Present Henry Reigal, County Judge and Act'g Surrogate. Onondaga County, Be it remembered that heretofore upon the petition of Nancy Smith the executrix named in the last will and testiment of Jarat Smith late of the town of Skaneateles in said county, deceased, for that purpose to the Surrogate of said county; a citation was duly issued in this matter which citation with the proofs of service thereof are now on file in the office of said Surrogate and thereupon the last will and testiment of said Jarat Smith deceased with proofs thereof were produced and are as follows to wit: In the name of God, Amen. I Jarrat Smith of the town of Skaneateles and County of Onondaga & State of New York do hereby make and publish and declare my last will and testiment. First, I do hereby order my executrix hereinafter named to pay all my funeral expenses and just debts as soon after my decease as conveniently may be done. Second, I give and devise unto my beloved wife Nancy all my personal property during her natural life for her sole use as she may think proper. Third, after the decease of my said wife Nancy, I give & devise unto my children who then living the rest and residue of my estate both real and personal, said children now consisting of my son William now in California, Samuel Smith now a resident of in Oswego County, Elizabeth Day, and Eliza Cooly (sp?) except out of my said Estate shall first be paid to my Grandson William Smith now a resident of Rochester, N.Y. one hundred dollars, and the rest and residue to be divided equally among said children as aforesaid except the sum of four hundred and thirty-four dollars shall be deducted from Samuel's share, that being an amount he has received more than the other children. Fourth, I do order & direct my executrix to pay my said sons William & Samuel one hundred dollars and then divide the remainder among each of my said children to share & share alike. Fifthly, if any of my children aforementioned should not be living I do order & direct that the amount which each child is entitled to to be distributed to their children so that the decendants may receive the share the parent would have been entitled to if living. Sixthly, I do hereby nominate and appoint my dearly beloved wife Nancy Smith executrix of this my last will & testiment, revoking all and every former will by me made. I do also give & devise unto my said executrix Nancy Smith all my real and personal property giving her full power to sell, grant, or convey any and all of my real estate according to her own discretion.
