MAYNARD  and JOHN EAGLESTON JUNIOR  for $550 part of Lot 23 in Marcellus
bounded by land formerly owned by JOSEPH TAYLOR AND NOW BY ISRAEL CURTIS,
SAMUEL WOOD, highway running from the old Genesee road to the turnpike. It is
understood there is a Martgage on said premises given to ZEBINA MOSES on which

wife of the first part and EBENEZER HAWLEY of Marcellus. For $400 sold piece
or parcel of ground known and distinguished by the name of Lot 120 in the late
Onondaga Reservation, bounded beginning at a post standing on the North side
of the Turnpike Road between or at the inner on an acre of land sold to and
now occupied by JOSEPH DANIELS, north 11 degrees west 3 chains 64 links then
east 1 chain 51 links thence south 11 degrees east 3 chains 87 links thens
south 81 degrees west along the North line of the Turnpike road to the place
of beginning containing « acre of land, it being bounded on the east on the
lot occupied by JAMES WELLS and being part of the land sold to SAMUEL VINTON &
by him to JOSEPH FELLOWS. . .the said SAMUEL EGGLESTON at the time of the
sealing and delivery of these presents is lawfully seized in his own right of
a good absolute and indefeasable estate of Inheritance in fee simple. The said

B. MILLER and deeded to LIBEUS SPERRY by PETER B. MILLER, POLLY MILLER, JAMES
MILLER AND LYDIA MILLER bearing date 15 September 1831 near the Stone saw mill
running from said Stake southerly to the center of the highway leading from
the Nine Mile Creek to SETH DUNBAR from thence westerly along said highway 10
rods from thence northerly 10 rods to a stake and stones thence westerly 11
and « rods to the place of beginning containing « acre of land, excepting and
reserving therefrom about 25 rods of land heretofore conveyed to JONATHAN

MRS.  CHARLOTTE BRADLEY for $560 part of Lot 7 in Marcellus, beginning in the
centre of the Highway in the gulf east of land formerly owned by WM MUNRO and
running thence northerly in the center of said gulf to about five feet below a
certain spring from thence in a westerly direction about 14 rods to a stake
and stones thence directly south to the centre of the highway thence east
along the centre of the said highway to the place of beginning, with the right
always to take and carry water from said spring above mentioned in logs and
the right to put in said logs and to repair the same as often as necessary

28 June 1860 WILLIAM J. WALLACE, a Referee in partition duly appointed as
hereafter mentioned party of the first part and EBENEZER COMSTOCK of the town
of Onondaga, party of the second part. Witness whereas JOHN EGGLESTON JR. did
exhibit in the Supreme Court a bill for division and partition of certain
premises therein mentioned according to the respective rights of the parties
interested therein and for a sale of such premises if it should appear that a
partition thereof could not be made without great prejudice in   persuasion
the statute relating to the partition of lands in which bill or complaint is
set forth in the name of the parties so interested.  Party of the first part
should distribute all the said premises with the appurtenances at public
auction to the highest bidder.  Whereas the said referee pursuant to the said
order and direction after giving public notice of the time and place of said
sale, 20 March at 2:00 p.m. at the office of CORNELL CRYSLER in the Village of
Marcellus. The said premises sold to said party of the second part for $1100,
that being the highest bid. Land part of lot 167 in the town of Onondaga,
beginning at the north east corner of said lot thence south on the east line
of said lot 21 chains 645 links, thence west 29 chains thence north 21 chains&
45 links to the north line of said lot thence East along said north line of
siad lot 29 chains to the place of beginning, containing 62 & ?/100 of land,
reserving a piece or parcell and land deeded by JOHN EGGLESTON, deceased to
WINLOCK EGGLESTON, bounded as follows, beginning 5 rods north of the south
line of land owned by EBENEZER COMSTOCK on the east side of the road running
north to Montfredy Grist Mill. . . east 16 rods thence south 10 rods thence
west 16 rods to the place of beginning, containing one acre of land. And

Mile Creek thence east to the bank of said Creek at highwater mark thence
southerly along the bank of said Creek at highwater mark to the said EGGLESTON
land thence west on the said EGGLESTON'S north line to the east line of the
highway thence northerly along the east line of said highway to a point due
west of the place of beginning thence east to the place of beginning, together
with the priviledge of taking water from a certain floom as is contained in a
certain deed of Conveyance executed by JOHN WIARD JUNIOR to DANIEL EGGLESTON.
Also excepting and reserving the right of taking water across the premises for

runs from the Paper Mill to Parkinson's Black Smith Shop at a point due east
of the most southerly of five Butternut trees growing near together on the
side hill on the west bank of Nine Mile Creek thence west to the most
southerly of the aforesaid butternut trees thence westerly along the lover
side of a small elm tree standing about 12 feet south west of a large rock to
NATHAN WEST'S land as owned by him in 1836 thence southerly along the east
line of the farm formerly belonging to LYMAN? COOK to the bank of the Nine
Mile Creek thence following the band of said creek & mill pond to the center
of the aforesaid highway thence northerly along the center of said highway to

10 April 1857 JONATHAN EGLESTON of Marcellus, party of the first part and 
GEORGE W. RYAN & HIRAM ELGESTON of the second part. Whereas the said JONATHAN
EGLESTON has become embarrassed in his circumstances and unable to pay and
discharge with punctuality or in full the several debts owing by him. Now
therefore for the purpose of making a fair and equitable distribution of his
property and assets among his creditors and for the purpose of appropriating
the same unconditionally and without delay to the payment of his debts the
said first party hath and by these presents doth hereby in consideration of
the premises & one dollar to him in hand paid sell and convey unto the said
second parties . . .all the real estate. . part of Lot 7 in Marcellus, bounded
on the west by the Camillus and Marcellus Plank road , on the north by the
lands of the heirs of ROBERT RHODES, dec'd  On the East by the west bank of
Nine Mile Creek and on the south by said Creek, Excepting and reserving all
that part thereof heretofore conveyed to TRUMAN EGLESTON and also for a like
consideration he sells, assigns, transfers and sets over ?said second parties
all his goods, wares, personal property except such articles as are by law
excepted from execution and also all bills, bonds, notes accounts, judgements
and evidences of debt of any kind and nature for these to have and hold the
same. . . The said second parties shall take immediate possession of said
property and by sales and collections covert the same into money, and from the
proceeds thereof after paying and satisfying in full and the taxes and
assessments upon said property and the costs and expenses of . . .carrying
into effect this assignment the said second parties shall first pay and
discharge in full a judgement against the said first party and the said GEORGE
W. RYAN, the second party which is for said first party to pay in favor of the
Crouse or Central City Bank. Also a note made by the said GEORGE W. RYAN for
the benefit and accommodation of said first party now owned by said Central
City Bank and all their notes made or endorsed by said RYAN for the
accommodation of said first party and in case there shall not be sufficient to
pay and discharge the same in full there to pay the same prorate according to
their respective amounts to second to pay out of the remainder of said estate
assigned all of the debts borrowing by me to any previous persons whomsoever
of corporation whatsoever and said remainder shall not be sufficient to pay
the same in full there to pay the same prorate according to their respective

$1000 part of Lot 7 in Marcellus, beginning at the south east corner of the
Blacksmith Shop on said premises and running thence easterly to the south west
corner of Saw Mill of said first party thence southerly on a line with the
west of said Saw Mill to the westerly bank of the Nine Mile Creek thence
southerly up said west bank to the east line of the Camillus & Marcellus
Plankroad thence northerly along the last line of said road to a point due
west of the place of beginning thence east to the place of beginning. Together
with the water power and privilege & machinery now in use in the blacksmith
shop on said premises. Also the right to convey from the Millpond of ISAAC
HILL such surplus water as they shall not want at any time for the use of the
Flouring Mill of said HILL provided said second party shall from time to time
and at all times defray one fourth part of all the expenses of building and
keeping the dam to said pond in repair and shall do nothing which shall in any
way injure the water privilege of said flouring mill and provide also shall no
person or persons shall hereafter and in said premises any machinery for
grinding grain except for the use of any distillery which may be in operation
on said premises and also subject to the right heretofore reserved to the
owner of the woolen factory to build a dam . . . and also reserving the right
and privilege to take the water from the flume upon the premises hereby
conveyed and of conveying the same to the Saw Mill. This reservation is
intended to and does reserve to the first party all the surplus water from the
flouring mill dam or pond as above provided except so much as may be necessary
when prudently & carefully used to propell the machinery now in said Machine
Shop on the premises hereby conveyed for the use of the first parties sawmill?
above mentioned and said second party is also at his own expense to maintain
and keep in repair the flume on said premises from the dam to the point where

17 August 1857 JAMES M. MUNRO, Sheriff of the County of Onondaga of the first
part and ALBERT G. EGLESTON of the city of Syracuse of the second part .
Whereas at a special term of the Supreme Court of the state of New York held
at court room in the city of Syracuse on the 24th of June 1857. . .in an
action then pending in the said Court between ALBERT G. EGLESTON, plaintiff
and JONATHAN EGLESTON, The Crouse Bank, GEORGE M. RYAN, HIRAM EGLESTON,
defendants. That all and singular the mortgaged premises mentioned in the
complaint in said action and said judgement described or so much thereof as
might be sufficient to raise the amount due to the plaintiff for principal,
interest and costs in said action and which might be sold separately without
mater injury to the parties interested by sold at public auction according to
the course and practice of said court by or under the direction of the said
JAMES M. MUNRO, Sheriff of Onondaga County and to whom it was directed by the
said order and judgement of the said Court among other things to make such
sale that the aid sale be made in the County where the said Mortgaged premises
or the greater part thereof are situated that the Sheriff give public notice
of the time and place of such sale according to the course and practice of
said court and that any of the parties in said action might become a purchases
or purchasers on such sale, that the said Sheriff execute to the purchaser or
purchasers of the said mortgaged premises or such part or part thereof as
should be sold a good and sufficient deed or deeds of conveyance for the same.
And whereas the said Sheriff in pursistance of the order and judgement of the
said court did on the 8th day of August 1857 sell at public auction at the
Syracuse House in the city of Syracuse the premises in the said order and
judgement mentioned due notice of the time and place of such sale being first
given agreeably to the said order at which sale the premises hereinafter
described were struck of the said party of the second part for the sum of
$2600 that being the highest sum bidden for the same. Part of Lot 7 in
Marcellus, beginning 8 feet south of the south west corner of a certain
building heretofore occupied by HENRY PLATT for a Curry & Shoe Shop near the
Nine Mile Creek thence east to the bank of said creek at highwater mark thence
southerly along up the bank of said creek to land owned by JONATHAN EGLESTON
on the 9th of June 1839, thence west on the said EGLESTON's north line to east
line of the Plank road thence northerly along on the east line of said highway
or Plankroad to a point due west of the place of beginning thence east to the
place of beginning together with the privilege of taking water from a certain
flume as is contained in a deed of conveyance executed by JOHN WIARD JR. to
DANIEL EGLESTON and also reserving the right of taking water across the
premises for the use of the factory and tannery below together also with all
the water power, privilege and machinery which was conveyed by said mortgage
said premises being those conveyed by HORACE MOSES and SANFORD DALLIBA by deed

corner of the building now occupied by ROBERT RHODES near the Nine Mile Creek
at what is called the Falls from thence running east to the Bank of said creek
at highwater mark thence southerly along the bank of said creek at high water
mark to a point due east of the south west corner of the old Mill and
Distillery burnt down when owned by PLATT & SHEPHERD thence west passing on
the said south west corner of said Old mill and Distillery wall to the east
line of the highway (crossing the creek below RHODES factory) thence along
said East line of said highway to a point due west of the place of beginning
from thence east to the place of beginning together with the privilege of
taking the water from the flume formerly owned by SALMON C. NORTON leading
from the Dam formerly owned by PARKER & TALLED to the building now owned and
occupied by JONATHAN EGGLESTON as a Blacksmith Shop, Machine Shop and Dwelling
standing about 12 feet south of the south line of the premises herertofore
described excepting and reserving sufficient water at any and all times in
said floom to carry the Water Wheel now in operation in the said buildings
belonging to the said EGGLESTON together with the machinery which may be
necessary to attach to said wheel or any other wheel requiring no more water
power that the present one and in all respects subject to the same privileges
and reservations as are contained in the deed or conveyance from SALMON C.
NORTON & PHILENA his wife to the said JOHN WIARD JUNIOR & TIMOTHY SANDS
bearing date 31 December 1832 the premises herein conveyed are now ever
subject to a certain Mortgage executed by the said JOHN WIARD JUNIOR to DANIEL
DOWNEY in which there with be remaining unpaid of principal and Interest of

Paper Mill to Parkinsons Blacksmith Shop at a point due east of the most
southerly of five butternut trees growing near together on the side hill and
on the west bank of Nine Mile Creek thence west to the most southerly of the
foresaid butternut trees thence westerly along the lower side a small Elm tree
standing about 12 feet south west of a large rock to NATHAN WEST land on the
east line of the LYMAN COOK farm thence southerly along said line to the bank
of Nine Mile Creek thence following the bank of said Creek on the Mill Pond to
the center of the aforesaid highway to the place of beginning. Reserving to
the owner of the Mill pond adjoining the privilege of building and repairing

PLATT as a Curry & Shoe Shop thence running east to the west bank of the Nine
Mile Creek at highwater mark thence southerly on the bank of said Creek at
highwater mark to the corner of land which was conveyed to the said EGGLESTON
by SALMON C. NORTON thence west to the east bounds of the highway thence
northerly on the east bound of said highway to a point due west of the place
of beginning thence east to the place of beginning, together with the
privilege of taking and using the water from a certain floom as is contained
in a certain deed of conveyance executed by JOHN WIARD JUNIIOR to DANIEL
EGGLESTON also excepting and reserving the right of taking water across the
premises for the use of the Factory & Tannery.. . .express condition that if
the said JONATHAN EGGLESTON his heirs, executors administrators or assigns
shall pay to the said HORACE MOSES & SANFORD DALIBA the sum of $1500 and
interest which is payably annually in the manner following, to wit: $300 the
first day of October next and the remainder in installments of $600 per annum
which installments are to be paid as follows $300 on the first day of May and
$300 on the first day of October in each and every year in good and
Mercantable Gath at $6 per chains and feet  the said EGGLESTON reserving to
himself the right of paying the above sum at any time provided that such
payment or payments shall amount to 25,000 feet of lath at any one time then
these presents shall cease and be null and void. But incase of non-payment of
the said sum of $1500 and interest in any part thereof at the time above
limited for the payment thereof then and in such case it shall and may be
lawful for the said parties of the second part their heirs executors
administrators or assigns and the said party of the first part doth hereby
empower and authorize the said parties of the second part their heirs
executors, administrators, or assigns to grant bargain sell lease and convey
the said premises with the appurtenances at public auction or vendue and on
such sale to make and execute to the purchaser or purchasers his or their
heirs and assigns forever good ample and sufficient deed or deeds of
conveyance in the law pursuant to the statute in that case made and provided
rendering the surplus monies (if any there should be) to the said party of the
first part his heirs executors or administrators after deducting the costs and

the no person or persons shall hereafter erect on said premises any machinery
for the purpose of grinding grain except for the use of any distillery which
may be in operation on said premises. Also reserving and subject to the right
and privilege of taking and carrying from said Creek to the Woollen factory
sufficient water for the use of said factory and tannery and of building and
keeping a dam across said creek so high and at such place as may or shall be
necessary for carrying the water as aforesaid to the factory and tannery, and
also the privilege of using the surplus water from the aforementioned mill
pond to JOHN WIARD & TIMOTHY SANDS or their successors as will more fully
appear by referance to a certain deed executed by the said parties of the
first part to the said WIARD & SANDS said premises herein conveyed are subject
however to a certain mortgage executed by the said parties of the first part
to JOHN HERRING to secure the sum of $500 and interest bearing date September

the highway which runs from Marcellus Falls northerly by the present residence
of said party and on the north line of lands formerly owned by GEORGE A. RYAN
being the paper mill lot thence running east to the west line of land formerly
owned by WARREN S. WALKER about 18 2/3 rods then north along said WALKER'S
line about 10 « rods to a stake & stones thence westerly along a board fence
to the aforesaid highway thence south along the line of said highway to the

25 September 1865 ALBERT G. EGLESTON & SUSAN A. EGGLESTON his wife of the city
of Syracuse sold to SUSAN G. BRIGHT of  Marcellus for $2250 part of Lot 7 in
Marcellus beginning  8 feet south of the south west corner of a certain
building heretofore occupied by HENRY PLATT JR. for a curry & shoe shop near
the Nine Mile Creek, thence east to the Bank of said creek at highwater mark
thence southerly along up the bank of said creek to land owned by JONATHAN
EGLESTON on the 9 day of June 1839 thence west on the said EGLESTON north line
to east line of the plank road thence northerly along on the east line of said
highway or plank road to a point due west of the place of beginning thence
east to the place of beginning together with the privilege of taking water
from a certain flume as contained in a deed of conveyance executed by JOHN
WIARD JR. to DANIEL EGLESTON and also reserving the right of taking water
across the premises for the use of the factory and tannery below together also
with all the water     Privilege and machinery which was conveyed by said
mortgage said premises being then conveyed by HORACE MOSES & SANFORD DALLIBA
by deed bearing date Nov. 9 1839 to said JONATHAN EGLESTON and the same
premises conveyed to the party of the first part by JAMES M. MUNRO. Sheriff of
the county of Onondaga by deed bearing date August 19, 1857. This conveyance
is made subject to the payment of a mortgage thereon of $500 and interest
thereon now held & owned by DAVID MUNRO of Camillus. The party of the first
part also reserves to himself the saw mill wheel and the irons appertaining

EGGLESTON of same place of the second part for $800 part of Lot 7 in
Marcellus, beginning 8 feet south west corner of the building occupied by
ROBERT RHODES near the Nine Mile Creek at the falls so called from thence
running east to the bank of the Nine Mile Creek at highwater mark thence
southerly along the bank of said Creek at high water mark to a point due east
of the south west corner of the old Mill & Distillery formerly owned by JOSEPH
PLATT thence west passing on said southwest corner of the said Mill &
Distillery to the east line of the highway crossing the Creek below RHODES
factory thence along said East line of said highway to a point due west of the
place of beginning thence east to the place of beginning, together with all
the privileges and subject to all the reservations contained in the deed from
JOHN WIARD & wife to the party of the first part. . . .upon this express
condition that if the said party of the first part pay to the said party of
the second part the sum of $800 in one year from date with Interest on the
same according to the condition of a certain bond or writing obligatory
bearing Even date herewith executed by the said DANIEL EGLESTON to the said
party of the second part as a collateral security then these presents and the
said bond bond ?obligatory shall cease and be null and void: But in case of
now payment of the said $800 with the Interest or any part thereof at the time
above limited for the payment thereof then and in such case it shall be lawful
for the said party of the second part his heirs executors, administrators or
assigns and the said party of the first part doth hereby impower and authorize
the said party of the second part her heirs executors administrators or
assigns to grant bargain sell release and convey the said premises with the
appurtenances at public auction or Vendue and on such sale make and execute to
the purchaser or purchasers his her or their heris and assigns forever good
lawful and sufficient deed or deeds of conveyance in the law pursuant to the
statute in such case made and provided rendering the lawful moneys (if any
there should be) to the said party of the first part his heirs executors, or
administrators after deducting the costs and charges of such vendue and sale

14 March 1820 JAMES CORNWELL of Marcellus and SYLVIA his wife sold to JOEL
WASHBURN of the town of Marlborough, county of Hartford, State of Connecticut
for $2100 part of Lot No. 52 in Marcellus beginning at a point in the north
line of said lot in the center of the same equally distant from the north east
and the north west corner of said lot and running thence south to the middle
of the said lot half way from the north to the south line of the same lot
thence west so far that a line drawn north parallel to the first mentioned
boundary line to the north line of the said lot shall inclose 100 acres of
land. Thence north to the north line of the said lot thence east on said north
line to the place of beginning containing 100 acres of land, subject to a
certain mortgage executed by SIMEON SKEELS to the loan offices of the county
of Onondaga given to secure the payment of $71. Also one other piece of land
also part of Lot No. 52 in Marcellus beginning at the north west corner of one
acre of land deeded to SILENCE CORNWELL thence east along said SILENCE's north
line to the north east corner of said SILENCE's east line to the center of the
highway thence east along the center of the highway to BENJAMIN EGGLESTON's
land thence north along the said BENJAMIN and NATHAN EGGLESTON's west line to
the north west corner of said NATHAN's land thence west along the north line
