At a surrogate court held at the surrogate office in Goshen in and for the county of Orange on the fifteenth day of December in the year of our Lord one thousand, eight hundred and thirty one. Booth, Surrogate It appearing to this court that Andrew D Savage _____, _____, _____, _____, _____, _____, infant___child___ and here at law of John Savage late of the town of Walkill in the County of Orange deceased and that the said Andrew D. Savage is an _____, _____ infant under the age of twenty one years. On reading and filing the consent of Daniel Bodle of the said town of Wallkill ordered that the said Daniel Bodle be and he is hereby appointed Special Guardian of the said Andrew D. Savage the infant child & the rest of Kin and heirs at law of the said deceased, You and each of you are please to take notice that I intent to apply to the surrogate of the county of Orange at his office in Goshen in said county on the second day of January next at ten o’clock in the forenoon of that day for the purpose of having the last will and testament of John Savage late of the town of Wallkill in said county deceased proved and recorded as a will of Real Estate. Yours H Joseph Slaughter – acting executor Orange County’s Asa Hasbrouck of the town of Wallkill in said county being duly sworn says that he did on the fifteenth day of December Instant saw on Maria Savage Daniel Bodle Special Guardian of Andrew D Savage and also on the same day on Jane the wife of Joseph Merrell a copy of the annexed notes that deponent did on the sixteenth day of December Instant serve Clarissa Savage, Mehitable Savage the widow of John Savage deceased and on Emily Dunning each with a copy of the annexed notes and shown them at the same time the original notes as aforesaid sworn this 2nd day of January 1832 before me John B. Booth – Surrogate. Asa Hasbrouck The last will and Testament of John Savage of the town of Wallkill, County of Orange, and State of New York. I, John Savage considering the uncertainty of this mortal life and being of sound mind and memory blessed by Almighty God for the same do make and publish this my last will and testament; in manner following that is to say, It is my wish that my executors herein after named and appointed shall as soon as convenient after my decease and after settling the gifts and bequeaths of personal property herein after mentioned sell and dispose of all the estate real and personal whereof I shall die seized; the two thirds of waits of which after debts and legacies satisfied and paid I give and bequeath to my son Andrew to be held in the hands of my executers to the proper use of said Andrew for schooling, clothing and boarding at the discretion of my executors until he arrive to the age of twenty one years. The law of the land having made provision for my widow, I make no other disposition of my estate in relation to her. To my daughter Jane, I give and bequeath five dollars; to my daughter Emily Five dollars, to my daughter Maria one good feather bed and bedding + one milk cow of her choosing. All the rest and residue of my estate, I give-bequeath to my daughter Clarissa and I do hereby nominate, constitute and appoint my friends and neighbors Asa Hasbrouck, Joseph Slaughter and Armstrong Wilson my executors to perform the offices of this my last will and testament; hereby revoking all former wills by me made in witness whereof I have hereto set my hand and affixed my seal the first day of May in the year one thousand eight hundred and twenty eight. John Savage [JS] Signed, sealed, published and declared by the above named John Savage to be his last will and testament in presence of us who have here subscribed our names as witnesses in the presence of the testator and of each other; Charles Lindsey, Daniel Bodle, Virgil Bodle; Orange Surrogate Court – In the matter of proving the last will and Testament of John Savage deceased as a will of real estate. Orange County’s Charles Lindsey of the town of Montgomery and Daniel Bodle of the town of Wallkill all of the county of Orange aforesaid being first duly sworn respectively by the surrogate of the county of Orange and by here examined they and each of them depose and say for himself that he was well acquainted with John Savage late of the town of Wallkill in said county deceased that he was present as a witness and did see the said John Savage deceased subscribe at the end thereof the instrument now produced and shown to these deponents purporting to be the last will and testament of the said deceased bearing date the first day of May in the year one thousand eight hundred and twenty eight, that they deponents respectively heard the said John Savage declare the said Instrument so as aforesaid subscribed by him to be his last will and testament and that they deponents respectively did subscribe their names at the end of the will as witnesses thereto at the request of the said John Savage and that at the time thereof the said John Savage was of full age of sound mind and memory and not under any restrewt. Sworn and examined this 2nd day of Charles Lindsey January 1832 before me. Daniel Bodle John B. Booth, Surrogate Orange Surrogate Court – In the matter of proving the last will and Testament of John Savage deceased as a will of real estate. Orange County’s Virgil Bodle of the town of Wallkill in said county being by the surrogate of said county duly sworn and examined says that he was well acquainted with the said John Savage late of the town of Wallkill in the county of Orange deceased. That he this deponent did hear the said John Savage declare and acknowledge that he subscribed the instrument now produced and shown to deponent purporting to be the last will and testament of the said deceased bearing date the first day of May in the year one thousand eight hundred and twenty eight as his last will and testament. That such acknowledgement was made by the said testator in the presence of this deponent and in the presence Charles Lindsey and Daniel Bodle who together with this deponent signed their names as witnesses at the end of said will at the request of said testator and that the said testator at the time of executing and publishing the said last will and testament was of full age of sound mind and memory and not under any restrewt.
