling house, to have and to hold absolutely, and I give and bequeath all of my clothing to my son-in-law William F. Clark, of Westmoreland, N.Y. to have and to hold absolutely. Second: Out of the rest and residue of my estate real and personal, there shall be paid all of my just debts and funeral expenses. Third: I give, grant, devise and bequeath, subject to the payment therefrom of said debts and funeral expenses, all the rest and residue of my estate, real and personal of which I die seized or possessed wheresoever the same may be situated including the real estate deeded to me and my wife Caroline Tisserant, now deceased as tenants of the entirety, (husband and wife) unto my daughter Adele Klimm, wife of Anthony Klimm of Utica, N.Y. and unto my daughter Camille Clark, wife of William T. Clark, of Westmoreland, County of Oneida, N.Y. share and share alike, one half to each to have and to hold th them their heirs and assigns forever. Lastly: I hereby nominate, constitute and appoint my daughters, Adele Klimm and Camille Clark the executrices of this my last Will and Testament, hereby revoking, annulling and celling all former Wilsl by me made, and I authorize and empower my said exectrices, and the survivor of them to grant and convey any real estate of which I die seized and to do all things required, to give to the purchaser thereof, good title to such real estate. Surrogate's Court, Oneida County, State of New York In the Matter of Proving the Last Will and Testament of} Joseph Tisserant, Deceased} Examination of Subscring Witness sworn and examined in the Surrogate's Court of Oneida County, in the above entitled proceeding. State of New York} County of Oneida} ss: Richard W. McIncrow, being duly sworn as a witness in the above entitled proceeding, and examined on behalf of the petitioner propounding for probate said Last Will and Testament, says; I reside in the City of Utica in the County of Oneida and State of New York. I was acquainted with Joseph Tisserant, late of the City of Utica, in the County of Oneida, now deceased, and had known him for five years, prior to his death. I am one of the subscribing witnesses to the instrument now shown and exhibited to me, bearing date the 22d day of May, 1889, and now offered and prpounded for probate as and for the Last Will and Testament of the above named decedent. The subscriptio nof the name of said decedent at the end of said instrument was made by the said decedent in the presence of myself and Adam Weimer, the other subscribing witness thereto. At the time of such subscriptio nthe said decedent dclared the said instrument so subscribed by him to be his Last Will and Testament, and I thereupon signed by name as a witness at the end of said instrument at the request and in the presence of said decedent. I also saw said Adam Weimer, the other subscribing witness, sign his name as a witness at the end of said instrument, and knew that he did so at the request of said decedent and in his presence. The said decedent at the time of so executing said instrument was a citizen of the United States, and upwards of the age of twenty-one years, and of sound mind, memory and understanding and was not under any restraint to the best of my knowledge and belief, and in my opinion was competent to devise real estate.
