Champion Esq their proctor; A. C. Coleman Esq Appearing for a James H. Carpenter & Sarah T. Gerson? & Sarah C Jacobus also appearing, all in support of the proofs of said will & no other parties or persons appearing herein. Petition filed on 1st day of Nov. 1870 Citation returnee the 6th day of Dec. 1870 per Daniel Carpenter. Filed by B. R. Champion, Esq. . . . Petition further shows, that the only heirs, and next of kin of said deceased, are as follows, residences do Mary Carpenter, Daughter, Goshen, NY Harriet E. Carpenter, daughter, Goshen, NY Daniel Carpenter, Your petitioner, Grandson, Goshen, NY Eleanor Tapper, daughter, Chicago ILL Sarah Conkling, daughter, Tecumseh, Mich Sarah C. Jacobus, granddaughter, Fairview, NY James H. Carpenter, grandson, New York City Sarah T. Geson, granddaughter, Brooklyn, NY George B. Carpenter, grandson, Chicago, Il That the said heirs and next of kin are all of full age that your petitioner claims an interest in and under said will as a legate a certain interest in real estate being therein devised wherein. That the estate and effects for or in respect of which the Probate of said will is applied for, do not exceed invalid the sum of nine thousand and five hundred dollars. Your Petitioner therefore prays, that the said Last Will and Testament may be proved and Letters Testamentary granted thereon according to Law, Daniel Carpenter (Image 297) in presence of said John A. and deponent and this deponent (?) said Carpenter sign said will as subscribing witnesses and that said will was written by said John A. Carpenter and was subscribed by said testator in the presence of said John A. Carpenter and deponent. (signed) B. Strong Sworn as around & subscribed before me this sixth day of Dec. 1870—Gilbert O. Hulse Orange County SS. Daniel Carpenter being dully sworn says that he knew Daniel Carpenter, Deceased in his life time, tester mentioned in the will Heirs and also John A. Carpenter subscribing witness & said will who is also deceased. That he is well acquainted with the handwriting of said tester and said subscribing witnesses as appears when said will are correct and genuine, the said Daniel Carpenter as tester and the said John A. as subscribing witness and are in there handwriting respectfully. } Sworn examined & subscribed before me.
