Whereas the said JONATHAN EGLESTON has become embarrassed in his circumstances and unable to pay and discharge with punctuality or in full the several debts owing by him. Together with the water power and privilege & machinery now in use in the blacksmith shop on said premises. Also the right to convey from the Millpond of ISAAC HILL such surplus water as they shall not want at any time for the use of the Flouring Mill of said HILL provided said second party shall from time to time and at all times defray one fourth part of all the expenses of building and keeping the dam to said pond in repair and shall do nothing which shall in any way injure the water privilege of said flouring mill and provide also shall no person or persons shall hereafter and in said premises any machinery for grinding grain except for the use of any distillery which may be in operation on said premises and also subject to the right heretofore reserved to the owner of the woolen factory to build a dam . . . and also reserving the right and privilege to take the water from the flume upon the premises hereby conveyed and of conveying the same to the Saw Mill. This reservation is intended to and does reserve to the first party all the surplus water from the flouring mill dam or pond as above provided except so much as may be necessary when prudently & carefully used to propell the machinery now in said Machine Shop on the premises hereby conveyed for the use of the first parties sawmill? above mentioned and said second party is also at his own expense to maintain and keep in repair the flume on said premises from the dam to the point where he shall draw the water from said flume. Whereas at a special term of the Supreme Court of the state of New York held at court room in the city of Syracuse on the 24th of June 1857. . .in an action then pending in the said Court between ALBERT G. EGLESTON, plaintiff and JONATHAN EGLESTON, The Crouse Bank, GEORGE M. RYAN, HIRAM EGLESTON, defendants. That all and singular the mortgaged premises mentioned in the complaint in said action and said judgement described or so much thereof as might be sufficient to raise the amount due to the plaintiff for principal, interest and costs in said action and which might be sold separately without mater injury to the parties interested by sold at public auction according to the course and practice of said court by or under the direction of the said JAMES M. MUNRO, Sheriff of Onondaga County and to whom it was directed by the said order and judgement of the said Court among other things to make such sale that the aid sale be made in the County where the said Mortgaged premises or the greater part thereof are situated that the Sheriff give public notice of the time and place of such sale according to the course and practice of said court and that any of the parties in said action might become a purchases or purchasers on such sale, that the said Sheriff execute to the purchaser or purchasers of the said mortgaged premises or such part or part thereof as should be sold a good and sufficient deed or deeds of conveyance for the same.
