Present Oscar L. Sprague Surrogate In the matter of proving the Last Will and Testament of Stephen Pomeroy Deceased Onondaga County ss. Be it remembered that heretofore upon the petition of Samuel S. Pomeroy the executor named in the last Will and Testament of Stephen Pomeroy late of the town of Otisco in said County of Onondaga deceased for that purpose to the Surrogate of said County a citation was duly issued in this matter which the citations with the proofs of service thereof was thereafter duly returned to said Surrogate and which said petition and citation with the proofs of service thereof are now on file in the Office of said Surrogate and therefore the last Will and Testament of the said Stephen Pomeroy deceased with the proofs thereof were produced and are as follows to wit. In the name of God Amen. I Stephen Pomeroy of the town of Otisco County of Onondaga being of sound mind and memory and understanding blessed be God for the same do make and publish this my Last Will and Testament in manner and form following Item First I order and direct that all my past debts and funeral expenses be paid out of my personal Estate Item Second I hereby give and bequeath unto my daughter Fanny wife of Harvey Wilson the sum of Five Hundred Dollars. Item Third I hereby give and bequeath unto my daughter Claria A. Wife of James A. Pol___ the sum of Five Hundred Dollars. Item Fourth I hereby give and bequeath unto my four sons Lemuel S. Pomeroy James C. Pomeroy Theodore C. Pomeroy & Stephen D. Pomeroy and unto my two daughter Fanny and Clarra A. the residue of my personal property (after paying the Legacies mentioned in Items Second and third) to be divided equally between them each to have & share _____ _____ I hereby direct my executors to pay the Legacies to Fanny & Clarra A. within one year after my decease and the said several Legacies may be paid from any moneys that may be on hand or in any bonds or mortgages or notes that may exist and belonging to me at my decease are collectable. Item Sixth I hereby appoint my son Lemuel S. Pomeroy executor of this my last will and testament hereby perishing all former wills by me at any time heretofore made. Surr C_____ /Dollar/ Surrogates Court County of Onondaga In the matter of proving the last Will and Testament Of Stephen Pomeroy Deseased Onondaga County fs. _____ Clark of the town of Otisco in the County of Onondaga being duly sworn and examined doth _____ and say that he this deponent was well acquainted with Stephen Pomeroy late of the town of Otisco in the County of Onondaga deceased that this deponent was present as a witness and did see the said Stephen Pomeroy subscribe at the _____ thereof the instrument now produced and shown to this deponent purporting to be the last Will and Testament of the said deceased bearing date the fifth day of January in the year of our Lord one thousand eight hundred and fifty three that the said testator at the same time declared the instrument so subscribed by him to be his last Will and Testament that thereupon this deponent and William B. Partridge in the presence of each other subscribed their names at the end thereof as witnesses thereto at the request of the testator at the time of executing and publishing the said last Will and Testament was of full age of sound mind and memory not under restraint and in all respects competent to make a last Will and Testament Philetus Clark Subscribed and Sworn this 14th day of March 1864 before me Oscar L. Partridge of the town of Otisco in the County of Onondaga being duly sworn and examined doth depose and say that he this deponent was well acquainted with Stephen Pomeroy late of the town of Otisco in the County of Onondaga deceased that this deponent was present as a witness and did see the said Stephen Pomeroy subscribe at the end thereof the instrument and produced and shown to the deponent purporting to be the last Will and Testament of the said deceased bearing date the fifth day of January in the year of our Lord one thousand eight hundred and fifty three that the said testator at the same time declared the instrument so subscribed by him to be his last Will and Testament that thereupon this deponent and Philetus Clark in the presence of each other subscribed their names at the end thereof as witnesses thereto at the request of the testator in his presence and that the said testator at the time of executing and publishing the said last Will and testament was of full age of sound mind and memory not under restraint and was in all respects competent to make a last Will and Testament.
