Between Archibald Smith of the town of Elmira, in the County of Tioga, and State of New York and Guy Smith of the town of Tully In the County of Tioga Onondaga and State afore said, Executors, of the last Will and Testament of Hophni Smith, deceased, parties of the first part and James S. Galloway of the Town of Monroe, In the County of Orange, and State of afore said, party of the Second part Witnesseth, whereas, the said Hophni Smith deceased did in and by his Last Will and Testament dully made and published and bearing date the tenth day of September in the year One Thousand Eight Hundred and Twenty One duly authorize and empower, order and direct, his Executors therein named, and thereby constituted and appointed to sell, all his real estate, whereof he should die seized, which said power and authority will move fully, and at large at appear reference being had to the said Will of the said Hophni Smith deceased duly of Record in the Office of the Surrogate of the County of Orange afore said, at his office in the Village of Goshen And whereas, the said Hophni Smith deceased did in and by the Said Last Will and Testament afore said, constitute and appoint the above named parties of the first part Executors of his said Last Will and Testament. And whereas, the said parties of the first part have in persuance of the above recited power contained in the said Last will and Testament after giving due and legal notice of The Time and Place of Such Sale and complying in other respects to the requirements of the divised Statues of this State in such case made in [--------?------] unto The said party of the second part the Lot piece or parcel of land and premises hereinafter contained and described for the sum of Twelve Hundred and Fifty Four dollars. That being, the highest sum bid for the same and not disproportionate to the value of the same premises Now this Indenture Further Witnesseth, that the said parties of the first part in consideration of the premises and especially in consideration of the said sum of Twelve Hundred and Fifty Four Dollars lawful money of the State of New York, the receipt whereof they do hereby acknowledge and by virtue of the above recited power and of the Statue in such case made and provided. Have granted bargained and sold enfeaffed conveyed and confirmed and by these present do grant, bargain and sell enfeaff conveyed and confirm unto the said James S. Galloway party of the second part and to his heirs and assigns forever All that Tract, Lot, piece or parcel of land situate lying and being in Smith's Clove, in the County of Orange in the patent of Cheescocks and which in the subdivision of the said patent as formerly made by Col Charley Clinton in the marble covered field book of the said patent is described as follows to wit: Lot No I Beginning at a stake standing in the Northwest, line of the Evans Patent upon a bushy high ridge, where a large Black Oak standing about Fifty Links South of the said stake is marked with Three notches on Four sides and A and No 1 on the South side ( the said stake stands about Eighteen chains, Northwest, from the Red Oak tree where An Hazards First Tract begins) thence from the said stake Southwest Thirty chains, along a line of trees marked with Three notches on Two sides, to a small White Oak marked with Three notches on Four sides, and B [ looks like a double B or a B super imposed on top of one B] on the Southwest side and No III then Southeast along a line of Trees marked marked (repeated word) with Two notches on Two sides ( at 20 Chains, came to a bushy plain, without timber, at Forty Two chains a path -The road from Goshen to Haverstraw) Fifty chains to a stake set up in said bushy plain, then Northeast along a line of trees marked with Two notches on Two sides, at Sixteen chains parted from the bushy plain, and come to timbers, at Twenty Four chains, cross the road that leads from Haverstraw to An? Hazards at Thirty chains set up a the stake in the Northwest line of Evans Patent, and mark on the stake and a small Maple; standing in the Northwest side of the Pine Swamp, with three notches on four sides, and No.II and then Northwest along the line of Captain John Evans patent Fifty chains to the place of beginning. Containing one hundred and fifty acres. Together with all and singular the edifices, buildings improvements ways water courses, easements, advantages, profits, rights [------?-------] to the said lot, tract, piece or parcel of land and premises being ? or anywise appertaining and the reversion and reversions, remainder and remainders, rents, fees and profits thereof and being part and parcel thereof with the appurtenances and all the estate lot? title interest, property possession claim or demand whatsoever in Law or equity of the said Hophni Smith deceased of in and to said premises with the appurtenances in his life time, and at the time of his death and also of the said parties of the first part Executors as afore said in virtue of the provisions of the said Last Will and Testament or otherwise To have and to hold, the said lot tract, piece or parcel of land & premises with the appurtenances unto the said party of the second part, his heirs and assigns forever, to their only proper use benefit and behoof forever, of the said party of the second part, his heirs and assign Forever In Witness Whereof, the parties to these presents have hereunto set their hands and seals, the day and year first above written.
