[--beginning of document dated 14 JAN 1863--] State of New York ) )ss: County of Onondaga ) On this 14th day of January A.D. 1863 personally appeared before me the County Clerk of the County and State aforesaid, Euphemia Hills a resident of Manlius in the County of Onondaga and State of New York aged twenty five years, who, being first duly sworn according to law, doth on her oath make the following declaration, in order to obtain the benefit of the provisions made by the act of Congress approved July 14, 1862: That she is the widow of David O. Hills who was a private in Company "I" commanded by Captain Demming in the Sixty First Regiment of New York Volunteers in the war of 1861, who died at Harrison's Landing Va. on the day of July 1862. She further declares that she was married to the said David O. Hills on the twenty-seventh day of June in the year 1852; that her husband the aforesaid David O. Hills died on the day above mentioned, and that she has remained a widow ever since that period, as will more fully appear by reference to the proof hereto annexed. She also declares that she has not in any manner aided or abetted the rebellion in the United States. That she hereby appoints R. F. TROWBRIDGE, of the City of Syracuse, New York, her true and lawful Attorney for her and in her name to present this claim, and to receive the certificate to be issued thereon. ($1.00 stamp) Euphemia Hills Also personally appeared Orin Scullen and Phoebe Wells residents of said County persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they were present and saw Euphemia Hills sign her name to the foregoing declaration; and they further swear that they know from their being acquainted with her, that she is the identical person she represents herself to be, and that they have no interest in the prosecution of this claim. Barrett Comm Pensions When our army was driven from the vicinity of the "White House" the sick & wounded were hurried on board the transports to be taken to Baltimore or Philadelphia. Many of these died on board the vessels. As no one made a report to the proper department of these deaths -many of the lost were too far gone to give any information of themselves - there is no way for widows & orphans at this distance from the scene to prove the death of which you say "there is no official evidence" Please advise me in what manner it is possible for us to furnish this testimony. There are those who saw some of these persons just before they were carried on board and can give evidence of their low condition prior to death and that is the last known of them. Bates a resident of Manlius in said County being duly sworn says that he was a member of Co. "I" in the 61st regiment of New York Volunteers from its organization in October 1861 to the fall of 1862; that David O. Hills was a member of the same Co and deponent was well acquainted with him; that deponent was warden of the hospital at Fair Oaks during the month of June and for part of July, 1862; that said Hills was in said hospital sick with typhoid fever and under the charge of deponent; that said Hills was very low; that in the latter part of June an order came to examine all patients and send to the hospital all who were dangerously sick; deponent was selected to assist the examination and said Hills was one of those selected and was sent from the hospital in the last week in June; that the surgeons and all other persons present gave their opinion that Hills would not recover and would die soon; deponent assisted in sending Hills away; that Dr. Vogel of said Regiment took an interest in the condition of said Hills, and shortly afterwards received a letter stating that Hills died on board the transport before it reached Annapolis and that deponent read said letter. Hills and Euphemia Davenport that there is no church record of said marriage, that he did not give them a certificate of marriage having no blanks at the time, and that he has no interest in this claim Truman Van Tassel Subscribed and sworn to before me this 9th day of November 1864 and I certify that deponent is the person he represents himself to be and creditible to belief E. Euphemia Hills of the Town of Pompey in the County of Onondaga & State of New York, being duly sworn says that David O. Hills, late of Co "I" 61st Regt N.Y. Vols was at the time of his decease her husband. That she has obtained the Bounty and Back Pay from the U.S. Government on account of said deceased. That she knows of his death through Daniel D. Bates, whose affidavit is hereto attached and through E. Tryon Bates who was a member of said Company "I" at the time of the death of David O. Hills, and that said E. Tryon Bates has since died. That all the knowledge deponent possesses relative to the sickness & death of said David O. Hills is derived through said E Tryon & Daniel D. Bates. That based on said knowledge she declares that said David O. Hills died in the month of July or June 1862 a few weeks after the battle of Fair Oaks. That he died on board a transport as she is informed & verily believes, the name and the destination of which she is unable to give; That she knows not the name or address of any surgeon commissioned officer or any person whatever on board said transport, and that she knows of no means of obtaining such name or address and that for this reason she believes herself unable to present or obtain any certificate of a surgeon or commissioned officer or any proof further than that heretofore & herewith presented. Further she says that she knows of no means by which she can ascertain any names or address of such commissioned officer surgeon, or person. Bates of the town of Manlius in said County being duly sworn says; That he was well acquainted with David O. Hills late of Co "I" 61st Regt of New York Vols, now deceased. That deponent was a member of said Company "I" at the time the disease occurred of which said David O. Hills afterwards died. That he was attacked at or about the time of the Battle of Fair Oaks with bilious fever and chronic diarrhea; Deponent was at that time ward-master of Hospital at Fair Oaks and had the care of said deceased from within three or four days after said Battle till he was taken away - about two weeks. That he assisted in placing him in an ambulance to be carried to the Rail Road by which he was to have been taken to White House Virginia, with the intention of being taken thence by water transport to some point unknown to deponent. That he afterwards, within a few weeks, heard read a letter addressed to Dr H.C. Vogel, Chaplain and then acting Assistant Surgeon of the 61st Regt of New York Vols purporting to have been written by the surgeon in charge on the transport stating that said David O. Hills had died on board the transport and his body was sent in the sea. Deponent is unable to remember the names of the transport, or the name of the writer of the letter and he does not know the address of Dr. Vogel afore-named. Deponent says that from the time of the removal of said Hills and the date and receipt of the aforesaid letter he must have died within ten days after his departure and deponent believes not far from the middle of July. Deponent further says, That he knows of no way of ascertaining more accurately in regard to the death of said David O. Hills, and that from what he does know of the matter he believes it to be almost, if not entirely, an impossibility. Deponent further says that he has since been honorably discharged from the service of the United States and that he has no interest whatever in any application on account of said David O. Hills, dec'd. Daniel D. Boss a resident of the town of Fabius County and State aforesaid who being by me first duly sworn according to law deposes and says; that he resides as aforesaid; that he was recently 1st Lieut of Company "B". 61st Regiment N.Y. State Infantry Vols. That he was a member of said regiment from the date of its organization until its muster out of service; that in the month of June A.D. 1862 he was a sergeant in company "I" of said regiment; that David O. Hills was a private in said company; that upon the 15th day of June A.D. 1862, said Private David O. Hills being very dangerously sick of Typhoid Fever was sent from the camp of said regiment then at Fair Oaks Station Va. to the Division Hospital at White House Station Va. Deponent further says that while upon the cars upon said date en route to said hospital said Private Hills died of aforesaid disease; that said fact was well known in said company at the time, and he always supposed it was as it should have been so reported. Deponent further says that he has no interest in the Pension Claim of Mrs. Euphemia Hills widow of said David O. Hills for a pension. Morris E. Lewis County ) On the 30th day of August A.D. 1866 before me, Clerk of the County aforesaid and of the Courts of Record therein, personally appeared Euphemia Jobs, a resident of the town of Watson, County & State aforesaid, who being by me first duly sworn according to law deposes and says; that she is now the wife of Arch Jobs of aforesaid town and was married to said Jobs on the 15th day of April A.D. 1863; that she was then the widow of David O. Hills, deceased, who was a private in Company "I" 61st Reg't N.Y. State Infantry Volunteers, and who died while in the service of the U.S. and in his line of duty as such soldier as is aforesaid at or near White House Landing in the State of Virginia on or about the 1st day of June A.D. 1862. That the said David O. Hills died leaving, besides his widow this declaimant, their children him surviving; that said children are all under sixteen years of age; and are named and aged as follows, viz: Helen C. Hills, born July 16th 1854 Harland D. Hills, born October 15th 1855 Charles H. Hills, born April 8th 1860. That said children are of the names and ages as above respectively set forth, and are all the children left surviving by aforesaid David O. Hills, deceased. That said children were born to said David and this declarant during lawful wedlock, while this declarant was said David's wife as aforesaid. Deponent further says; that on the 12th day of March 1866, she was duly appointed by the Honorable C.P. Scovil, County Judge and Surrogate of the County of Lewis guardian of the persons and estates of the aforesaid Children of David O. Hills, deceased, and is now such guardian. That Declarant has not been engaged in nor in any way aided or abetted the Rebellion in the United States. That she makes this declaration for a pension for said minor children, under the provisions of the acts of Congress of July 14th 1862, and of July 25th 1806 and such other acts, laws or regulations as may be applicable to her cases. She declares that her age is 29 years; that her Post Office address is Watson Lewis County N.Y. And she hereby appoints and constitutes Edwin S. Jenney of Syracuse, Onondaga County N.Y. her attorney, with full power of substitution to procure for her as guardian of said minors, from the United States, such pension as they are entitled to, and to receive such certificate as may be issued for the same. Deponent further says that she made application for a widows pension, as widow of said David O. Hills, deceased; that before the granting of said pension she remarried as aforesaid and that by reason of such remarriage said claim was repealed; that the number of her said application was 12,976, and she refers to the evidence filed with her said application for proof of the death of the said David O. Hills and for proof of the marriage of said David and this declarant. Euphemia Jobes Also at the same time and place appeared 1st Rosell Hall of the town of New Bremen, County and State aforesaid aged 28 years and Melissa M Butts of the town of New Bremen, County and State aforesaid aged 21 years, persons whom I certify to be respectable and entitled to credit, who being by me first duly sworn according to law, depose and say; that they are acquainted with Euphemia Jobs the foregoing declarant; that they were present and saw her sign her name to the foregoing declaration, and know her to be the identical person she therein represents herself to be. Devenport, aged 56 years, a resident of the town of Cazenovia, Madison County & State aforesaid and Caroline Voorus aged sixty years, a resident of the town of Manlius, County and State aforesaid, persons whom I certify to be respectable and entitled to credit who being by me first duly sworn according to law depose & say; that they do reside and are ages respectively as aforesaid. They further say, that they are acquainted with Euphemia Jobs, wife of Arch Jobs, of the County of Lewis, State of New York, formerly widow of David O. Hills, deceased, who was a Private in Company I, in the 61st Reg't NY Vols. And now guardian of the minor children of said David O. Hills, deceased. The deponent (lined through: Brazillah) Mary O. Davenport, for herself, says that she is the mother of said guardian Euphemia Jobs and the deponent Caroline Voorus, for herself, says that she has been acquainted with said guardian Euphemia Jobs for more than twenty years last past, and was acquainted with her former husband, said David O. Hills, deceased, in his life time, and knew him for more than five years prior to his death which occurred about June 1, 1862, as she is informed and believes; that during the whole time of her acquaintance with said Euphemia and said David, she has known them both well & continually and her intercourse with them has been constant and familiar. Deponents, each for herself, further say; that they were present at the house of said David O. Hills in the town of Manlius County and State aforesaid on the 16th day of July A.D. 1854, and saw said Euphemia Jobs (then wife of said David O. Hills) delivered of a female child; that said child was subsequently named Hellen Corlista Hills; that deponents have known her almost constantly since her birth and she is the identical child now residing with her mother and called by that name and her and the rest of the three children of whom said Euphemia is mother and duly appointed guardian, and for where, as such guardian, she is making application for a pension; that said child was born while said David O. Hills and said Euphemia were living together in lawful wedlock. Deponents further say that they distinctly recollect the date of such birth and it occurred as above stated on the 16th day of July 1854. Deponent Mary O. recollects it from being the child's grandmother and having constantly kept tract of her age, and deponent Caroline recollects it from the fact that she was at that time next neighbor to said Euphemia, whose house was within call of deponent. They further say that they have no interest in the claim of said Euphemia, guardian for a pension. Mary O Davenport, signed in the Mary O. Devenport Presence of Joseph Baker (her mark) John H. Hills, deceased, who was as deponent is informed and believes, a Private in Company I in the 61st Reg't NY Vols. And that said Arch Jobs & Euphemia now reside in the county of Lewis in the state aforesaid. He further says that he has no interest in the claim of said Euphemia Jobs for a pension as guardian of the minor children of said David O. Hills, deceased. Hills, her deceased husband in his lifetime - that they knew him several years prior to his marriage with the said Euphemia Jobes (whose maiden name was Euphemia Davenport) that the said David O. Hills was not married prior to his marriage with the said Euphemia Davenport, now Euphemia Jobes, that she was his first and only wife, that by the said David O. Hill in his life time also his wife Euphemia & that said Euphemia had three children of her deceased husband David O. Hill and herself, born during wedlock under sixteen years of age who are now all living and provided for & supported by their mother said Euphemia, & that deponant was present in the town of Fabius N.Y. on the 10th of October 1856 at the birth of Harland Duane Hills & remained with said Euphemia several days after the birth of said Harland. County of Onondaga ) On the 14th day of February A.D. 1868, before me a Justice of the Peace within and for the county and state aforesaid personally appeared Elizabeth Hills a resident of the town of Fabius, County and State aforesaid, aged 61 years a person whom I certify to be respectable and entitled to credit, who being by me first duly sworn according to law deposes and says; that she resides and is aged as aforesaid; that she was acquainted, in his life time with David O. Hills, late a Private in Company "I" 61st Reg't N.Y. Vols., deceased, and is acquainted with Euphemia Jobs, who was the widow of said David O. Hills deceased and is now the guardian of the children of said David, and as such guardian is making application for a pension for such children. That the deponent is the wife of the uncle of said David. That the deponent was present on the 10th day of October A.D. 1856 at the residence of said David and said Euphemia in the town of Fabius in said county of Onondaga and witnessed the birth by said Euphemia of a male child, that said child was named Harland Duane Hills, and is the identical child now living of that name, whose guardian is said Euphemia Jobs. That deponent well recollects the date of said birth and that it occurred October 10, 1856, as is above stated. Deponent further says that at the time of said birth said David and Euphemia were man and wife and that said child was born in lawful wedlock. This deponent has been acquainted with said David for twenty years last past until his death, and has been acquainted with said Euphemia for fifteen years last past. That she has been acquainted with said child Harland Duane Hills continuously since his aforesaid birth. Deponent further says that she has no interest in the said pension claim of said Euphemia Jobs as such guardian as is aforesaid. Edmund Wheaton Justice of the Peace [--end of document dated 14 FEB 1868--] [--beginning of document dated 09 MAR 1868--] State of Wisconsin ) )ss County of Eau Claire ) On the 9th day of March A.D. 1868 before me a Justice of the Peace within and for the county and state aforesaid, personally appeared Amelia Travis a resident of the town of Bridge Creek in the county and state aforesaid, aged 39 years, a person who I certify to be respectable and entitled to credit who being by me first duly sworn according to law deposes and says; that she resides as aforesaid and is aged as aforesaid; that she was acquainted in his life time with David O. Hills, deceased, who was a Private in Company "I" 61st Regiment N.Y. Vols. And is acquainted with Euphemia Jobs, who was the widow of said David and is the guardian of the children of said David, and as such guardian is seeking application for a pension for said children; that she was acquainted with said David for Ten years prior to his death and has been acquainted with said Euphemia for thirty years last past; that she was present on the eight day of April 1860 at a certain house in the town of Alma in Jackson county state of Wisconsin and saw said Euphemia delivered of a male child; that at that time said David and Euphemia were living together in lawful wedlock as man and wife; that said child was named Charles Henry Hills; that she has known said child continuously since that time and said child is the identical child now called by that name; that she well recollects the date of said birth and the same is as is above stated. She further says that she has no interest in the said claim of Euphemia Jobs as such guardian for such pension as aforesaid.
