The submittor has given permission to the USGenWeb Archives to store the file permanently for free access. ************************************************************************ Will of Augustus Oakley  The last will and testament of Augustus Oakley of Minisink in the County of Orange and State of New York I Augustus Oakley considering the uncertainty of this mortal life and being of sound mind and memory (blessed be Almighty God for the same) do make and publish this my last will and testament in manner and forme following That is to say first I give and bequeath unto my well beloved wife Mary Oakley all her wareing apperl together with all the property she fetch to me to be maid as good as when she fetch hur goods to me together with the colt that the brown mare now suckles and one cow to be hur chois together with what property she has arned and fetch in my family item I give and bequeth unto my eldest daughter Martha Brundage fifteen dollars item I give and bequeth unto my second daughter the sum of seven dollars item I give and bequeth to my four daughters Elizabeth Christiein Claresey and Euzebe the sum of two hundred dollars each item I give and bequeth unto my sone William Oakley one waggon and harness one sled one plow and the dun mare and one two year old colt I further give unto my sone William Oakley the Lot of Land on which my dwelling house and barne stand containing fifty seven and a half acres of Land and a small Lot purchased of Jeremiah Holly containing five acres of Land during his natural life and then to the ares of his body if he has any if not to his four sisters or thare ares or assigns for ever to be equally divided between them to wit Sary Brink Elizabeth Oakley Christiein Oakley Clarisey Oakley Euzebe Oakley I further will and order that my executors shall as soon as they think best to sell all my goods and chattels and they are hereby instructed and authorized to sell all the other Lands that I owne and to give deeds of conveyances for the same that I have not before deposed of in this my last will and from such sales to pay my funele espences and lawfull debts and the legacys Item I give and bequeth to Charles Wood twenty dollars item I give and bequeth to Eleas B. Wood the sum of twenty dollars item I give and bequeath to Mary Wood one cow which said several legatees or sums of money I will and order to be paid to the said respective legatees as soon as the money can be conveniently collected etsepting to those under age and thares to be on draft for them as soon as can be collected from the sales till they arrive to the age of twenty one or till they mary and then to be paid over with the intrest to them and if thare should be a overplus money from the aforesaid sales then it is to be divided equal among my five youngest daughters to wit Sary Brink Elizabeth Oakley Christiein Oakley Euzebe Oakley and Claresy and lastely I hereby appoint Mary Oakely executrix Samuel Brink and John Jackson executors of this my last will and testament and I hereby * * the guardian ship of all my children untill they shall respectively attane to the age of eighteen years unto my said executors and do hereby declare that the expences of the maintenece and education of my said children until they shall attane the age aforesaid or till they shall become entitled to the sum or sums of money hereby provided for thare benefit shall be borne and paid out of the money that is given to them by this my last will and lastely my express will and meaning is now I do hereby order and appoint that if any differences dispute question or controvessy shall be moved arise or happen concerning any gift bequest make or thing in this my will given and bequeathed expresed or contained that then no suit or suits in Law or equity or other wise shall be brought commenced or prosecuted for and concerning the same but the same be referred wholly to the **anden meter** and determination of my friends William Stewart and Pheneas Terry both of the Town of Minisink aforesaid and what they shall order direct and determine therein shall be binding and conclusive to all and persons tharein concerned In witness whereof I have hereunto set my hand and seal this forteenth day of June in the year of our Lord one thousand eight hundred and nine Signed Sealed published and declared by the above named Augustus Oakley to be his last will and testament in the presence of us who have hereunto subscribed our names as witness in the presence of the testator William Stewart Paul Stark Jeremiah Holly                                                           Augustus Oakley                                                           By John Jackson by the exprest                                                           Direction of the testater
