(Onondaga County L of A Book IV p. 62) David Kingsbury of the town of Marcellus, County of Onondaga was appointed Administrator of the estate of Thomas Tanner Junior late of Marcellus December 22, 1814. Signed George Hall ( Onondaga County L of A Book IV p. 64) Court of Common Pleas held at the Court House in the Town of Onondaga for the county of Onondaga, Nov 4, 1819. David Kingsbury & Nathan Tanner, Alfred Northern their Attorney, against Amos Tanner, Asa Tanner, Phebe Tanner, Solomon Tanner & Van Rensselaer Ranner in a plea for the partition of lands. The petition of David Kingsbury of Marcellus, and & Nathan Tanner of Perry in the County of Genessee respectfully sheweth that your petitioners together with Amos Tanner, Asa Tanner, Phebe Tanner, Solomon Tanner & Van Renselaer Tanner of the town of Marcellus, are seized in fee simple as tenants in common in equal parts of a certain farm or tract of land in Marcellus part of Lot 53, bounded on the south by the highway, north by lands of Jonathan Reed, the west by land of the said Nathan Eagleston containing 63 Acres. Petitioners desirous that partition should be made between them and the said Amos Tanner, Asa Tanner, Phebe Tanner, Solomon Tanner & Van Rensselaer Tanner, pray that the said premises may be divided between them. Amos, Asa Phebe, Solomon & Van Renssealer by Nathan Eagleston, their Guardian, who is admitted by the said Court to prosecute and defend for said Amos, Asa, Phebe, solomon & Van Rensselaer, who are respectively minors, within the age of 21, said that they cananot deny the matters in the petition of David & Nathan . Amos, Asa, Phebe, Soloman & Van Rensselaer by their said Guardian freely consent that partition thereof may be made between them according to the petition. Jonathan Reed. Amasa Sessions, and John Hunt appointed commissioners to make partition by 4th Monday of February next. Commissioners to sell the premises at public venue to the highest bidder. They did sell the premises at such auction to richard Robinson for the sum of $1024.68. Said commissioners to pay each of the said petitioners the one seventh part of the money from the sale of said premises and that the remaining 5 seventh parts of said money be paid to Nathan Eggleston the guardian of the said Defendants for their use in equal proportions, the said commissioners first deduction from the share of each of the said parties one seventh part of the costs & charges in the amount of $50.31.Judgement signed May 24, 1820 J.
