To all whom These presents Shall come or may concern send Greeting. Know ye that at Goshen in the County of Orange on the twenty-ninth day of June in the year of our Lord one Thousand eight hundred and fifteen before Edward Ely, Esq. Surrogate of our said County. The last will and testament of Isaac Pinckney, deceased (a copy whereof is hereunto annexed) was proved and is now approved by us and the said deceased having whilst he lived and at the time of his death goods chattels or credits within this state by means whence the proving and registering the said will and the granting administration of all and singular, the said goods chattels and credits and also the auditing, allowing and final discharging the account thereof doth belong unto us. The administration of all and singular, the goods chattels and credits of the said deceased and anyway concerning his will is granted unto Henry Wisner and Jacobus Bertholf the executors in the said will named. They being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular, the said good chattels and credits and also to render a just and true account thereof when thereunto required, In testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed. Witness Edward Ely, Esq., Surrogate of the said County at Goshen the twenty-ninth day of June in the year of our Lord one thousand eight hundred and fifteen and of our independence the thirty-ninth. The will: In the name of God Amen. I Isaac Pinckney, of the Town of Warwick in the County of Orange and the state of New York being week in body but of sound mind and memory (Blessed be God) do this twenty seventh day of May in the year of our Lord one thousand eight hundred and fifteen make and publish this my last will and testament in manner and form following: that is to say. First. I bequeath to my beloved wife Sarah my cows and sheep, beds and bedding with all my household furniture all the residue and remainder of my property both real and personal I hereby order and direct my executors herein after named as soon as they shall think proper after my decease to sell and after paying all past debts the remainder to be put to use and one third of the interest arising from such monies to be annually paid to my said wife Sarah during the time she shall remain my widow provided she shall sign her right of dower to my real estate. The remaining two thirds I give and bequeath to my two sons Joel and Elisha when they shall arrive at the age of twenty one years to be equally divided between them and if my said wife Sarah shall refuse to sign the right of dower or get married or die at any time before or after my said sons shall arrive at age as aforesaid, then the whole of my estate I give to my sons Joel and Elisha (excepting the personal property given to my said wife in the first bequest of this will and testament) and if either of my said sons should die before he shall arrive at the age of twenty one years the other to have his part, and if both should die, I give and bequeath to my said wife Sarah one third part of the whole of my estate. I give to Henry Wisner fifty dollars and the remainder to be equally divided between Philian Vanderwort wife of Thomas Vanderwort, Philahan Weeden, daughter of Thomas Weeden and Isaac Odle son of Abraham Odle. And, I do hereby appoint Henry Wisner and Jacobus Berthof of Warwick aforesaid Executors to this my last will and testament and also guardians for my said children. In Witness whereof I have hereunto set my hand and seal the day and year first about written. Signed sealed published and declared by the above named Isaac Pinckney to be the Last Will and testament in the presence of us who have hereunto subscribed our names as witness in the presence of the Testator Isaac Pinckney, X his mark I Sarah Pinckney, wife of Isaac Pinckney do herby agree to accept the Interest and property bequeathed in the above last will and testament and release all my rights of dower on the real estate Sarah Pinckney Witness: Jeremy Odle Abraham Odell William J Weeden Orange county: be it remembered that on the twenty ninth day of June in the year of our Lord one thousand eight hundred and fifteen personally appeared before me Edward Ely, Esq. surrogate of the County of Orange Abraham Odell and being duly sworn did declare and say that he did see Isaac Pinckney deceased sign and seal the preceding written testament purporting to be the Last will and Testament of the said deceased and bearing date the twenty seventh day of May in the year of our Lord one thousand eight hundred and fifteen and heard him publish and declare same as and for his last will and testament that at at the time thereof the said deceased was of sound and disposing mind and memory to the best of his knowledge and belief and that he together with Jeremy Odle and William J Weeden subscribed their names thereto as witnesses in the testators presence and in the presence of each other. The proceeding is a true copy of the original will of Isaac Pinckney deceased of the Certificate of Proof Thereof and of the Letters testamentary thereon. Edward ely Esq. Surrogate.
