Presents John B. Booth, Surrogate- - - It appearing to this Court that William Henry Houston, Nathaniel D. Houston, James Houston & John W. Houston are the children & Heirs at law of John Houston late of the Town of Warwick in said county deceased and that they are respectively infants under the age of twenty one years: on reading & filing the consent of Henry W Houston of the Town of Warwick aforesaid; It is ordered that the said Henry W Houston be and he is hereby appointed Guardian for the said infants for the sole purpose of appearing for and taking care of their Interest in the proceedings to be had in proving the last will & testament of said John Houston Deceased as a will of Real Estate - - - Orange Surrogate Court In the matter of proving the last will and testament of John Houston deceased as a will of Real Estate. To Julia Ann Houston the widow & Henry W. Houston official Guardians of William Henry Houston, Nathaniel D. Houston, James Houston & John W. Houston Infants & the next of kin and heirs at Law of the said deceased. You and each of you will please to take notice that I intend to apply to the Surrogate of the County of Orange at his office in Goshen in said County on the thirteenth day of November next at ten oclock in the forenoon of that day for the purpose of hearing the last will and testament of John W Houston late of the town of Warwick in said County deceased proved and recorded as a will of Reaal Estate Dated the twenty ninth day of October one thousand and eight hundred and thirty two. Booth Surrogate: I John Houston of Warwick Orange County New York do publish this my last will and testament this twenty sixty day of September in the year of our Lord one thousand and eight hundred and thirty two. First I give unto my beloved wife Julia Ann Houston and my son William H Houston all necessary cuticels for housekeeping. Such as beds and Bedding Carpets Tables Chairs and kitchen furniture proper for House Keeping also three Horses. One two horse waggon, one chair and harness belonging thereto. Also eight cows, one bull and a cow for Beef and as many Hogs as will be necessary for them and further to have the House and the land where I now live and the Lot near James Nan Houstons to farm it on and further to have two ploughs, one Harrow, and to have all the fodder and straw on the said premises and to have four Heiffers, Which said above mentioned articles I give and Bequeath unto them until the youngest son arrives to the full age of twenty one years. I give and bequeath unto my four sons as follows and to their Heirs and assigns forever: To William Henry Houston, Nathaniel W Houston, James Houston and John W Houston equally share and share alike of all the property I did seezed(?) after paying all my just debts. I order my Executors to sell all my Lands in the County of Tioga and a small Lot lying near Benjamin Browns on the south side of the Road leading from mount eve to Great Island containing about one acre. Also I wish my Executors to deed to the heirs of John Wisner deceased a lot of about Eleven acres at the time the decision is made between said heirs & Robert Armstrong and William Carr Juns on the said heirs paying the principal and Interest on what I paid for said Lot. I wish my Executors to rent out my other lands not mentioned. I hereby appoint my Executors Guardians for my four children and wish them to see to my children Educated and properly brought up. I appoint George W Houston & Amoza(?) A. Jesup my Executors. In witness whereof the said Testator has hereunto put his and seal in our presence and in the presence of each other. State of New York, Orange County y. John Fox, James L Houston & Henry W Houston of the town of Warwick in said County being by the Surrogate of the County of Orange duly sworn and examined depose and say & each for himself says that he was well acquainted with John Houston late of the town of Warwick in said County deceased. That the deponent was present as a Witness and did see the said John Houston deceased Subscribe at the end thereof the instrument now produced and shown to the deponent purporting to be the last will and Testament of the said John Houston deceased bearing date the twenty sixth day of September in the year one thousand and eight hundred and thirty two: That such subscription was made by the said Testator in the preseance of these deponents subscribing witnesses to said will: That said Testator at the same time declared the instrument to subscribed by him to be his Last will and Testament whereupon these deponents signed their names at the end of the Will at the request of the said Testator and that the said Testator at the time of executing and publishing the said last will and Testament was of full age, sound mind and memory and under any restraint.
