Be it remembered that heretofore upon the petition of Francis Antes one of the Executors named in the Last Will and Testament of Catherine Antes late of the town of Clay in said county, deceased, for that purpose to the Surrogate of said County a citation was duly issued which citation with the proofs of service thereof, was thereafter duly returned to said Surrogate and which said petition and citation with the proofs of service thereof, are now on file in the office of said Surrogate, and therefore the Last Will and Testament of the said Catherine Antes deceased, with the proofs thereof, were produced and are as follows to wit:-- The Last Will and Testament of Catherine Antes being mindful of my mortality and being of sound mind and memory, (blessed be almighty God for the same) do this eighteenth day of September in the year of our Lord one thousand eight hundred and fifty two make and publish this my last will and testament, in manner and form following First, I resign my soul unto the hands of almighty God, hoping and believing in a remission of my sins, by the merits and mediation of Jesus Christ; my body I commit to the earth to be decently buried at the discretion of my executors hereinafter named, and my worldly estate I give and devise as follows: First, I give and bequeath to my beloved brother Francis Antes one good bedstead, bed and bedding, throughout and all the rest and residue of my personal estate whatsoever and wheresoever, of what nature kind and quality soever the same may be. (after the payment of my debts, legacies, personal expenses, tombstone and the ample compensation of my executors for the execution of this my will.) I do give and bequeath to my beloved sister Dorothy Ann her heirs and assigns forever. Finally I do hereby constitute and appoint my brother Francis Antes and William Ottman of Clay and Evert Antes of Cicero, executors of this my last Will and Testament, in witness whereof I have hereunto set my hand and seal the day and year first above written. her Catherine + Antes L.S. Mark Signed, sealed, published and declared by the said Testor as and for her last will and testament, in our presence, who at her request, in her presence and in the presence of each other have subscribed our names as witnesses thereto. Sarah M. Antes Francis Antes Wm. Ottman Surrogates Court -- County of Onondaga In the matter of proving the} Last Will and Testament } Of } Catherine Antes deceased } Onondaga County Js. Francis Antes of the Town of Clay in the County of Onondaga being duly sworn and examined doth depose and say that he, this deponent, was well acquainted with Catherine Antes, late of the Town of Clay in the County of Onondaga deceased. That this deponent was present as a witness and did see the said Catherine Antes subscribe at the end thereof, the instrument now produced and shown to the deponent, purporting to be the Last Will and Testament of the said deceased, bearing date the eighteenth day of September in the year of our Lord one thousand eight hundred and fifty two. That the said Testatrix, at the same time, declared the instrument so substantiated by her to be her Last Will and Testament. That therefore this deponent and Sarah M. Antes and William Ottman in the presence of each other, subscribed their names at the end thereof, as witnesses thereto, at the request of the Testatrix, in her presence, and that the said Testatrix, at the time of executing and publishing the said Last Will and Testament, was of full eye, of sound mind and memory, not under restraint & was in all respects competent to make a Last Will and Testament. State of New York} Js: Onondaga County} Surrogate Court In the matter of proving the} Last Will and Testament } Of } Katherine Antes deceased } Onondaga County Js. Peter V. Antes of Clay in the County of Onondaga, being duly sworn says that he is the husband of Sarah M. Antes late of Clay deceased. That he has often seen her write and is well acquainted with her writing. That the signiture to the attestation clause to the instrument was produced and shown to him, purporting to be the Last Will and Testament of Catherine Antes, late of Clay deceased and bearing date the eighteenth day of September 1852, is the signiture of the said Sarah M. Antes written by herself. That he was acquainted with William Ottman, and has seen his writing. That he should call the body of said instrument his handwriting, and the signiture to the attestation clause also his. Sworn and subscribed before me} this 1st day of December 1864. } Peter V. Antes Oscar S. Sprague Surrogate. Surrogates Court -- County of Onondaga In the matter of proving the} Last Will and Testament } Of } Catherine Antes deceased } Onondaga County Js. Henry Sommer (or Somner?) of Clay in the County of Onondaga, being duly sworn and examined deposes and says, that he is well acquainted with William Ottman, who is a clergyman and has often seen him write, and knows well his handwriting. That the body of the instrument now produced and shown to him, bearing date the eighteenth day of September 1852, purporting to be the Last Will and Testament of Catherine Antes, late of Clay in the County of Onondaga deceased, is in his handwriting. That the name of Catherine Antes is also in his handwriting, except the mark. That the signiture to the attestation clause purporting to be the name and signiture of the said William Ottman, is his name written by himself in his own handwriting. That the last deponent heard of him he was at some place in the north east part of this State, located as a preacher. Recorded the preceding Last Will and Testament of Catherine Antes deceased, as a will of real and personal estate together with the proofs taken in the court of the surrogate of the County of Onondaga, relating to the said Last Will and Testament, which record is hereby signed and certified by me, pursuant to the revised statues, this 1st day of December 1864 one thousand eight hundred and sixty four. D. C. Greenfield Surrogate Additional Comments: She and her brothers are children of Johannes, son of Fraz Antes or Antis and Margaret Magdalene Sommers, all originally of Schoharie County.
