Ellis At a Surrogate Court held in and for the County of Onondaga at the Surrogate's office in the city of Syracuse on the 14th day of April one thousand eight hundred and fifty-six Present Amasa H. Jerome Surrogate In the matter of proving the } last Will and Testament } of } Jonas P. Ellis deceased } Onondaga County fs. Be it remembered that heretofore upon the petition of Huldah Ellis Executrix named in the last Will and Testament of Jonas P. Ellis late of the city of Syracuse said County deceased for that purpose to the Surrogate of said County a citation was duly issued in this matter which citation with the proofs of service thereof was thereafter duly returned to said Surrogate and which said petition and citation with the proofs of service thereof are now on file in the office of said Surrogate. And therefore the said last Will and Testament of the said deceased and the proofs thereof were produced and are as following: In the name of God Amen I Jonas P. Ellis of the city of Syracuse County of Onondaga State of New York being of sound mind and memory Blessed be Almighty God for the same do make and publish this my last Will and Testament. First, I give and bequeath to my beloved wife Huldah all my household goods and furniture beds and bedding of every name and nature and all my mechanicks tools of every name and kind also my one horse wagon and harness and all things of Personal property now in my barn in Washington street where I now reside to be my wife's forever. I also give my desk books and all small articles which I deem or call relicks to my wife Huldah. Second, I give and bequeath to my daughter Harriett H. my gold watch and my rifle. I also give her my Family Bible in remembrance of me after my wife's decease or is willing to let her have it. I further give to my daughter Harriett the use of all my estate real and personal as the case may be after the decease of my wife Huldah. I also order my Executors here after named to pay out of the use of my Estate one hundred dollars each year after Harriett is twenty-one years of age to the disease of my wife Huldah then Harriett is to have the income or use of all my estate and no more after paying out of the same the funeral expenses of my wife Huldah. Third, I give to my wife Huldah the use of all my Estate both real and personal so long as she lives without exceptions other than that my daughter Harriett is to have one hundred dollars each year after she becomes twenty-one years of age. I include in my Estate what my Father has recently given me in his Will the amount is eleven hundred dollars. I order my Executors to erect or cause to be erected a good substantial wrot iron fence around the whole of my lot in Rose Hill Cemetery grounds Syracuse where I am to be buried where my son James H. Ellis is now buried and I order my Executors to cause a tombstone to be erected at the head of my grave of station marble with my name and age inscribed in raised letters also a small foot stone with J. P. Ellis in sunk letters. Headstone to be 2 feet wide 4 ½ feet high 2 ½ inches thick the height is to be above the pedestal or block which is to be 3 feet by 18 inches 10 inches thick of sound Onondaga stone all to cost put up in a good substantial manner warranted to cost 40 forty dollars and I order one of the like to be put up at my son James H's grave to cost 30 thirty dollars. I order my Executors to erect or cause to be erected a good wrot iron fence around my lot in Rose Hill Cemetery the fence is to be made in three sections on three sides the front is to have a gate three feet wide at every section there is to be a post of iron 14¼ (?) inch square at every iron post there is to be a stone put in to the ground 10 inches square at the top 3 feet long the banister is to be of round iron ¾ inches in diameter 3 to the foot the posts of the fence there is to be a small ornament placed on each at top the whole fence will stand on 12 stones 3 feet long 10 inches square at top deprefsed 4 inches down all around the posts of the fence is to be incerted in the center of the top of the stones 3 inches leaded in the gate to be hung to swing each way with latch arranged so as it can be locked with padlock the top rail of the fence is to be 1½ wide by 3/8ths thick. The bottom rail is to be ¾ square with a band all round the whole fence of 2 or 2 ½ inches by ¼ th inch thick well fastened on all to be done in a first rate workmanlike manner. Fourth, I authorize and empower my Executors to sell and convey all of my real Estate when they see fit to sell the same or at least within twenty years from or after my decease or death the interest arising from the sale my wife is to have or my daughter Harriett as the case may be yearly or half yearly according to the condition of sale of said real estate. I order my Executors to give good & sufficient deed or deeds to the purchaser or purchasers of the said real Estate. Fifth, I give and bequeath all my Estate both real and personal as the case may be to the heirs of my daughter Harriett H. provided always that they arrive at the age of twenty-one years but they are not to have any interest in the above estate till their mother's decease or death as much as to say the said heirs is not to have any interest in the above Estate while their mother lives. In case my daughter Harriett H. has no lawful heirs then I give my whole Estate both real and personal as the case may be One half to the Orphan Asylum of Syracuse the remaining half I give to the State of New York for free schools. I give only the use of all my Estate to the foregoing institutions forever. Lastly, I do hereby nominate and appoint my wife Huldah Executrix and my friend Nelson Caswell Executor of Manlius of this my last Will and Testament And hereby expressly revoke all and every former will by me made in witness whereof I have set my hand and seal this sixteenth day of June in the year of our Lord one thousand eight hundred and fifty-five Jonas P. Peck of the city of Syracuse in the County of Onondaga being duly sworn and examined doth depose and say that he this deponent was well acquainted with Jonas P. Ellis late of the city of Syracuse in the County of Onondaga deceased. That this deponent was present as a Witness and did see the said Jonas P. Ellis subscribe at the end thereof the instrument now produced and shown to this deponent purporting to be the last Will and Testament of the said deceased bearing date the sixteenth day of June in the year of Our Lord one thousand eight hundred and fifty-five. That the said testator at the same time declared the instrument as subscribed by him to be his last Will and Testament. That thereupon this deponent and William R. Strong subscribed their names at the end thereof as witnesses thereto at the request of the testator in his presence: and that the said testator at the time of executing and publishing the said last Will and Testament was of full age and of sound mind and memory not under restraint and was in all respects competent to make a last Will and Testament. Ellis deceased Onondaga County fs William R. Strong of the city of Syracuse in the County of Onondaga, being duly sworn and examined doth depose and say that he this deponent was well acquainted with Jonas P. Ellis late of the city of Syracuse in the County of Onondaga deceased. That this deponent was present as a witness and did see the said Jonas P.
