ORANGE COUNTY, WILLS, VOL 0033-0034, 1868- 1873. (pp. 241, 242 & 243) Surrogate’s Court. Be it Remembered that heretofore to wish on the (?first) day of November in the year one thousand eight hundred and seventy. Daniel Carpenter a person interested in the last will and Testament of Daniel Carpenter late of the town of Goshen in the County of Orange Deceased appeared in open Court before Gilbert O Hulse the Surrogate of the County of Orange and made of plication to have the said Last Will and Testament which relates to both Real and Personal Estate proved: and on such application the Surrogate did ascertain by satisfactory evidence who were the only heirs and next of kin of said deceased and their respective places of residence & said Surrogated did they upon afore as Citation directed to said only heirs and next of kin by their respective names stating their places of residence, requiring them to appear before said Surrogate at his office in the Village of Goshen in said County on the sixth day of December then next to attend the probate of said Will: And afterwards to wit on the said sixth day of December satisfactory evidence by affidavit was adduced and presented to said Surrogate of the service of the said levitation in the mode prescribed by law, and non of them appearing to be minors & on that day no one appearing to appose the probate of the said Will such proceedings (?avene) therefore had afterwards that said Surrogate took the proofs and said Will hereinafter set forth and upon this said sixth day of December A.D. 1870, he adjudged said Will to be a Valid Will of Real and Personal Estate. and the proofs thereof to be sufficient; which said last Will and Testament and proofs are as follows: That is to say: —-———- In the name of God Amen. I Daniel Carpenter of the Town of Goshen in the County of Orange and the state of New York of the age of eighty three years and being of sound mind and memory do make public and declares this my last Will and Testament in manner following that is to day. FIRST I will and direct that all my just and legal debts & funeral charges be paid by my Executors hereinafter named. SECOND I give and beauty to the heirs of my deceased son Robert Carpenter the sum of three hundred dollars to be divided equally amongst them share and share alike to be paid to them when they respectively arrive to the age of twenty one years. THIRD I give and bequeath to my daughter Susan Carpenter the sum of one hundred and fifty dollars. FOURTH I give and bequeath to my daughter Mary Carpenter the sum of one hundred and twenty five dollars. FIFTH I give and bequeath to my daughter Harriet Carpenter the sum of one hundred dollars. SIXTH I give and bequeath to my daughter-in-law Nancy the widow of my deceased son John S. Carpenter her heirs and assignee all my right title and interest to all that certain lot of land with the buildings thereon erected situated (?being) and being in the town of Goshen aforesaid and adjoining the garden and premises I now own and occupy being the same premises formerly owned and occupied by my said John S. Carpenter. (next page-242) SEVENTH I give devise and bequeath all the rest Residue and Remainder of my estate and affects Real and Personal not heron otherwise disposed of (after payment of my debts legalies and funeral charges) to my five daughters viz: Susan Carpenter, Mary Carpenter, Elenor Topper, Harriet Carpenter and Sarah Conckling equally to be divided between them share and share alike and my further will is that whenever or majority of my daughters shall believe it will be to their advantage to all the Real Estate herein devised to them I the order the same to be sold at public on private sale. LASTLY I do hereby nominate my son in law Charles S. Topper and my daughter Susan Carpenter Executor and Executrix of this my last Will and Testament hereby revoking all and any forever Wills and Will by me made. In Witness whereof I have hereunto set my had and seal this fifteenth day of August in the year of our Lord one thousand eight hundred and fifty-six. Daniel Carpenter (L.S.) The above instrument consisting of one sheet was at the date thereof signed sealed published and recalled by the said Daniel Carpenter as and for his last Will and Testament in presence of who at his request have subsided our names as witnesses thereto. Orange County Surrogates Court ========================== In the matter of proving the | last Will and Testament | of | Daniel Carpenter deceased as a | State of New York Will of real and Personal Estate | Orange County ===========================|=================== Benjamin Strong of the town of Goshen in the County of Orange having on this sixth day of December in the year one thousand eight hundred and seventy personally appeared before Gilbert O. Hulse the Surrogate of the County of Orange and being by the said Surrogate duly sworn and examined deponents and says and each says that he was well acquainted with Daniel Carpenter late of town of Goshen in said County of Orange deceased that he was present as witness and did see the said Daniel Carpenter now deceased by writing his name subscribe at the ed thereof the instrumenting now produces and shows to deponent purporting to be the last Will and Testament of the said (next page-243) Daniel Carpenter deceased bearing date the 15 day of August the year one thousand eight hundred and fifty six. that such subscribtion (sic) was made by the said Daniel Carpenter now deceased in the presence of this deponent the attesting witness to said Daniel Carpenter’s Will that the said Daniel Carpenter at the same time deceased to said witnesses the instrument so subscribed by him to be his Last Will and Testament whereupon the deponent signed his name at the end of the said Will at the request of the said tester now deceased and that the said Daniel Carpenter at the time of executing and publishing his the said last Will and Testament was of full age of sound mind and memory and not under any restraint and was a citizen of the United States. And deponent further says that John A. Carpenter the other subscribing witness to said Last Will and Testament has departed this life and that at the execution of said Will by said deceased said deceased declared the same to be his last Will and Testament in presence of said John A. and deponent and that deponent (?) said Carpenter sign said Will as subscribing witness and that said Will was written by said John A. Carpenter and was subscribed by said Testators in the presence of said John A. Carpenter and deponent. Sworn examined and Subscribed before me } B. Strong this sixth day of Dec. 1870. } Gilbert O. Hulse Surrogate. Orange County ss Daniel Carpenter being duly sworn says that he knew Daniel Carpenter, deceased in his lifetime testator mentioned in the will herein and also John a. Carpenter subscribing witness to said Will who is also deceased that he is well acquainted with the hand writing of said tester and said subscribing witness and that the signatures of said persons as appears upon said Will are correct and genuine, the said Daniel Carpenter as testator and the said John A as subscribing witness and in their hand writing respectfully.
