D page 108 Written: January 22, 1823 Recorded: January 24, 1825 Transcribed from SAMPUBCO copy by Marilyn Kulkarni The people of the State of New York by the grace of God free and independent, to all to whom these presents shall come or may concern send greetings – Know ye that at the Town of Onondaga in the County of Onondaga on the twenty-fourth day of January one thousand eight hundred and twenty five before Freeborn G. Jewett Surrogate of our County of Onondaga, the last will and testament of Thomas Foster late of the Town of Pompey and County of Onondaga deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us, and the said deceased having whilst he lived and at the time of his death goods, chattels or credits within this State by means whereof the proving and registering the said will ______ granting Administration of all and singular the said goods chattels and credits, and also the auditing allowing and final discharging the account thereof doth belong unto us – the Administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto Calvin Foster executor in the said will named he being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof when thereunto required. In testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed – witness Freeborn G. Jewett Surrogate of the said County at the town of Onondaga this twenty fourth day of January one thousand eight hundred and twenty-five – F. G. Jewett Surrogate The last will and testament of Thomas Foster of the Town of Pompey County of Onondaga and State of New York, I Thomas Foster considering the uncertainity of the mortal life and being of sound mind and memory (blessed be Almightly for the same) so make and publish this my last will and testament in manner and form following (that is to say) First I give and bequeath unto my daughter Sally Alpha Potter wife of Bradford A. Potter fifty dollars to be paid by my executor in household furniture after the decease of my wife – Item I give and bequeath unto Wealthy Warner, Martin Warner, Matilda Warner Alma Warner Maria Warner and Lewis Warner, my grandchildren being the children of Heman Warner and my daughter Phebe now dead one dollar each, to be paid by my executor after my decease – Whereas I have before given to my sons DeLanson Foster Martin Foster and Aaron Foster each of them one hundred acres of Land and what I have assisted them besides I consider to be their proportion of my property – Item I give and devise to my youngest son Calvin Foster his heirs and assigns all that undivided morty or one half the farm now in my possession being one hundred and fifteen acres of Land on the North East corner of Lot number Eleven in the Town of Pompey (the other morty of said farm I have this day deeded to my said son Calvin) to hold to him the said Calvin Foster his heirs and assigns forever, and lastly as to all the real residue and remainder of my personal estate goods and chattels of what kind and nature so ever I give and bequeath the same to my said son Calvin Foster, whom I hereby appoint sole executor of this my last will and testament, hereby revoking all former wills by me made- In writing whereof I have hereunto set my hands and seal the twenty second day of January in the year of our Lord one thousand eight hundred and twenty three. D. 1825 came before me Freeborn G. Jewett surrogate of the County of Onondaga John Watson who being by me duly sworn did depose and say that he saw Thomas Foster sign and Seal an instrument in writing purporting to be hi last will and testament bearing date the twenty-second day of January one thousand eight hundred twenty three (the preceding whereof is a true copy) and at the same time heard him publish and declare the same as his last will and testament and that at the same time the said testator was of sound and disposing mind and memory to the best of the knowledge of him the said John Watson and that he subscribed the said will in the presence of the said testator and the other subscribing witnesses to said will and that they all subscribed the said will in the presence of each other and in the presence of the said testator and he in their presence and on the same day came Calvin Foster the executor in the said will named and was duly qualified by taking the necessary oath and thereupon Letters testamentary with a copy of said will annexed the preceding whereof are copies were issued accordingly recorded – F.
