CLARK Deceased ONTARIO COUNTY, ss.: Muriel B. Clark being duly sworn, deposes and says: That she resides at No. 219 High Street, Geneva, Ontario County, New York and was well acquainted with Arthur W. Clark late of the City of Geneva in said County, deceased, and with his property and business affairs. That the decedent was at the time of his death, a legal resident of the County of Ontario, and State of New York, and departed this life on or about the 25th. day of October, 1950, leaving a last will and testament, which was thereafter duly admitted to probate by a decree of this Court, on the 1st. day of November, 1950; that thereafter letters testamentary were duly granted by this Court to deponent, Muriel B. Clark who thereupon duly qualified, and entered upon the discharge of her duties as such Executor and now and ever since has acted as such. That said decedent made no disposition of any property by deed, grant, bargain sale or gift, in contemplation of death, or intended to take effect in possession or enjoyment after death and had not been given powers of disposition of property by the will of another, or exercised any power of appointment by will or otherwise. That said decedent owned no personal property without the State of New York at the time of his death. That an inventory was taken of the personal estate, and contains a true statement of all the personal property of which the decedent died seized and possessed and the same was filed with this Court November 22nd., 1950, and was the aggregate market value of $7,002.10. That except for one buick (sic) automobile, owned by the decedent, the above sum of $7,002.10 consisted of bank accounts and one promissory note of $1,000.00 owned jointly by deponent and Decedent. That at the time of his death the deceased was the owner of the following real property situate within the State of New York, of the reasonable market value as set opposite each parcel thereof. House and Lot situate at No. 219 High Street, in the City of Geneva, New Yory (sic) of the reasonable market value of $7,000.00 which deponent and decedent owned as tenants by the entirety (Assessed at $4,000.00) That the aggregate value of real and personal estate is the sum of $14,002.10 That deponent has paid out for debts, funeral expenses and administration the following: Funeral Expenses $732.90 Administration Expenses 55.00 Debts 77.54 Total $865.44 That the following are the names of the persons interested and entitled to a distributive share in said decedent's estate: NAME RELATIONSHIP AGE INTEREST Muriel B. Bennett Brown, attorney for the State Tax Commission, having examined into the facts and circumstances set forth in the foregoing affidavit and being satisfied the property passing in the above estate is not subject to the payment of transfer tax hereby consent to the making of and entry of an order exempting said estate from the payment of transfer tax, subject to the right of the State Tax Commission to appeal from such order.
