To all whom These presents Shall come or may concern send Greeting. Know ye that at Goshen in the County of Orange on the thirteenth day of January in the year of our Lord one Thousand eight hundred and twenty before Edward Ely, Esq. Surrogate of our said County. The last will and testament of Ebenezer Stephens, deceased (a copy whereof is hereunto annexed) was proved and is now approved by us and the said deceased having whilst he lived and at the time of his death goods chattels or credits within this state by means whence the proving and registering the said will and the granting administration of all and singular, the said goods chattels and credits and also the auditing, allowing and final discharging the account thereof doth belong unto us. The administration of all and singular, the goods chattels and credits of the said deceased and any way concerning his will is granted unto Holloway Stephens and Oliver Crane the executors in the said will named. They being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular, the said good chattels and credits and also to render a just and true account thereof when thereunto required, In testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed. Witness Edward Ely, Esq., Surrogate of the said County at Goshen the fourteenth day of January in the year of our Lord one thousand eight hundred and twenty and of our independence the forty-fourth. In the name of God Amen. I Ebenezer Stephens being weak in body but of sound and perfect mind and memory do make and publish this my last will and testament in manner and form following (that is to say) First I give and bequeath unto my beloved wife Mariah Stephens the best bed and bedding, five the best chairs, one high chest and one stand and such other furniture as my Executors may think proper, one cow, now to have the use of my house new lot in the Village of Brookfield while she remains my widow the lower part of the said house to be finished by my executors if she feels fit to keep house, and the rest of my property to be sold to the best advantage as my Executors may think proper and my debts to be paid out of the same and the remainder to be put to interest and when my eldest son William E Stephens arrives at age twenty one is to have one equal third and when my son Holloway W Stephens arrives at the age of twenty one is to have one equal half of the remainder and when my third son Ebenezer B Stephens arrives at the age of twenty one is to have the remaining part of my property except in each case what my executors may think proper to make use in bringing them up. I do also appoint Holloway Stephens and Oliver Crane for my executors. In witness whereof, I have hereunto set my hand and seal the fifth day of January one thousand eight hundred and twenty. Signed sealed and declared by the above named Ebenezer Stephens to be his last will and testament in the presence of us who have hereunto subscribed our names in the presence of the testator. Ebenezer Stephens Tho Sergeant; James Walker; Jesse Smith Jr. Orange county: be it remembered that on the thirteenth day of January in the year of our Lord one thousand eight hundred and twenty personally appeared before me Edward Ely, Esq. surrogate of the County of Orange James Walker and being duly sworn did declare and say that he did see Isaac Pinckney deceased sign and seal the paper writing then thereon unto him purporting to be the Last will and Testament of the said deceased of which the preceding is a copy and heard him publish and declare the same as and for his last will and testament. That at the time thereof he the said deceased was of sound and disposing mind and memory to the best of his knowledge and belief and that he together with Thomas Sergeant and Jesse Smith Jr. subscribed their names thereto as witnesses in the testators presence and in the presence of each other. The proceeding is a true copy of the original will of Ebenezer Stephens deceased of the Certificate of Proof Thereof and of the Letters testamentary thereon. Edward Ely Esq. Surrogate.
