Babcock deceased ) Onondaga County Be it remembered that heretofore upon the petition of John P. Babcock Executor named in the last Will and Testament of Stanton P. Babcock late of the City of Syracuse in said County deceased for that purpose to the Surrogate of said County a citation was duly issued in this matter which citation with the proofs of service thereof was thereafter duly returned to said Surrogate. And which said petition and citation with the proofs of service thereof are now on file in the office of said Surrogates. And therefore the said last Will and Testament of the said deceased and the proofs thereof were produced and are as follows, viz. In the name of God, Amen. I Stanton P. Babcock of the City of Syracuse in the County of Onondaga being of sound mind and memory do publish and declare this my last Will and Testament in manner following that is to say First. I give and bequeath to my Wife Lucy, the sum of three thousand dollars in Bank Stock which I own in the Salt Springs Bank in the City of Syracuse aforesaid. And I also give and bequeath unto my said wife the sum of one hundred dollars to be paid to her on my deceas by my Executors hereinafter named and which said same above mentioned are bequeathed and are to be received and accepted by my said Wife in lieu of dower. I also give and bequeath to my said Wife all my Household furniture (Beds and Bedding included) also my Library. To my son John P. Babcock, I give and bequeath the sum of two thousand dollars. And I also direct my said Executors after my deceas to give up and deliver unto my said son a promissory note for the sum of Nine hundred and sixty seven dollars. To my son Edwin Babcock I give and bequeath the sum of two thousand dollars. To my daughter Lucyan Pendleton I give and bequeath the sum of two thousand five hundred dollars. To my daughter Frances H. Morgan I give and bequeath the sum of two thousand five hundred dollars. To my daughter Abbey Hinckley I give and bequeath the sum of two thousand five hundred dollars. To my two sons John W. and Edwin I give my wearing apparel to be equally divided between them. Second. I give bequeath and devise all the rest and residue of my personal and real Estate of whatever kind the same may be unto my children to be equally divided between them by my said Executors after my decease provided that all my just debts and funeral expenses shall first be paid. Third. I hereby nominate constitute and appoint my son John P. Babcock and Aaron G. Fisk of the Village of Fulton, Oswego County Executors of this my last will and Testament hereby giving unto my said Executors full power and authority to sell and convey any and all real Estate which I may own at the time of my decease and divide the proceeds as aforesaid. Fourth. I hereby direct my said Executors after my deceas to purchase and erect at my grave a suitable monument of such kind and value as to them may seem meet for which they are to pay before making a distribution of my property as above directed. Babcock as and for his last Will & testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as Witnesses thereto. W.S. Babcock deceased ) Onondaga County Andrew I. Fish of the town of Volney in the County of Oswego being duly sworn and examined doth depose and say that he this deponent was well acquainted with Stanton P. Babcock of the City of Syracuse in the County of Onondaga deceased That this deponent was present as a Witness and did see the said Stanton P. Babcock subscribe at the end thereof the instrument now produced and shown to this deponent purporting to be the last Will and Testament of the said deceased bearing date the 20th day of April in the year of our Lord one thousand eight hundred and fifty five. That the said testator at the same time declared the instrument so subscribed by him to be his last Will and Testament. That thereupon this deponent and Willis S. Nelson of the town of Volney subscribed their names at the end thereof as Witnesses thereto at the request of the testator in his presence. And that the said testator at the time of executing and publishing the said last Will and Testament was of full age and of sound mind and memory not under restraint, and was in all respects competent to make a last Will and Testament. A.I. Fish Subscribed and sworn this 28th day of ) May 1837 before me ) A.H. Jerome, Surrogate ) Onondaga Surrogate Court ) In the matter of proving the ) Last Will and Testament ) of ) Stanton P. Babcock deceased ) Onondaga County Willis S. Nelson of the town of Volney in the County of Oswego being duly sworn and examined doth depose and say that he this deponent was well acquainted with Stanton P. Babcock late of the City of Syracuse in the County Onondaga deceased. That this deponent was present as a Witness and did see the said Stanton P. Babcock, subscribe at the end thereof the instrument now produced and shown to this deponent purporting to be the last Will and testament of the said deceased bearing date the 20th day of April in the year of our Lord one thousand eight hundred and fifty five. That the said testator at the same time That therefore this deponent and Andrew I Fish of the town of Volney subscribed their names at the end thereof as Witnesses thereto at the request of the testator in his presence. And that the said testator at the time of executing & publishing the said last Will and Testament was of full age and of sound mind and memory not under restraint and was in all respects competent to make a last Will and Testament. Babcock deceased as a Will of Real and Personal Estate together with the proofs thereof taken and had in the Court of the Surrogate of the County of Onondaga which record pursuant to the provisions of the Revised Statutes Additional Comments: Some parts of the foregoing were too faint to make out. Stanton P. Babcock was born 15 Dec 1778, Westerly, Rhode Island and died 7 Apr 1857, Salina, New York.
