Cobb of the town of Palmyra in the County of Ontario and State of New York and Ann his wife of the first part, and Henry Turner of the City and County of Albany and State aforesaid of the second part Witnesseth that the said parties of the first part for and in consideration of the sum of four hundred and fifty Dollars to them in hand paid the receipt whereof is hereby confessed and acknowledged and in consideration of the covenants and conditions herein after contained on the part of the said party of the second part of heirs executors administrators and assigns to be kept and performed have di_________ leased and to farm lot and by the privileges of Water to wit, beginning two feet north of the side of a building built for a Carding Machine now occupied by one Enoch M. Hibbard to extend down the said river or north forty eight feet and to extend east of the said River from highwater mark, not more than fifty feet, to be appropriated particularly for the erecting and carrying on of cloathing and fulling works and so much of the water from the said river to be taken out of a saw-mill dam which now stands near said Carding machine and to be carried under the said Saw Mill but in such manner as not to injure the said Saw Mill as shall be amply sufficient to supply said works provided there should be water sufficient to carry and support said saw Mill, Carding Machine and Fulling Mill and if not sufficient then the said party of the second part is only to have his equal proportion of said Water and also immediately opposite the said ground and privilege here described eastwardly on what is called the bank leaving between twenty and thirty feet shall way, and to begin so as not to interfere upon a burial in contemplation to be out through said spaceway near said works one other piece or parcel of land , to wit one hundred and fifty feet up and down said River, north and south to extend east and west so far as to give ground sufficient for a dry house and three rows of tenter bars for the use of said Cloathing and fulling works. To have and to hold the said pieces or parcels of land with all and singular the privileges and appurtenances unto the said party of the second part his heirs executors administrators and assigns forever and the said party of the second for himself, his heirs executors administrators an assigns covenants and agrees with the said parties of the first part to bear his equal proportion in keeping in repair the said Saw Mill dam, to be calculated in proportion with the quantity of Water he shall draw from the said dam, with the said Saw Mill and Carding Machine, which said repairs shall be calculated and for no other purpose than to supply the said three works with water and the said party of the second part for himself his heirs executors administrators and assigns covenants and agrees to and with the said parities of the first part that he will well and truly pay all reasonable taxes that may be hereafter bestowed on said premises wither by the laws of the United States or of this State and will pay all damages that may accrue to the said parties of the first part by non payment of such taxes or any part thereof and the said parties of the first part for themselves their heirs executors administrators and assigns do hereby covenant and agree to and with the said party of the second part his heirs executors administrators
