Ogden. In the matter of proving the last will and testament of Moses How, deceased. Onondaga County, NY; Be it remembered that heretofore upon the petition of Eber Ingalsbe, sole executor named in the last will and testament of Moses How, late of the town of Van Buren, in said county, deceased, for that purpose, to the Surrogate of said county, a citation was duly issued in this matter, which citation with the proofs of service thereof were thereafter duly returned to said Surrogate, and which said petition and citation, with the proofs of service thereof, are now on file in the office of said Surrogate. And thereupon the last will and testament of said Moses How deceased with proofs thereof were produced and are as follows, viz: In the name of God, Amen; I Moses How of the town of Van Buren, County of Onondaga and State of New York, considering the uncertainty of this mortal life and being weak in body but of sound mind and memory, blessed be Almighty God for the same, do make and publish this my last will and testament in manner and form following that is to say: First, I give and bequeath unto my beloved wife Polly How all my money, bonds, notes and accounts that be due me at the time of my decease and also all my personal property that may be mine at the time of my decease excepting and reserving the amount of the following legacies which I hereby direct my Executors or Executrix to pay to the several persons hereinafter mentioned within one year after my decease, that is to say that is to say [sic]: I direct the sum of twenty five dollars Laura Warner wife of Ira Warner, the further sum of fifty dollars to Anny Warner wife of Ezra Warner, the further sum of fifty dollars to Betsey Hart, wife of Eber[?] Hart, the further sum of fifty dollars to Polly Hart wife of Pardow Hart, the further sum of fifty dollars to Susan Weaver wife of William Weaver, the further sum of fifty dollars to Parcy[?] Nichols wife of Browning Nichols, the further sum of fifty dollars to the heirs of Sally Wild to wit: Moses Wild & Myra twenty five dollars each they being the children of my daughter Sally Wild and the further sum of fifty dollars to be paid to my son Samuel How, which said several legacies or sums of money I will and order shall be paid within one year after my decease as aforesaid and lastly, I hereby appoint Eber Ingalsbie my sole executor of this last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this seventh day of March 1843. Charles H. Toll of Town of Van Buren Joseph I. Glap of Town of Van Buren F. R. Bentley of Town of Van Buren Onondaga County, NY; Charles H. Toll of the town of Van Buren, in the County of Onondaga, being duly sworn and examined, doth depose and say that he, this deponent, was well acquainted with Moses How, late of the town of Van Buren, in the county of Onondaga, deceased. That this deponent was present as a witness and did see the said Moses How subscribe at the end thereof the instrument now produced and shown to this deponent, purporting to be the last will and testament of the said deceased, bearing date the seventh day of March 1843. That the said testator at the same time declared the instrument so subscribed by him to be his last will and testament. That thereupon this deponent and Joseph I. Glap and Francis R. Bentley subscribed their names at the end thereof as witnesses thereto, at the request of the testator, in his presence; and that the said testator at the time of executing and publishing the said last will and testament was of ? full age and of sound mind and memory, not under restraint, and was in all respects competent to make a last will and testament Charles H. Toll Sworn this 28th day of May 1849 before me Isaac T. Minard, Surrogate Onondaga County, NY; Joseph I. Glap of the town of Van Buren, in the County of Onondaga, being duly sworn and examined, doth depose and say that he, this deponent, was well acquainted with Moses How, late of the town of Van Buren, in the county of Onondaga, deceased.
