Jerome, Surrogate In the matter of proving the Last Will and Testament of William McLeish, deceased Onondaga County. Lo, Be it remembered that heretofore upon the petition of Elizabeth McLeish, Executor named in thee Last Will and Testament of William McLeish, late of the town of Cicero in said County, deceased. For that purpose to the Surrogate of said County a citation was duly issued in this matter which citation with the proofs of service thereof was thereafter duly returned to said Surrogate and which said Petition & citation with the proofs of service thereof are now on file in the Office of said Surrogate- and therefore the said Last Will and Testeament of the said deceased and the proofs thereof were produced and as follows viz. I, William McLeish, of Cicero, County of Onondaga & State of New York, being of sound and disposing mind, memory, understanding, thanks to Almighty God for the same for all the many mercies with which he has followed me all my life long until now do make, publish and declare this to be paid by my Executors hereafter named. The residence of my Estate and property I give, devise & dispose thereof as follows to wit. I give & bequeath to my only son William that farm in the township of Cicero on which we now reside together with all the livestock on said farm, farming [?], other tools and everything else on or belonging to the farm, likewise three hundred dollars to enable him comfortably to carry on the same without getting in debt, to be paid within six months after my decease and I likewise will that my above son will provide a good sufficient home with board free and everything nice pray for his mother my beloved Wife so long as she remains my Widow. I give & bequeath to my daughter Isabella, wife of H.H. Merriam the sum of two thousand dollars over and above what she has already had, within one year after my decease in money or securities as may be convenient. I give & bequeath to my brother John now living Cuyahoga Falls the sum of five hundred dollars ($500) to be paid in one year after my decease. I give & bequeath to my sister Helen now living in Dundee Scotland the sum of three hundred dollars ($300) but if she comes out to this Country the above bequest to be null and void otherwise the money to be paid in 18 months after my decease. I give devise & bequeath all the rest & residue of my Estate, Real, Personal & mixed of which I shall be seized or possessed or to which I shall be Entitled at the time of my decease together with all the household furniture to my beloved Wife Elizabeth and I do nominate appoint my said Wife Elizabeth & my son William to be Executors of this my Last Will and Testament. In testimony whereof I thee said William McLeish have here subscribed my name & affixed my seal this seventeenth day of April A.D. 1857. Merriam, Witness Onondaga Surrogate Court. In the matter of proving the Last Will and Testament of William McLeish, deceased Onondaga County. Lo, Henry H. Merriam of the town of Cicero in the County of Onondaga being duly sworn and examined doth depose and say that he this deponent was well acquainted with William McLeish, late of the town of Cicero in the County of Onondaga, deceased. That this deponent was present as a witness and did see the said William McLeish subscribe at the end thereof the instrument now produced and shown to this deponent purporting to be the Last Will and Testament of the said deceased bearing date the 17th day of April in the year of our Lord one thousand Eight hundred & fifty seven. That the said testator at the same time declared the instrument so subscribed by him to be his Last Will and Testament. That therefore this deponent and Seymour Skiff subsribed their names at the End thereof as Witness thereto at the request of the testator in his presence and that the said testator at the time of Executing and publishing the said Last Will and Testament was of full age & of sound mind and memory, not under restraint and was in all respects competent to make a Last Will and Testament. Henry H. Merriam Subcribed & sworn the 9th day of September 1858, before me A. H. Jerome, Surrogate Onondaga Surrogate Court. In the matter of proving the Last Will and Testament of William McLeish, deceased Onondaga County. Lo, Seymour Skiff of the town of Cicero in the County of Onondaga being duly sworn and examined doth depose and say that he this deponent was well acquainted with William McLeish, late of the town of Cicero in the County of Onondaga, deceased. Seymour Skiff Subscribed & sworn this 9th day of September 1858, before me A.H. Jerome, Surrogate Onondaga County Surrogate Office So, Recorded the preceding Last Will and Testament of William McLeish, deceased as a Will of Real and Personal Estate together with the proofs thereof taken and had in the Court of the Surrogate of the County of Onondaga, which Record is hereby signed and certified by me pursuant to the provisions of the Revised Statutes this 9th day of September, A.D. 1858 A.H.
